As you probably know, recent legislation was passed by our State Legis-
lature whereby Senate Bill 258 was passed, providing for the creation of
the Northern Colorado River Basin Authority. This bill gives the Boards
of County Commissioners within the river basin the authority to create
and implement such an authority.
Now, this legislation is only permissive, and your Board of County
Commissioners feels that before it can justify taking any positive action
in such a serious undertaking, it wishes to obtain an expression from any
and all responsible water users within Weld County.
Accordingly, we attach herewith a form of Resolution which can be passed
by your Board, either in favor or against the formation of such authority.
Your expression in this matter will be most appreciated and certainly will
be very helpful to the Board of County Commissioners before making a
decision that most certainly should be in the best interest of Weld County.
Your early attention to this matter, returning the completed Resolution,
will be greatly appreciated. For your convenience, we are attaching a
stamped, self-addressed envelope.

2. The proposed authority is not a true water basin
authority but divides the South Platte Basin into three parts
and thereby contributes to the further division of the South
Platte Basin.
3. The powers of taxation are too broad. There is no
real element of local control by the interested property owners.
I want to say emphatically that this is no reflection of the
Board of County Commissioners of any of the counties involved
but simply to say that this is not the normal function of the
Board of County Commissioners.
4. No provision is thereby made for real participation
of the irrigators.
5. The primary purpose of S. B. 258 is directed to prob-
lems of ground water management. In our view a rule by the
State Engineer or a Court decision charging ground water with-
drawals by stockholders of mutual ditch companies to the
priority of the ditch system in the proportion in which lands
irrigated by wells bears to the total land under the system
would enable the State Engineer to satisfy all calls.

We represent Central Colorado Water Conservancy District and
Henrylyn Irrigation District. As you know Henrylyn Irrigation
District comprises approximately 32,000 acres of land lying
in Weld County, Colorado. Its irrigation system is a somewhat
complicated one. Its water is delivered through the headgate
of the Burlington Canal just north and east of the north side
of Denver's sewage disposal plan and just north and west of
Riverside Cemetery at the edge of Denver. Some of its storage
structures and its ditches lie within the boundaries of the
proposed Northern Colorado Water authority.
Central Colorado Water Conservancy District includes 300,000
acres of land of which approximately 102,000 acres are irrigated.
These lands lie under the irrigation systems of'Farmers Reservoir
and Irrigation CompanBarr Lake Division,(+the Henrylyn Irrigation
District, theCFulton Irrigatio;Ditch Company, th turlington
Ditch land and Reservoir Company and the0New Brantner Extension
Ditch Company.
On behalf of Central Colorado Water Conservancy District and
on behalf of the Henrylyn Irrigation District and in accordance
with the action of their officers we state their opposition to
the creation of the Northern Colorado Water authority.
The reasons for the position of both districts we represent are:
1. Existing districts are able to take care of the ground
water management problem by cooperation between those districts.
Negotiations between Northern Colorado Water Conservancy District,
Lower South Platte Water Conservancy District, the City and
County of Denver and Central Colorado Water Conservancy District
are now taking place.

Gentlemen:
Senate Bill 258, effective July 1, 1969, authorizes the
creation of river basin authorites designed "to promote stabil-
ity of ground and surface water supplies and to encourage maxi-
mum utilization of and benefit from all water supplies within
the State of Colorado by planned management".
This letter serves as the call of the meeting of Board
of County Commissioners of the member Counties of the proposed
Northern Colorado River Basin Authority. Said meeting, author-
ized by Section 7 of the Act, will take place at 7:30 P.M. on
Wednes_day,- Novemb r h- 196L at the I, rimmr County Annex, 201
as Loveland, Colorado. The purpose of the meet-
ing will be to consider and act upon the question of the creation
of the Northern Colorado River Basin Authority; and, if such
authority is created, to appoint the directors thereof.
The time and place of the meeting was established by
agreement among the County Commissioners involved, in order to
allow time for study and consideration. We feel quite strongly
that this opportunity for local control should not be lost, and
would be glad to discuss the matter with any of you.

Dear Mr. Anderson:
The boards of the Riverside Reservoir and Land Company and The
Riverside Irrigation District requested that I, as their attorney, re-
spond to your letter of September 24, 1969, in regard to the captioned.
The consensus among the members of the boards is that they wish to
participate in every way possible in each and every program that will
make for better utilization of the waters of the State of Colorado.
Particularly, they are interested in the South Platte River Basin and
the possibility of augmenting the supply of the Riverside Irrigation
system. However, they did not feel that they had sufficient infor-
mation with respect to the proposed Northern Colorado River Basin
Authority to justify the adoption of a resolution by them at this time.
Because of their great interest, it would be sincerely appreciated if
youcouldprovide us with all the information available respecting this
proposed authority. Particularly, we would like to know the area pro-
posed to be included, the tributary streams to the South Platte that
would be affected and the counties and cities that would be included
hin the basin thority if it is created.

of Trustees of the Town of Evans that they would prefer to see the
outcome of pending litigation regarding the state engineerts actions
before pursuing the creation of the river basin authority. It is their
feeling that thorough investigation and analysis would be necessary

resolution regarding the formation of a Water Authority
District.
It is the consensus of this board that such an organi-
zation could be very valuable. However, none of us are
willing to endorse such a creation without understanding
