RE: GRANT CHANGE OF ZONE #495 FROM C-3 (COMMERCIAL) TO PUD (PLANNED UNIT
DEVELOPMENT) FOR C-3 (COMMERCIAL) USES - QUINLAN CONSTRUCTION, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, a public hearing was held on the 12th day of July, 1995, at 10:00 a.m. for the
purpose of hearing the application of Quinlan Construction, Inc., 5540 Central Avenue, Boulder,
Colorado 80301, requesting a Change of Zone #495 from C-3 (Commercial) to PUD (Planned Unit
Development) for C-3 (Commercial) uses for a parcel of land located on the following described
real estate, to -wit:
Lot 2 of RE #1201, in part of the WA SW' of Section 11,
Township 2 North, Range 68 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the applicant was represented by Gary Shaw, Vice President of Quinlan
Construction, Inc., representing Flatiron Structures, and
WHEREAS, Section 21.6.2 of the Weld County Zoning Ordinance provides standards for
review of such a Change of Zone, and
WHEREAS, the Board of County Commissioners heard all the testimony and statements
of those present, studied the request of the applicant and the recommendation of the Weld County
Planning Commission and, having been fully informed, finds that this request shall be approved for
the following reasons:
1. The applicant has complied with all the application requirements listed in Section
21.7 et seq., of the Weld County Zoning Ordinance.
2. The request is in conformance with Section 21.6 of the Weld County Zoning
Ordinance as follows:
a. The proposed Planned Unit Development (PUD) District is located within the
1-25 Mixed Use Development Area (1-25 MUD). The uses associated with
the proposed PUD District are consistent with the uses identified in the 1-25
MUD Conceptual Land Use Plan of the Weld County Comprehensive Plan.
b. The uses allowed in the proposed PUD District will conform to the
Performance Standards set forth in Section 35.3 of the Weld County Zoning
Ordinance.

c. The uses permitted shall be compatible with the existing or future
development of the surrounding area as permitted by the existing zoning
and with the future development as projected by the Comprehensive Plan.
Surrounding land uses include outside storage and a contracting business,
vacant commercial ground, manufactured home sales, and Interstate 25
right-of-way.
d. Adequate water and sewer service will be made available to the property to
serve the proposed uses. Central Weld County Water District and St. Vrain
Sanitation District will provide water and sewer service to the site.
e. Highway facilities providing access to the property are adequate in
functional classification, width, and structural capacity to meet the traffic
requirements of the proposed commercial uses. 1-25 Frontage Road will
provide access to the PUD, in accordance with the letter from Teresa Jones,
Colorado Department of Transportation, dated May 16, 1995.
f. No overlay districts, restrictive soil conditions, or commercial mineral
deposits are known to be located on the subject site.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the application of Quinlan Construction, Inc., requesting a Change of Zone
#495 from C-3 (Commercial) to PUD (Planned Unit Development) for C-3 (Commercial) uses on
the above referenced parcel of land be, and hereby is, granted subject to the following conditions:
1. The Change of Zone plat shall be delivered to the Department of Planning Services
and be ready for recording in the Weld County Clerk and Recorder's Office within
15 days of the date of approval by the Board of County Commissioners.
2. The following notes shall be placed on the PUD District plat:
a. Uses allowed within the PUD District shall comply with uses identified in the
C-3 (Commercial) Zone as set forth in Section 33.4 of the Weld County
Zoning Ordinance.
b. A site plan review shall be required for all uses within the PUD, in
accordance with Section 33.4.5 of the Weld County Zoning Ordinance.

c. All streets within the PUD District are private and shall be built to County
standards. All streets within the PUD District shall be maintained by the lot
owners of the PhD District.
d. Central Weld County Water District shall provide the PUD District water
supply.
-e. St. Vrain Sanitation District shall provide sewer service to the PUD District.
f. Installation of utilities shall comply with Section 10 of the Weld County
Subdivision Regulations.

Each lot within the PUD shall be developed with no less than 15 percent
open space.
h. Landscaping within the 1-25 Frontage Road right-of-way on Lots 1 or 2 shall
be maintained in such a way that it does not impair site distance at any
access, does not present a safety hazard to the travelling public on the 1-25
Frontage Road, and shall be maintained by the respective lot owners. No
trees shall be allowed within the 1-25 Frontage Road right-of-way.
3. The PUD Plan application submittal shall contain the following information:
a. Identify a location on the PUD Plan plat where potential oil and gas uses will
occur within the PUD District.
b. Document the applicant's willingness to satisfy concerns expressed by
Teresa Jones, Colorado Department of Transportation, regarding future
addition of auxiliary lanes to the 1-25 Frontage Road, drainage, utility permit
and temporary state highway access permit, in her letter dated May 16,
1995.
It. Evidence that all permits required by the Department of the Army Corps of
Engineers have been obtained for this PUD development.
d. Documentation verifying the future right-of-way location of the 1-25 Frontage
Road lying west of and adjacent to the subject property, as approved by the
Colorado Department of Transportation. Said future right-of-way line shall
be shown on the PUD Plan plat.

The above and foregoing Resolution was, on motion duly made and seconded, adopted by the
