Home My WebLink About971696.tiff6yi RESOLUTION RE: VACATION OF PORTIONS OF WELD COUNTY ROADS 64 AND 64.5 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Greeley -Weld County Airport NS Runway is planned for construction beginning late summer or early fall 1997, which runway will run northward from the current Airport site to a location north of Weld County Road (WCR) 64.5, and WHEREAS, by letter dated June 23, 1997, Mike Reisman, Airport Manager, requested that the Board of County Commissioners vacate portions of WCR's 64 and 64.5, since the NS Runway will cross those roads and the Federal Aviation Administration will require that no public traffic cross the new runway, and WHEREAS, by notice dated July 25, 1997, and mailed on that date, the adjoining landowners were notified by the Clerk to the Board of a public hearing set for August 4, 1997, to consider the vacation, in accordance with the requirements of C.R.S. § 43-2-303(2)(b), of those portions of WCR's 64 and 64.5 which are described in the attached Exhibit "A," and shown on the attached Exhibit "B," and WHEREAS, the Board of County Commissioners convened said public hearing on August 4, 1997, and heard testimony and reviewed all other evidence presented therein by staff and the public, and WHEREAS, the evidence showed that the vacation of the portions of WCR's 64 and 64.5 which are described in the attached Exhibit "A," and shown on the attached Exhibit "B," will leave no land adjoining the roadway without an established public road or private access easement connecting the land with another established public road, and WHEREAS, the Board of County Commissioners now deems it advisable to vacate said portions WCR's 64 and 64.5, with said vacations to become effective at the time and upon the conditions set forth below. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that those portions of Weld County Roads 64 and 64.5 which are described in the attached Exhibit "A," and shown on the attached Exhibit "B," be, and hereby are, vacated, with said vacation to become effective at such time as construction of the new NS Runway requires that the roadways be closed to public traffic.
