RESOLUTION
RE: APPROVAL OF RECORDED EXEMPTION #2599 - IRIS KRAUTSCHUN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10)(d), C.R.S., did determine at a public meeting held in the Chambers of
the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat
known as Recorded Exemption #2599, does not come within the purview of the definition of the
terms, "subdivision" and "subdivided land", and
WHEREAS, the request for Recorded Exemption #2599 was submitted by Iris
Krautschun, c/o Douglas Stolte, 800 8th Avenue, Suite 235, Greeley, Colorado 80631, for
property which is located in part of the NE1/4 of Section 33, Township 5 North, Range 63 West
of the 6th P.M., Weld County, Colorado, being more particularly described in the plat which
shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels estimated to be
approximately 3.5 acres and 2.5 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is,
exempt from the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Recorded Exemption #2599 by Iris
Krautschun, do Douglas Stolte is, approved conditional upon the following:
1. A Weld County septic permit is required for any proposed home. The septic
system shall be installed according to the Weld County Individual Sewage
Disposal System (I.S.D.S.) regulations.
2. Prior to recording the plat:
A. In accordance with Weld County Public Works Ordinance #180, Lots A
and B shall utilize the existing residential/agricultural access point. No
circle drives or additional accesses shall be granted. The access will be
placed in such a location to have adequate sight distance in both
directions and not below the crest of a hill or where physical obstructions
are present. These roads will be graded and drained to provide all
weather access.
B. All approved accesses shall be clearly shown on the plat. The applicant
shall contact the Weld County Department of Public Works to determine
if a culvert is necessary at any approved access point. If a drainage
culvert is required, a 15-inch CMP is the County minimum size. If the
applicant chooses to place a larger culvert, please contact the Weld
County Department of Public Works to adequately size the culvert.

C. Weld County Road 380 is designated on the Transportation Plan Map as
a local gravel road, which requires 60 feet of right-of-way at full build out.
There is presently 60 feet of right-of-way. This road is maintained by
Weld County. A total of 30 feet from the centerline of Weld County Road
380 shall be delineated on the plat as right-of-way.
D. Both Lots A and B shall comply with the one (1) acre minimum lot size
required by Section 11.8.5 of the Weld County Subdivision Ordinance.
E. The following notes shall be placed on the plat:
1) All proposed or existing structures will meet the minimum setback
and offset requirements for the Zone District in which the property
is located. Pursuant to the definition of setback in the Weld
County Zoning Ordinance, the required setback is measured from
the future right-of-way line.
2) Any future structures or uses on the site must obtain the
appropriate zoning and building permits.
3) Prior to the release of building permits, the applicant shall submit
evidence to the Department of Planning Services that Lot A has
an adequate water supply of sufficient quality, quantity and
dependability.
4) Prior to the release of building permits on Lots A or B, the
applicant will be required to submit a recorded deed describing
the lot upon which the building permit is requested with the
building permit application. The legal description on such deed
shall include the lot and recorded exemption number.
5) Should noxious weeds exist on the property or become
established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the
noxious weeds, pursuant to Ordinance #169-A.
6) RIGHT TO FARM COVENANT
Weld County is one of the most productive agricultural counties in
the United States. The rural areas of Weld County may be open
and spacious, but they are intensively used for agriculture.
Persons moving into a rural area must recognize there are
drawbacks, including conflicts with longstanding agricultural
practices and a lower level of services than in town.
Agricultural users of the land should not be expected to change
their long-established agricultural practices to accommodate the
intrusions of urban users into a rural area. Well run agricultural

activities will generate off-site impacts, including noise from
tractors and equipment; dust from animal pens, field work,
harvest, and gravel roads; odor from animal confinement, silage,
and manure; smoke from ditch burning; flies and mosquitoes; the
use of pesticides and fertilizers in the fields, including the use of
aerial spraying. Ditches and reservoirs cannot simply be moved
"out of the way" of residential development without threatening the
efficient delivery of irrigation to fields which is essential to farm
production.
Weld County covers a land area of over 4,000 square miles in
size (twice the State of Delaware) with more than 3,700 miles of
state and county roads outside of municipalities. The sheer
magnitude of the area to be served stretches available resources.
Law enforcement is based on responses to complaints more than
on patrols of the county and the distances which must be traveled
may delay all emergency responses, including law enforcement,
ambulance, and fire. Fire protection is usually provided by
volunteers who must leave their jobs and families to respond to
emergencies. County gravel roads, no matter how often they are
bladed, will not provide the same kind of surface expected from a
paved road. Snow removal priorities mean that roads from
subdivisions to arterials may not be cleared for several days after
a major snowstorm. Snow removal for roads within subdivisions
are of the lowest priority for public works or may be the private
responsibility of the homeowners. Services in rural areas, in
many cases, will not be equivalent to municipal services.
Children are exposed to different hazards in the county than in an
urban or suburban setting. Farm equipment and oil field
equipment, ponds and irrigation ditches, electrical power for
pumps and center pivot operations, high speed traffic sand burs,
puncture vines, territorial farm dogs, and livestock present real
threats to children. Controlling children's activities is important,
not only for their safety, but also for the protection of the farmer's
livelihood.
3. The applicant shall submit a mylar plat to the Department of Planning Services to
be recorded in the office of the Weld County Clerk and Recorder. The plat shall
be prepared in accordance with the requirements of Section 11.7 of the Weld
County Subdivision Ordinance. The plat shall be submitted within sixty (60) days
from the date of approval by the Weld County Board of Commissioners. The
applicant shall be responsible for paying the recording fees.

The Department of Planning Services'staff has reviewed this request and recommends that this request be denied
for the following reasons:
1. It is the opinion of the Department of Planning Services' staff that the applicant has not shown compliance with
Section 11.4.2.1 through 11.4.2.6 of the Weld County Subdivision Ordinance, as follows
d. Section 11.4.2.4-Consistency with the purpose of efficient and orderly development as expressed in Section
1.3 of the Weld County Subdivision Ordinance.
1) Section 1.3.1 -Assisting orderly and integrated development.The proposed Recorded Exemption would
create an additional residential lot on land that is not large enough to support successful farming
practices. The present size of the lot is approximately six (6) acres. The applicant proposes to divide
off the existing house from the dry land pasture ground to create two parcels of two and a half(2.5)
acres and three and a half (3.5) acres respectively. In the recorded exemption questionnaire the
applicant proposes that, "both parcels shall be used as agriculture residences" The Department of
Planning Services' staff believes that this proposed recorded exemption does not meet the intent of
the recorded exemption, as stated in Section 11.2 of the Subdivision Ordinance. The intent of the
recorded exemption has been traditionally interpreted to mean that a small piece of agricultural land
is eligible to be divided off from a viable farming operation. This parcel of non irrigated pasture land is
not a viable farming operation.
In addition, the configuration of the parcel, a long, narrow strip of land bordered by Rail Road Right-of-
Way to the north and WCR 388 Right-of-way to the south, does not lend itself to efficient land division.
Should the Board of County Commissioners approve this request, the Department of Planning Services' staff
recommends the following conditions be attached:.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to
the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.

2. Prior to recording the plat:
A. A 30-foot wide joint access easement extending across Lot A from Weld County Road 380, for the benefit of
both Lots A and B, shall be clearly shown on the plat. The joint access easement shall be dedicated for the
use as shown utilizing the language set forth in Section 11.7.1.12.5 of the Weld County Subdivision Ordinance
B. In accordance with Weld County Public Works Ordinance #180, Lot A and Lot B shall utilize the existing

Dear Commissioners:
Ms. Iris Krautschun requested a Recorded Exemption on P.t.. NE4 Section 33, Township 5
North, Range 63 West of the 6th P.M., Weld County, CO. The 6 acre parcel is north of and
adjacent to WCR 380 and approximately 1/2 mile east of WCR 65.
Planning staff has found that the application is not in compliance with Section 11.8.7 of the
Weld County Subdivision Ordinance. For this reason we are requesting the case be reviewed by
the Board of County Commissioners.
Department of Planning Services' staff has the following concerns:
1. The parcel being considered for a recorded exemption is not currently a viable farming
operation. Dividing this land further is not consistent with the intent of the recorded
exemption application process. In addition, the configuration of the parcel, a long, narrow strip
of land bordered by Rail RoadRight-of-Way to the north and WCR 388 Right-of-way to the
south, does not lend itself to efficient land division.
2. The conflict between rural and urban activities is evident in this request. When an urban
growth pattern is established without regard to long range comprehensive planning the
outcome lacks the essential elements of long term desirability. Higher costs are incurred by
providing many public services to urban sprawl areas. As urban areas develop and expand
they inadvertently influence surrounding areas. These areas are either converted to urban
uses themselves or are in direct conflict and competition with agricultural areas.
3. The applicant has failed to comply with the A (Agricultural) zone district intent. This parcel is
located outside of an Urban Growth Boundary Area. Continued division of this parcel
emphatically opposes the intent of the A (Agricultural) zone district. The potential to interfere
and encroach upon the agricultural activities of this area is evident. The A (Agricultural) zone
district was established to promote and maintain agriculture as a vital support element for
Weld County Citizens, and not to be continually decreased for residential development. The
Agricultural zone policies discourage the conversion of agricultural land for residential uses
within an area located outside of an urban growth boundary. The intent is to eliminate
incompatibilities that exist and minimize costs to Weld County tax-payers.
The applicant has chosen to subdivide the land without regard to the long term impacts of the
division. By doing so, the applicant has not been required to pay for the cost of public
services and improvements that their current proposed division are producing. The
Department of Planning Services' staff is concerned with this lack of consistency with the
Comprehensive Plan and Subdivision Ordinance.
Specifically, the Department of Planning Services' staff recommendation of denial for this
request is based upon the application's inconsistency with Section 1.3 of the Weld County
Subdivision Ordinance, which ensures orderly and efficient subdivision development within the
county, and conflicts with A. Goals 3, 4, 6, 7, and 9 of the Comprehensive Plan, which define
appropriate development goals and policies within the Agricultural zone district.
Scattered residential development in rural areas necessitates an increased demand for roads
and bridges, police and fire protection, education facilities, utilities and other services. The
cost of providing services and the conflicts between rural and urban land uses can be reduced
if development is encouraged within urban growth boundary areas or are adjacent to existing
municipalities.
The Department of Planning Services' staff requests that the Board of County Commissioners
consider the application and determine if the standards of Sections 11.2 through 11.8 of the
Weld County Subdivision Ordinance have been met and adhere to the goals and policies of
the Weld County Comprehensive Plan.

All that part of the Northeast Quarter (NE1/4) of Section Thirty-three (33),
Township Five (5) North, Range Sixty-three (63) West of the Sixth Principal
Meridian (6th P.M.), Weld County, Colorado, lying North of the county road
right-of-way as now established on the premises and south of the right-of-way of the
Union Pacific Railroad Company.
RECORDED EXEMPTIONS QUESTIONNAIRE
1. Water supply statements addressing the following:
A can serve letter from the Central Weld County Water District is
included with this application. C.W.C.W.D. water has proven history of
high quality and dependability for domestic use in rural Weld County. There
is a main line located in Weld County Road#380 adjacent to this proposed
Recorded Exemption which warrants sufficient quantity to serve its needs.
There is no irrigation water used on proposed Lot"A"or proposed Lot"B".
2. A statement explaining that the proposed lots will have adequate means
for disposal of sewage in compliance with the requirements of the
underlying zone district and the Weld County Health Department. A copy
of the septic permit or a letter from the sewage disposal facility must
accompany the application.
A "Statement of Existing" septic permit has been applied for proposed
Lot"B"together with this application. An I.S.D.S. permit shall be applied
for according to the regulations of the Weld County Health Department
when needed for proposed LOT "A". No such permit is requested at this
time.
3. A description of how the property is being used. When the Parcel(s) is
located in the agricultural zone district, the description shall include
approximate acreage of prime and nonprime farmland as defined in the
Weld County Comprehensive Plan, number and types of livestock and any
existing improvements such as the principal residence, labor home, mobile
home, manufactured home, barn outbuildings, irrigation ditches, and oil
well production facilities on the property.
The subject property is currently used as an agriculture residence
together with a small amount of dry pasture land. Proposed Lot"B"
includes the existing dwelling and other outbuildings. Proposed Lot"A" is
vacant dry land pasture. There is no farm ground on the subject property.
This parcel is bound on its North boundary by an abandoned Railroad right
of way.
4. The reason for the proposed recorded exemption with an explanation how
each lot will be used.
The reason for the proposed Recorded Exemption is to separate the existing
residence from the dry pasture land. Both proposed parcels shall be used as
agriculture residences.
5. A description of the location, size, and present use of the area where the
proposed new lot(s)will be created.
The proposed Recorded Exemptions is located in an area which is primarily
farmland and rural residence. LOT "A" shall be approximately 2 1/2 acres
in size and located in a non-farmland area. LOT"B" has no agricultural
productivity. Lot "B"is an agricultural residence consisting of
approximately 3 1/2 acres.
6. A statement describing any unique physical characteristics on the site, if
applicable.

There is a principal residence located on proposed LOT "B"which meets all

This proposal is consistent with the Weld County Comprehensive Plan in
that it keeps the prime farmland in productivity and upholds the agricultural
productivity of the county. It also enhances the non-rime farmland by
creating tax revenue for the county and the improved maintenance and
upkeep typically associated with owner occupied residences.
11. A statement explaining how proposed uses will be compatible with
existing surrounding land uses.
The proposed uses for this proposed Recorded Exemption are compatible
with surrounding land uses in that the entire area is agricultural farmland
and small acreage residences. These uses are consistent with this
application.
12. A statement explaining how the proposal is consistent with the intent of
the district it is located within as expressed in the Weld County Zoning
Ordinance, as amended, and the Weld County Comprehensive Plan.
The proposal is consistent with the Weld County Zoning Ordinance which
allows for Recorded Exemptions in the Agricultural Districts. It allows for
the creation of lots with a minimum size of 1 acre and this proposal
complies. The intent of the Comprehensive plan is to preserve the prime
farmland and improve the non-prime farmland. This proposal is consistent
with that intent.
13. A statement explaining how the proposal is consistent with efficient and
orderly development as defined in the Weld County Subdivision
Ordinance, Section 1.3.
This proposal is consistent with efficient and orderly development. It meets
the requirements as set forth in the Weld County Subdivision Ordinance for
Recorded Exemptions.
A small portion of the East end of the subject parcel is located within the
100 year flood boundary. The building site for proposed Lot
"A"is located outside the flood boundary. A copy of the F.E.M.A.
flood hazard map is provided with this application to illustrate the 100 year
flood zone as it relates to the subject property. This proposal is not located
within the geological overlay district or within any municipality urban
growth district.
This proposal contains no productive farmland at all. Adequate domestic
utilities are available and there is adequate acreage for the creation
of a new lot. No productive farmland will be taken out of production.

recommended to be a part of any approval:
COMMENTS:
WCR 380 is designated on the Transportation Plan Map as a local gravel road which requires 60 feet of right-of-
way at full build out. There is presently 60 feet of right-of-way. This road is maintained by Weld County. Pursuant
to the definition of SETBACK in the Weld County Zoning Ordinance (Ordinance 89, as amended), the required
setback is measured from the future right-of-way line.
WCR 65 is designated on the Transportation Plan Map as a local gravel road which requires 60 feet of right-of-way

COLORADO SUBJECT: I.S.D.S. Flood Plain Policy
Septic systems will not be allowed to be located in the floodway.
Septic systems will be allowed in the flood plain, but the system must be installed in a manner
as to prevent the infiltration of groundwater into the septic tank and to prevent the release of
sewage from the tank during a flood event.
If the tank is above the flood plain elevation, no special installation requirements would be
necessary.
If the tank is not above the flood plain elevation then the access to the tank manhole lids must
be covered with 20 mil PVC and sealed with plumbers cement. When the seal is broken, i.e.
the tank is opened for pumping, etc., the tank must be re-sealed prior to backfilling again. A
backflow preventer or one-way valve, must also be installed in the effluent line between the
tank and the absorption field.
All other percolation and suitable soil criteria must be met for a conventional septic system to be
installed.
For inspection purposes, the materials to seal the manhole lids must be on site. The manholes
are not required to be sealed at the time of inspection in order to allow for the inspection of tcc's
in the tank.

Dear Mr. Krautschun:
This letter is in response to your request for the availability of additional water service for the
following described property:
NE '/4 Section 33, Township 5 North, Range 63 West of the 6th P.M., Weld County.. Colorado,
lying North of the county road right-of-way as now established on the premises and South of the
right-of-way of the Union Pacific Railroad Company.
Water service is presently available to the above described property by tap number 230 located at
Weld Co. Rd. 380 between 65 & 67. Additional water service can be made available to this
property provided all requirements of Central Weld County Water District, Northern Colorado
Water Conservancy District and the Bureau are satisfied. Please note that you are responsible for
confirming that this property has met the requirements of Northern Colorado Water
Conservancy District and the Bureau. Central Weld cannot issue a tap until all requirements
are satisfied.
Central Weld County Water District requires that contracts he consummated within one (1) year
from the date of this letter or this letter shall become null and void unless extended in writing by the
District. Please contact the Central Weld office for further information about water service. The
water main presently serving the area may be inadequate for additional taps, and improvements to
existing infrastructure may need to be made.
