As a condition of approval from the Weld County authorities all proposed street names must be submitted to the Eaton Post Office for review of duplication of street names. The name "Avery Avenue" has been submitted as the proposed streetname for the single street in this development. 1 confirm that the use of"Avery Avenue" would create no duplication of names. As per our response to the Weld County Planning Department, the District has established a formula to calculate a land or cash amount in lieu of land dedication to be paid to the District. The amount due for this development is$1,890.00 or$378-00 per lot as shown in the attached calculation. As was stated earlier,the problem is that under the CC.O.G.C.C.Field Rules for the Wattenberg Field, well locations are limited to a 400 foot square (the "drillsite window") centered on the center of a standard governmental quarter-quarter section. This drillsite window is depicted on the plat attached as Exhibit"A". Your development plans would restrict Lyco from utilizing the sin-face on part of Lot 1, Lot 2 and the 60' Access&Utility Easement. However,Lyco is willing to restrict its surface use of the portions of Lot 1 and Lot 2 included within the stated drillsite window, if Avery Farms is willing to agree that neither Avery Farms nor its assignees or successors in title to the lots will oppose in any way Lyco's use of the remainder of the drillsite window for a future well in the NW/.NW%of Section 10-T6N-R65W-6th P.M.
