WHEREAS, the Petition for Annexation for the territory hereinafter described was filed with the Town Clerk by the Weld County Commissioners, hereinafter referred to as the Petitioner; and WHEREAS, the Petition for Annexation is in substantial compliance with the applicable parts of Sections 31-12-104 and 31-12-105 of the Municipal Annexation Act of 1965, as amended; and WHEREAS, the territory proposed to be annexed is situated in the County of Weld, State of Colorado, and is more particularly described as follows: SEE ATTACHED EXHIBIT "A" WHEREAS, the Petitioner is the owner of 100% of the area proposed to be annexed, exclusive of streets and alleys; and WHEREAS, it is desirable and necessary that the described real property be annexed to the Town of Erie, Colorado; and WHEREAS, not less than on-sixth (1/6th) of the perimeter of the area proposed to be annexed will be contiguous with the Town of Erie, Colorado; and WHEREAS, a community of interest exists between the area proposed to be annexed and the Town of Erie, Colorado; the area proposed to be annexed is urban or will be urbanized in the near future; and the area proposed to be annexed is integrated with the Town of Erie, Colorado; and WHEREAS, in establishing the boundaries of the territory proposed to be annexed, no land held in identical ownership, whether consisting of one tract or parcel of real estate as two or more contiguous tracts or parcels of real estate has been divided into separate parts or parcels without the written consent of landowners, thereof; and WHEREAS, in establishing the boundaries of the area proposed to be annexed, no land held in identical ownership, whether consisting of one tract or parcel of real estate or tow or more contiguous tracts or parcels of real estate, comprising twenty.
