RE: APPROVAL OF RECORDED EXEMPTION #1817 - MCLAIN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under Section
30-28-101(10)(d), CRS, as amended, did determine at a public meeting held in the Chambers of
the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known
as Recorded Exemption #1817, does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land", and
WHEREAS, the request for Recorded Exemption #1817 was submitted by Donnie L.
McLain, 33899 Weld County Road 55, Gill, Colorado 80624, for property which is described as
Lot B of RE #857, being a part of the N'/2 of Section 16, Township 6 North, Range 64 West of the
6th P.M., Weld County, Colorado, being more particularly described in the plat which shall be
provided by the applicant and known as Exhibit "A", said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels estimated to be approximately
13 acres and 98.18 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from
the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1817 submitted by
Donnie L. McLain be, and hereby is, approved conditional upon the following:
1. A Weld County septic permit is required for any proposed home. The septic system
shall be installed according to the Weld County Individual Sewage Disposal System
(ISDS) regulations.
2. The applicant shall submit a mylar plat to the Department of Planning Services to
be recorded in the office of the Weld County Clerk and Recorder. The plat shall be
prepared in accordance with the requirements of Section 11.7 of the Weld County
Subdivision Ordinance. The plat shall be submitted within sixty days from the date
of approval by the Board of County Commissioners. The applicant shall be
responsible for paying the recording fees.

LEGAL DESCRIPTION: Lot B of RE -857, being a part of the N2 of Section 16, T6N, R64W of
the 6th P.M., Weld County, Colorado.
LOCATION: East of and adjacent to WCR 53; south of WCR 70.
REQUEST:
This request is to:
(1) Divide Lot B of RE -857 into proposed Lot A with 13 acres (+/-) and proposed Lot B
with 98.18 acres (+/-).
WATER: Both parcels would be provided with a tap from the North Weld County Water
District. A conveyance, grant, or reservation of irrigation water will be provided to
proposed Lot A in sufficient quantity to support crops.
SEWER: A septic system on both proposed Lot A and proposed Lot B shall provide for sewage
disposal.
APPLICANT'S REASON FOR EXEMPTION: To sell the new smaller Lot A, to provide relief
from financial drain created by a livestock operation.
REFERRAL CONCERNS:
- The Weld County Department of Public Works is asking only one access be granted for
each lot of the recorded exemption.
- The Weld County Health Department has reviewed this request and has no conflict of
interest.
-The Galeton Fire Protection District has reviewed this request and has no conflict of
interest.
STAFF RECOMMENDATION: The Department of Planning Services has concerns about the
number of building sites in the immediate area, and believes the addition of another buildable sight
will contribute to sprawl -row type development. The two recorded exemptions on this parcel
combined have the potential to take 31.54 acres of productive agricultural land out of production,
not counting the addition of another buildable site on proposed Lot B. Furthermore, staff does not
feel the recorded exemption is consistent with the intent of the Weld County Comprehensive Plan.

Subject: Lot B of RE -857, being a part of the N2 of Section 16, T6N, R64W of the 6th P.M., Weld

Dear Commissioners:
This request for a recorded exemption is submitted by Donnie L. McLain. The parcel of land under
consideration is described as Lot B of RE -857, being a part of the N2 of Section 16, T6N, R64W of the 6th
P.M., Weld County, Colorado. The property does not lie within the urban growth boundary of any
surrounding municipality. Currently, there are no existing structures on neither proposed Lot A, nor Lot B.
Proposed Lot A is 13 acres more or less, currently in agricultural production. Proposed Lot B is likewise
in agricultural production, consisting of 98.18 acres, more or less.
A septic system is proposed for Lot A and Lot B for sewage disposal. Water is provided by the North
Weld County Water District for proposed Lot A and proposed Lot B. The Weld County Department of
Public Works is asking that there only be one access per legal parcel, no additional accesses shall be granted.
The Weld County Health Department has reviewed this request and has no conflict of interest.
Proposed Lot A is to be used as a building site for a single family dwelling, with proposed Lot B remaining
in agricultural production. According to the applicant, the purpose of the recorded exemption is to sell
proposed Lot A because of losses in their livestock operation.
The Department of Planning Services has concerns about the number of building sites in the immediate area.
The addition of another buildable site to the area will contribute to sprawl -row type development. The two
recorded exemptions on this parcel combined have the potential to take 31.54 acres of productive
agricultural land out of production, not counting the addition of another buildable site on proposed Lot B.

In addition, staff has concerns that the application for a recorded exemption is not consistent with the intent
of the Weld County Comprehensive Plan:
A. Enable the property owner who is retiring an opportunity to live on or sell the existing farm
improvements.
B. Enable the property owner to sell off agricultural land that is nonproductive for one single family
dwelling.
C. Enable the property owner to provide a residence for direct members of the farm family and also for
workers employed at the farm.
The Department of Planning Services requests that the Board of County Commissioners consider this
application and determine if Sections 11.5.1 through 11.5.7 of the Weld County Subdivision Ordinance have
been met.

Dear Ms Dunn:
We the undersigned submit the following application to divide Lot
"B" amending Recorded Exemption No. 0801 -16 -2 -RE 857.
Our request to amend the existing Recorded Exemption would split
the existing Lot "B" into two lots. The smaller of the two lots
would be Lot "A", approximately 13+1 -acres, the larger Lot "B" will
have approximately 98.18+/ -acres. The existing Lot "B" is an un-impr-
o ved lot. Our plans are to sell the new smaller Lot "A", hoping
that this will provide some relief to the financial drain created
by loses in our livestock operation. It is anticipated that at
some future date a small part of Lot "A" will be used for a
✓ esidence, the remainder continuing to have an agriculture use.
We have no plans to change the use of the new larger Lot "B" it
w ill remain the basis of our livestock operation. Either as irri-
gated summer pasture or for hay production, the hay used in the
winter feed and care of our livestock.
All of the land is currently irrigated, having irrigation water
✓ ights under the Larimer and Weld Irrigation system. A pro rata
distribution of our irrigation water will be assigned to each lot.
We currently utilize an underground and gated pipe irrigation
system for distribution and irrigation of the land. The split we
are proposing is a split whereby amended Lot "A" is already indep-
e ndent of amended Lot "B" within the current irrigation system.

The subject property is located in an agriculture zone, the
proposed Recorded Exemption is consistent with the zoning. It is
o ur intent that both lots will remain agriculturally zoned. No
change in use is contemplated and the use is fully compatible
with the existing use and tenure of the area.
Domestic water for amended Lots "A" and "B" is available from
North Weld County Water District. A letter from the water district
stating that the district is able to supply water taps is part of
and attached to this request. Both lots will utilize septic tanks
or standard systems required by the Weld County Health Depart-
ment.
The proposed Amended Recorded Exemption is compatible with other
properties in the area and is not inconsistent with the effic-
ient and orderly development of the area. The property is not
located in a flood plain, geologic hazard or Weld County Airport
District. It complies with the Weld County Zoning Ordinance.
Fire Protection is provided by the Kersey Volunteer Fire Depart-
ment. Public Service Company provides electrical service to the
area. US West provides telephone service.
The herein described property, that we are proposing to split in
amending the existing Recorded Exemption is located approximately
11 miles northeast of Greeley, approximately three miles northwest
of Gill and approximately 3z miles southeast of Galeton.
Amended Lot "A" has access onto Weld County Road 55, Lot
having access onto Weld County Road 70.

THIS INDENTURE, Made this 10th day of June, 1986, between THE FEDERAL LAND BANK
OF WICHITA, Wichita, Kansas, a corporation, party of the first part, and CLAIR
B. ORR and LARRY G. INTERMILL, not as joint tenants, but as tenants in common,

WITNESSETH: That the said party of the first part, for and in
consideration of the sum of One Hundred Thirty Thousand and No/Hundredths

Comments: There are six residences on the east side of WCR 53, between WCR 70 and HWY
392. The west side of the property is currently in agricultural production. There are small rural
homesites as well. It appears the recorded exemption as the applicant has drawn it out would
create a landlocked parcel. There is an access on the north end to WCR 70, but it is difficult to
tell whether or not it serves the proposed Lot B. It crosses through the neighbor to the north's
property. WCR 70 actually sits higher than the subject property. To the north of WCR 70 lies
Howards Lake.
