REQUEST: Minor Resubdivision of Tract "A" of Arrowhead Subdivision 4th Filing into two
(2) lots.
LEGAL DESCRIPTION: Tract"A" of Arrowhead 4th Filing, located in the N2 of Section 27,
T5N, R66W of the 6th P.M., Weld County, Colorado
LOCATION: East of and adjacent to Kiowa Drive; North of and adjacent to Pawnee Drive

THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS
REQUEST BE APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of Section
8.4 of the Weld County Subdivision Ordinance.
2. The request is in conformance with Section 7 of the Weld County Subdivision
Ordinance including specifically:
A. Section 7.3.6.1 - That the proposed subdivision is located within an Urban
Growth Boundary area as defined and adopted in any approved
intergovernmental agreement(s), or as defined in the Weld County
Comprehensive plan. The subject property is located in the City of Greeley's
Urban Growth Boundary area and 1/2 mile from the City of Evans Urban Growth
Boundary area.

B. Section 7.3.6.2 - Compliance with the Weld County Comprehensive Plan and
the zone district in which the proposed subdivision is located. The subject
property is zoned A (Agricultural), however no farming or agricultural uses are
currently being conducted on the site. This request will not remove any prime
farmground from production.
C. Section 7.3.6.3 - That comments received from referral agencies have been
addressed, if applicable. Numerous referral agencies reviewed this request.
Those with comments have been incorporated into the Conditions of Approval.
D. Section 7.3.6.4 - That definite provision has been made for a water supply that
is sufficient in terms of quantity, dependability, and quality to provide water for
the subdivision including fire protection. Public water is proposed to be
supplied by the City of Evans.
E. Section 7.3.6.5 - That, if a public sewage disposal system is proposed,
provision has been made for the system and, if other methods of sewage
disposal are proposed, evidence that such systems will comply with state and
local laws and regulations which are in effect at the time of submission of the
subdivision. Individual septic systems are proposed for sewage disposal.
F. Section 7.3.6.6 - That streets within the subdivision are adequate in functional
classification width, and structural capacity to meet the traffic requirements of
the subdivision. All roads within the subdivision have been paved and are
maintained by the county.
G. Section 73.6.7- That off-site street or highway facilities providing access to the
subdivision are adequate in classification, width, and structural capacity to meet
the traffic requirements of the subdivision in accordance with the requirements
set for th in Section 10 of the Subdivision Ordinance. The off-site street and
highway facilities provide adequate access to the proposed site.
H. Section 7.3.6.8- That facilities providing drainage and stormwater management
are adequate. The addition of two lots will not influence the stormwater
drainage plan.
Section 73.6.9 - The subdivision will not cause an unreasonable burden on the
ability of local governments or districts to provide fire and police protection,
hospital, solid waste disposal and other services. Through referral agencies
comments it has been determined by staff that the creation of two additional
lots will not place a burden on local governments or districts.

J. Section 7.3.6.10 - The subdivision will not cause air pollution violations based
on Colorado Department of Public Health and Environment standards. The
proposed two residential lots will not cause any air pollution violations.
K. Section 7.3.6.11- The subdivision conforms to the subdivision design standards
of Section 10 of the Weld County Subdivision Ordinance. Conditions of
Approval address compliance with Section 10.
L. Section 7.3.6. 12 - The subdivision will not have an undue adverse effect on
wildlife, its habitat, the preservation of prime agricultural land, and historical
sites. The proposed two residential lots will not have an impact on wildlife,
agricultural production or historical sites.
This recommendation is based, in part, upon a review of the application materials
submitted by the applicant, other relevant information regarding this request, and
responses from referral entities.
The Department of Planning Services' staff recommendation for approval is
conditional upon the following:
1. The following notes shall be placed on the plat:
A. City of Evans shall provide domestic water service to the residential uses within
the Resubdivision. (Planning)
B. Sewage disposal shall be provided by an Individual sewage Disposal System
(I.S.D.S.). The systems shall comply with all rules and regulations of the Weld
County Health Department. (Health Dept.)
C. Installation of all utilities shall comply with Section 10 (Design Standards) of the
Weld County Subdivision Ordinance. (Planning)
D. Tract A-1 shall access onto Pawnee Drive. (Public Works)
E. Tract A-2 shall access onto Kiowa Drive. (Public Works)
F. One access will be granted for each lot, with no circle drives or additional
accesses allowed. (Public Works)
G. Prior to any work associated with this project which requires the placement of
dredged or fill material, and any excavation associated with a dredged or fill
project, either temporary or permanent, instreams or wetlands should contact
the Department of the Army for appropriate permits. (Planning)

H. A Weld County septic permit is required for any proposed home septic
system(s) and shall be installed according to the Weld County I.S.D.S.
Regulations. (Health Dept.)
2. Prior to recording the plat:
A. The plat shall be amended to show a 15-foot frontage and perimeter easement
shall be shown for tract A-1 and tract A-2 on the plat. (Public Works)
