RESOLUTION
RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT
#1090 FOR PRIVATE SCHOOL, CHURCH, AND MULTIPLE DWELLING UNITS IN
THE A (AGRICULTURAL) ZONE DISTRICT - PRESTON RANCH MINISTRIES, INC.,
C/O ELLEN KORTHUIS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 14th day
of August, 1996, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of
hearing the application of Preston Ranch Ministries, Inc., do Ellen Korthuis, P.O. Box 44,
Roggen, Colorado 80652, for a Site Specific Development Plan and Special Review Permit
#1090 for a private school, church, and multiple dwelling units in the A (Agricultural) Zone
District on the following described real estate, to-wit:
The SE1/4 of the SW1/4 of Section 17, and the E1/2 of the NW1/4
of Section 20, Township 2 North, Range 62 West of the 6th P.M.,
Weld County, Colorado
WHEREAS, said applicant was represented at said hearing by Ellen Korthuis, Donald
Sharp, and Bob Korthuis, members of the Preston Ranch Ministries, Inc., Board, and
WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards
for review of said Special Review Permit, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Weld County Planning Commission and all of the exhibits and evidence presented in this
matter and, having been fully informed, finds that this request shall be approved for the
following reasons:
1. The submitted materials are in compliance with the application requirements of
Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Board of County Commissioners that the applicant has
shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as
follows:
a. This proposal is consistent with the Weld County Comprehensive Plan's
Agricultural Goals and Policies section. The proposal does not take prime
farm ground out of production.

b. This proposal is consistent with the intent of the A (Agricultural) Zone
District and is provided for as a Use by Special Review.
c. Portions of this site lie in the flood plain.
d. Special Review Permit Development Standards will provide adequate
protection of the health, safety and welfare of the neighborhood and
County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the application of Preston Ranch Ministries, Inc., c/o Ellen
Korthuis, for a Site Specific Development Plan and Special Review Permit#1090 for a private
school, church, and multiple dwelling units in the A (Agricultural) Zone District on the
hereinabove described parcel of land be, and hereby is, granted subject to the following
conditions:
1. The attached Development Standards for the Special Review Permit shall be
adopted and placed on the Special Review plat prior to recording the plat. The
plat shall be delivered to the Department of Planning Services and be ready for
recording in the Weld County Clerk and Recorder's Office within 15 days of
approval by the Board of County Commissioners.
2. The Special Review activity shall not occur nor shall any building or electrical
permits be issued on the property until the Special Review plat is ready to be
recorded in the office of the Weld County Clerk and Recorder.
3. Prior to recording the plat:
a. The applicant shall submit a drainage plan to the Department of Public
Works for review and approval. A copy of the approved drainage plan
shall be submitted to the Department of Planning Services.
b. The applicant shall submit a parking space analysis and drawing to the
Department of Planning Services for review and approval. The approval
of the parking spaces shall be shown on the plat.
c. All accesses shall be clearly shown on the plat.
d. The plat shall be amended to show only two access points to the
property. One access shall accommodate the main buildings and the
homes. The other access will be utilized for the school site.

e. The plat shall be amended to show adequate drawings of the radiuses
from the County roads to the facilities. The radiuses shall be approved
by the Weld County Public Works Department.
f. The applicant shall submit a storm water detention plan to the Weld
County Public Works Department for review and approval. A copy of the
approved plan shall be submitted to the Department of Planning
Services.
4. An Individual Sewage Disposal System permit must be finalized and approved
by an Environmental Protection Specialist within one (1) year of the application
date.
5. All construction activities that disturb more than five (5) acres will be required to
obtain a storm water discharge permit from the Colorado Department of Health,
Water Quality Control Division.
6. The following note shall be placed on the plat:
a. Any construction in the flood plain shall require a flood hazard
development permit to be applied for and approved by the Department of
Planning Services, prior to the issuance of any building permits.
7. An Individual Sewage Disposal System is required for the proposed facility and
shall be installed according to the Weld County Individual Sewage Disposal
Regulations.
8. The septic system(s) is required to be designed by a Colorado Registered
Professional Engineer according to the Weld County Individual Sewage Disposal
Regulations.
9. A minimum 15-inch Corrugated Metal Pipe (CMP) culvert shall be required for
placement in the borrow pit for each access to the property from a Weld County
road.
10. Prior to placing a child who would attend school(s) in Weld County School
District RE-3(J) at the Preston Ranch Ministries, Inc., facility, the applicant shall
meet with the District RE-3(J) staff to jointly determine the needs and impacts
posed by the child to District RE-3(J).
11. The applicant shall accept for placement at the Preston Ranch Ministries, Inc.,
facility only those children who are authorized for such placement pursuant to the
applicant's Residential Child Care Facility (RCCF) license issued by the State of
Colorado or an agent on behalf of the State of Colorado.

SITE SPECIFIC DEVELOPMENT PLAN
SPECIAL REVIEW PERMIT
DEVELOPMENT STANDARDS
PRESTON RANCH MINISTRIES, INC., C/O ELLEN KORTHUIS,
USR#1090
1. The Site Specific Development Plan and Special Review Permit is for a private school,
church, and multiple dwelling units in the A (Agricultural) Zone District as submitted in
the application materials on file and subject to the Development Standards stated
herein.
2. Approval of this plan may create a vested property right pursuant to Section 90 of the
Weld County Zoning Ordinance, as amended.
3. All construction on the property shall be in accordance with the requirements of the
Weld County Building Code Ordinance.
4. The property owner or operator shall be responsible for complying with the Design
Standards of Section 24.5 of the Weld County Zoning Ordinance, as amended.
5. The property owner or operator shall be responsible for complying with the Operation
Standards of Section 24.6 of the Weld County Zoning Ordinance, as amended.
6. All liquid and solid wastes shall be stored and removed for final disposal in a manner
that protects against surface and groundwater contamination.
7. No permanent disposal of wastes shall be permitted at this site.
8. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, blowing debris, and other potential nuisance conditions.
9. Fugitive dust shall be controlled on this site.
10. The maximum permissible noise level shall not exceed the residential limit of 55 db(A)
as measured according to 25-12-102, Colorado Revised Statutes.
11. Any existing septic system(s) not currently permitted through the Weld County Health
Department will require an I.S.D.S. Evaluation prior to the issuance of the required
septic permit(s). In the event the system(s) is found to be inadequate, the system(s)
must be brought into compliance with current I.S.D.S. regulations.
12. All pesticides, fertilizer, and other potentially hazardous chemicals must be stored and
handled in a safe manner. Reference 25-8-205.5 Colorado Water Quality Control Act
and rules and regulations thereof.

13. Any construction in the flood plain will require a flood hazard development permit.
14. Personnel from the Weld County Health Department and Weld County Department of
Planning Services shall be granted access onto the property at any reasonable time in
order to ensure the activities carried out on the property comply with the Development
Standards stated herein and all applicable Weld County regulations.
15. The Special Review area shall be limited to the plans shown herein and governed by the
foregoing Standards and all applicable Weld County regulations. Major changes from
the plans or Development Standards as shown or stated shall require the approval of an
amendment of the Permit by the Weld County Planning Commission and the Board of
County Commissioners before such changes from the plans or Development Standards
are permitted. Any other changes shall be filed in the office of the Department of
Planning Services.
16. The property owner or operator shall be responsible for complying with all of the
foregoing Development Standards. Noncompliance with any of the foregoing
Development Standards may be reason for revocation of the Permit by the Board of
County Commissioners.
