RESOLUTION
RE: APPROVAL OF RECORDED EXEMPTION #1758 - MCINTYRE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under Section
30-28-101(10)(d), CRS, as amended, did determine at a public meeting held in the Chambers of
the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known
as Recorded Exemption #1758, does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land", and
WHEREAS, the request for Recorded Exemption #1758 was submitted by Keith A. and
Barbara K. McIntyre, 4804 F Street, Greeley, Colorado 80631, for property described as Lot B of
Amended RE #611, which is located in part of the SEY4 SE% of Section 34, Township 6 North,
Range 66 West of the 6th P.M., Weld County, Colorado, being more particularly described in the
plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded,
and
WHEREAS, this request is to divide the property into parcels estimated to be approximately
22 acres and 10 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from
the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1758 submitted by
Keith and Barbara McIntyre be, and hereby is, approved conditional upon the following:
1. A Weld County septic permit is required for any proposed home. It shall be installed
according to the Weld County Individual Sewage Disposal System (ISDS)
regulations.
2. Prior to recording the plat, any existing septic system(s) which is not currently
permitted through the Weld County Health Department shall require an ISDS
evaluation.
3. The applicant shall submit a mylar plat to the Department of Planning Services to
be recorded in the office of the Weld County Clerk and Recorder. The plat shall be
prepared in accordance with the requirements of Section 11.7 of the Weld County
Subdivision Ordinance. The plat shall be submitted within sixty days from the date
of approval by the Board of County Commissioners. The applicant shall be
responsible for paying the recording fees.

4. The applicant shall transfer to the purchaser of Lot B one (1) share of irrigation
water from the No. 3 Ditch. The applicant shall provide evidence of the transfer to
the Department of Planning Services staff within thirty (30) days after the date of the
transfer.
5. Prior to recording the plat, the applicant shall present to the Department of Planning
Services staff evidence of a well permit for Lot B issued by the State of Colorado
Division of Water Resources.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 2nd day of August, A.D., 1995.

Dear Commissioners:
This request for a recorded exemption is submitted by Keith A. McIntyre. The parcel of land under
consideration is described as part Lot B of AmRE-611 located in part of the SE4, SE4 of Section 34,
T6N, R66W of the 6th P.M., Weld County, Colorado. The property is located south of and adjacent
to F Street and approximately 1 mile west of 35th Avenue. The applicants are requesting to further
divide Lot B of AmRE-611 into two parcels of 22 acres and 10 acres, more or less.
A water well is the water source on Lot A and is proposed for Lot B. A septic system currently
provides proposed Lot A with water and is proposed for Lot B. Access is existing onto F Street. The
City of Greeley has reviewed this request and has no objectionst. The Weld County Health
Department and Weld County Public Works Department have reviewed this request and both have
recommended approval.
Recorded Exemption 611, approved by the Board of County Commissioners on May 5, 1983, created
two lots of 35 acres and 4 acres. Amended Recorded Exemption 611, approved by the Department
of Planning Services on November 25, 1986 amended Lot B from 30 + acres to 31 ±. Concurrently
Subdivision Exemption 288 was also approved by the Department of Planning Services' staff for lot
line boundary adjustment. The applicant is now requesting to further subdivide the 32 acre parcel
into two lots of 22 acres and 10 acres, more or less. The applicants have stated in their application
that the reason for this request is that they are advancing in age and do not own the horses and
cattle that they once did. The applicants desire to live in the existing home and sell the remaining
acreage to a prospective buyer who wishes to construct a residence on it.

The Department of Planning Services' staff has concerns that the creation of an additional buildable
lot at this location is not consistent with orderly and efficient development. Staff also has concerns
with the applicant adding additional septic systems and water wells with such close proximity to the
City of Greeley. The city limit of Greeley lies directly south of the subject property. Staff also has
concerns that the criteria of the Comprehensive Plan have not been meet. The criteria for evaluating
recorded exemptions are as follows:
1. Enable the property owner who is retiring an opportunity to live on or sell the existing farm
improvements.
2. Enable the property owner to sell off agricultural land that is nonproductive for one single
family dwelling homesite.
3. Enable the property owner to provide a residence for direct members of the farm family and
also for workers employed at the farm.
The Department of Planning Services' staff requests that the Board of County Commissioners
consider this request and determine if the standards of Sections 11.5.1 through 11.5.7 of the Weld
County Subdivision Ordinance have been met.

RECORDED EXEMPTION QUESTIONAIRE

1. Explain the reason for the proposed recorded exemption and' how each proposed lot will be used.
The applicants own 32 acres of land. With my children grown and advancing in age,
we don't own the horses and cattle we once did, so we do not need all of the land-.
We desire to continue living in the house, however we do have a prospective buyer
who wishes to purchase 22 acres to put his residence on. The property is not
prime agricultural land, but is best used for residential acreage.
2. Describe the location, size and present use of the area where each proposed new lot will be created.
The new lot would be located south of F Street from approximately 49th Avenue to
50th Avenue and south of the No. 3 ditch from 47th Avenue to approximately 51st
Avenue. It is currently pasture land. The division between the two properties will
follow, almost exclusively, the existing fence lines and the natural division
caused by the No. 3 ditch.
3. Explain how the proposal is consistent with the Weld County Comprehensive Plan and any adopted
municipal plan, if applicable. I believe the area in which the proposed split exists
is proposed as future residential. Each parcel remaining (10± acres and 22± acres)
is large enough for regular subdivision if that were considered desirable in the
future. The area is currently small scale, agricultural mixed with some farmed
fields. The proposed split will be consistent with current use of this land and
the surrounding property.
4. Explain how the uses permitted will be .compatible with existing uses surrounding the proposed
recorded exemption. The residences along F Street are all country -type
residences. All parcels under 80.acres range from 1 to 2 acres (across the.
street and 1/8 mile east), to 4 acres (1/8 mile east) to 5 acres (1/8 mile west)
to 10 acres (1/4 mile west) to 24 acres (1/2 mile west). This use would be consistent
with this 2 mile stretch of F Street.
5. Explain how the proposal is consistent with the intent of the zoning district it is located within.
This is zoned agricultural. These parcels are large enough to support
small-scale agricultural uses such as pasturing horses and cattle etc.
6. Explain how the proposal is consistent with efficient and orderly development.
As noted above, both parcels are large enough to support future subdivision if
desirable. They are however, small enough to be utilized as is without major
investment in livestock or equipment. The property has not had a history of use
for commercial crops and much of it is unsuitable for anything but pasture and
residential.

All three parcels have road frontage on "F" Street.
In the Fall of 1986, the brewers contacted the applicant requesting the
purchase of approximately 3 additional acres to add to the existing one acre,
making a 4 acre parcel with contiguous boundaries. The applicants and the
brewers are seeking approval of that transfer through a subdivision exemption
request filed contemporaneously with this request for an amended recorded
exemption. The applicant was informed that it is necessary to amend the
boundaries of Lot B of Recorded Exemption #611 to make them conform to the
proposed transfer. The before and after maps done by the surveyor were drawn
ignoring the Recorded Exemption which was completed in 1983. According to the
surveyor, this was done at the suggestion of a member of the planning
department.

We received the resolution of the Board of County Commissioners on the above
recorded exemption.
I noticed the language in that recorded exemption still states as follows:
"2) any new structure on Lot "B" must be served with Greeley City sewer;".
It is my understanding from my telephone conversation with the Planning
Department, with you, and with the County Commissioners on the day on which
this was passed, that, In fact, it was the understanding of all parties that
if the structure was located more than 400 feet from the street or the sewer
line that it would not have to be served with Greeley City sewer. This was,
in fact, the recommendation by the Greeley Planning Commission and it is my
understanding this was approved by the County Commissioners. I wonder if the
resolution, perhaps, should not be amended to reflect this or if there is
some reason to leave it in the way it is even though it is apparently the
understanding of all parties that the 400 -foot limitation is, in fact, in
effect.
The reason I wish to be precise and get this matter resolved is that, at the
time a building permit is requested, if the structure is located more than
400 feet away from the street and sewer, we will be requesting a leach field
and are trying to minimize at this point any difficulties we will have then
in getting our building permit.
I hope to hear from you with regard to this problem. Thank you very much for
