RESOLUTION OF RECOMMENDATION TO THE BOARD OF COUNTY COMMISSIONERS
Moved by Rusty Tucker that the following resolution, with the deletion of Condition of Approval 1f, with
subsequent relettering, and the addition of Condition of Approval 2m, be introduced for passage by the Weld
County Planning Commission. Be it resolved by the Weld County Planning Commission that the application
for:

REQUEST: Site Specific Development Plan and Planned Unit Development Final Plan
LEGAL DESCRIPTION: The E2SW4 and a parcel of land in the W2SW4 of Section 11 and Lot B of
RE-1400 being a portion of the NW4 of Section 14, all in T2N, R68W of the
6th P.M., Weld County, Colorado
LOCATION: North of and adjacent to and south of and adjacent to Weld County Road 22; approximately
% mile west of Weld County Road 11
be recommended favorably to the Board of County Commissioners for the following reasons:
1. The submitted materials are in compliance with the application requirements of Section 28.9 of the
Weld County Zoning Ordinance, as amended.
2. The request is in conformance with Section 28.13 of the Weld County Zoning Ordinance, as amended
as follows:
a. Section 28.13.1.1 - That the proposal is consistent with the Weld County Comprehensive
Plan. PUD.Goal 2 encourages creative approaches to land development which will result in
environments of district identity and character. The proposed PUD includes a mixture of
commercial, industrial, residential and open space components. The PUD also includes a
new county road that has been described in the MUD Ordinance, Ordinance 191, that is
designed to relieve pressure from the 1-25 east frontage road. The intent of the Final Plan is
to plat Del Camino Parkway, delinate block layout and delinate oil and gas drill sites.
b. Section 28.13.1.2-That the Planned Unit Development Plan conforms to the PUD District in
which itis proposed to be located. The proposed Final Plan conforms to the approved PUD
District. The Utility Coordinating Advisory Committee reviewed and conditionally approved
the PUD utility plan at its November 13, 1997 meeting. The concerns of the Utility
Coordinating Advisory Committee are addressed in the Conditions of Approval.
c. Section 28.13.1.3-That the uses, buildings and structures which would be permitted shall be
compatible with the existing or future development of the surrounding area as permitted by
the existing zoning and with the future development as projected by the comprehensive plan
or master plans of affected municipalities. The proposed PUD Final Plan is consistent with
the Weld County Comprehensive Plan and the MUD Ordinance, Ordinance 191. The PUD
Final Plan is compatible with the future development as permitted by the existing PUD District
and plans of affected municipalities. The subject PUD Final Plan lies within the

Intergovernmental Agreement Area,Ordinance 195,with the Town of Firestone and Frederick.
Section 4.3(b) requires an executed annexation agreement with the Towns as a condition of
approval of this application request.
d. Section 28.13.1.4 - That there has been conformance with the Performance Standards
outlined in Section 35.3 of the Weld County Zoning Ordinance, as amended. The PUD Final
Plan adheres to all Performance Standards as described in Section 35.3.
e. Section 26.13.1.5- That there will be compliance with the Weld County Zoning Ordinance,
Section 50, Overlay Districts if the proposal is located within any Overlay District area
identified by maps officially adopted by Weld County. Portions of the PUD Final Plan lies with
the flood plain as described in FEMA Community Panel Maps 080266 0850C and 080266
0861 C, dated September 28, 1982. Conditions of Approval address this issue.
This recommendation is based, in part, upon a review of the application materials submitted by the applicant,
other relevant information regarding this request, and responses from referral entities.
The Planning Commission's recommendation for approval is conditional upon the following:
1. Prior to recording the PUD Final Plan plat:
a. The typical cross section of the local streets as indicated in the application materials is
described as having a 22 foot wide driving lane with four feet of gravel shoulders. The cross
section shall be amended to reflect the local employment and residential cross sections as
indicated in Figure 2.10 of the MUD Plan, Ordinance 191. (Public Works)
b. The plat shall be amended to include a temporary paved cul-de-sac which shall be
constructed at both ends of Del Camino Parkway to accommodate turn around for public and
emergency vehicles. (Public Works)
c. A storm water drainage plan shall be submitted for review and approval to the Weld County
Public Works Department. (Public Works)
d. Information shall be submitted for review and approval to the Department of Planning Services
that describes,in detail,within each block the highest intensity of potential uses and proposed
infrastructure needs of the development. After approval by staff the information shall be
delineated on the plat. (Planning)
e. Clarification shall be submitted to the Department of Planning Services for the delineation of
Del Camino Parkway being located on a portion of the eastern portion of Lot A of RE-1400.

f. The plat shall be amended to show a 15 foot utility easement around the perimeter of the
development. (Planning)
g. Information regarding the maintenance of the designated oil and gas areas shall be submitted
for review and approval to the Department of Planning Services. (Planning)

2. The following notes shall be placed on the PUD Final Plan plat prior to recording:
a. The intent of the Final Plan is to plat Del Camino Parkway, delinate block layout and delinate
oil and gas drill sites. (Planning)
b. The uses permitted within the PUD Final Plat shall include those uses allowed in the C-1 C-2,
C-3, I-1,I-2, residential uses and open space which comply with the PUD District as described
in the application materials. (Planning)
c. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld
County Zoning Ordinance. (Planning)
d. Central Weld County Water District shall provide water service to all uses within the PUD
District. (Planning)
e. St. Vrain Sanitation District shall provide sewage disposal to all lots within the PUD District.

f. Installation of all utilities shall comply with Section 10 (Design Standards) of the Weld County
Subdivision Ordinance, as amended and the conditions of the Weld County Utility Board.

g. All uses within the PUD Final Plan shall attempt to comply with the requirements of the
Mountain View Fire Protection District. (Planning)
h. Primary access to the development will be from Weld County Road 22 and Del Camino
Parkway. (Public Works)
Landscaping and signage shall comply with the MUD Ordinance 191. (Planning)
j. All lots and uses within the PUD shall adhere to the MUD Development Standards as
described in Ordinance 191. (Planning)
k. A road improvements and maintenance agreement regarding collateral shall be submitted for
the PUD for future filings. (Public Works)
Development within each of the commercial and industrial zoned blocks shall occur as
follows: (Planning)
1. If a user intends to utilize the entire block for development a Site Plan Review shall
be submitted to the Department of Planning Services for review and approval.
2. To establish lots within each block for separate users a PUD Final Plan and Site Plan
Review shall be submitted to the Department of Planning Services for review and
approval. The PUD Final Plan shall be reviewed and approved by the Board of
County Commissioners.
m. When applicable,the applicant shall be in compliance with the Intergovernmental Agreement
with the Towns of Frederick and Firestone, Ordinance 195, Section 4.3(b), and submit an
executed annexation agreement with the Towns to the Department of Planning Services.
