HomeMy WebLinkAbout991526.tiff RESOLUTION RE: VACATION OF A PORTION OF WELD COUNTY ROAD 84 BETWEEN WELD COUNTY ROADS 71 AND 75; AND A PORTION OF WELD COUNTY ROAD 73 BETWEEN WELD COUNTY ROADS 82 AND 86 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Public Works Department has recommended that a portion of Weld County Road 84 between Weld County Roads 71 and 75; and a portion of Weld County Road 73 between Weld County Roads 82 and 86 be vacated, subject to dedicated and recorded easements and rights-of-way, said roads being fully described as follows: The public road right-of-way lying 30 feet to the south side of the section line between Sections 1 and 12, Township 7 North, Range 63 West, and between Sections 6 and 7, Township 7 North, Range 62 West; and public road right-of-way lying 30 feet to the east of the section line between Section 1 Township 7, Range 63 West and Section 6, Township 7, Range 62 West, and road right- of-way lying 30 feet to the east of the section line between Section 12, Township 7, Range 63 West, and Section 7, Township 7, Range 62 West of the 6th P.M., Weld County, Colorado WHEREAS, by notice dated June 4, 1999, and mailed on that date, the adjoining landowners were notified by the Clerk to the Board of a public hearing set for June 21, 1999, to consider the vacation, in accordance with the requirements of Section 43-2-303(2)(b), C.R.S., of those portions of Weld County Roads 84 and 73, a copy of the legal description is attached hereto and included by reference, and WHEREAS, the Board of County Commissioners convened a public hearing on June 21, 1999, and heard testimony and reviewed all other evidence presented therein by staff and the public, and WHEREAS, the evidence showed that vacation of those portions of Weld County Roads 84 and 73, described above will not leave any land adjoining the roadway without an established public road or private access easement connecting the land with another established public road, and WHEREAS, the Board of County Commissioners deems it advisable to vacate said portions of Weld County Roads 84 and 73, with said vacations to become effective upon recording as required below.
