HomeMy WebLinkAbout980037.tiff HEARING CERTIFICATION DOCKET NO. 98- 01 RE: SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT#1160 (SECOND AMENDED SPECIAL REVIEW PERMIT #386), AND AMENDED CERTIFICATE OF DESIGNATION TO ALLOW THE DISPOSAL OF MINE WASTE ROCK IN AN EXISTING SOLID WASTE(ASH)DISPOSAL FACILITY AND SURFACE COAL MINING OPERATION -COORS ENERGY COMPANY A public hearing was conducted on January 7, 1998, at 10:00 a.m., with the following present: Commissioner George E. Baxter, Chair Commissioner Constance L. Harbert, Pro-Tem Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer Commissioner W. H. Webster Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Gloria Dunn Health Department representative, Trevor Jiricek Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated December 2, 1997, and duly published December 24, 1997, in the Platteville Herald, a public hearing was conducted to consider the request of Coors Energy Company for a Site Specific Development Plan and Special Review Permit #1160 (Second Amended Special Review Permit #386), and Amended Certificate of Designation to allow the disposal of mine waste rock in an existing solid waste (ash)disposal facility and surface coal mining operation. Lee Morrison, Assistant County Attorney, made this a matter of record. Gloria Dunn, Department of Planning Services representative, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Ms. Dunn stated this request requires both an amended Certificate of Designation and second amended Special Review Permit. The site was permitted for surface coal mining under SUP#386 in 1981 and was amended to allow the disposal of ash in 1987. Ms. Dunn stated currently there is a daily maximum of 100 cubic yards of ash accepted per day, a maximum of 33,000 tons of mine waste rock per year, and a lifespan of 15 years or less for the operation. Access to the site runs from Weld County Road 59 and then to a private access road. Ms. Dunn stated all previous Conditions of Approval and Development Standards have been carried over or updated. In response to Commissioner Kirkmeyer, Don Carroll, Department of Public Works representative, stated currently there are three daily trips with the exception of a 45-day "heavy hauling"which consists of 25 trips daily. In response to Commissioner Kirkmeyer, Ms. Dunn stated there is the possibility of having more heavy hauls; however, Coors Energy Company must obtain 980037 pt PL0113 HEARING CERTIFICATION - COORS ENERGY COMPANY (SUP#386) PAGE 2 permission from the Health and Public Works Departments. After discussion, changes were suggested to add language to Condition #4 to include more than one hauling event, and should road damage occur as a result of the hauling activity, the applicant/owner shall be responsible for repairing the road by laying two inches of asphalt. Responding to Commissioner Kirkmeyer, Trevor Jiricek, Department of Health representative, stated mine waste rock is defined in the letter from Doty and Associates dated October 1, 1997, which is referred to in Development Standard #4. Commissioner Kirkmeyer requested the exact definition be included in Development Standard #4, rather than referencing a letter. George Daserki, applicant, and Ben Doty, Consultant, gave a brief slide presentation which explained the location and history of the operation and the current process for filling the mining pits. Mr. Daserki stated this is a volunteer project which will also help the company with their reclamation process to close the mine. In response to Commissioner Kirkmeyer, Mr. Daserki stated he agreed with the Development Standards and Conditions of Approval. Responding to Commissioners Webster and Kirkmeyer, Mr. Daserki explained the mine has a 10 to 12 years left, including filling and reclamation, to have its $4.5 million bond returned. The hours of operation are from 3:00 a.m. to 4:00 p.m., and the ash dust is prevented by hauling the ash while it is wet. No public testimony was offered concerning this matter. Commissioner Kirkmeyer moved to approve the request of Coors Energy Company for a Site Specific Development Plan and Special Review Permit#1160 (Second Amended Special Review Permit #386) to allow the disposal of mine waste rock in an existing solid waste (ash) disposal facility and surface coal mining operation, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards with changes to Condition#4 as discussed above and the addition to Development Standard#4 to read as follows: "Each source of mine waste rock shall be approved by both the Weld County Health Department (WCHD) and the Colorado Department of Public Health and Environment (CDPHE) prior to disposal at the site. Mine waste rock is defined as geologic materials derived from mining activities that have not been subjected to chemical processing. The facility shall submit a detailed, written request for each source. Each request shall include the following:". The motion was seconded by Commissioner Webster, and it carried unanimously. Commissioner Kirkmeyer moved to approve the Amended Certificate of Designation based on the recommendations of the Planning staff and the Planning Commission.
