NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". I am of retirement age and I know that my farm can no longer be maintained profitably as a cow/calf farming operation. I wish to exchange this operation for a more profitable income-producing properties that will be of benefit to my long-range estate plan. However, the current market value of this land exceeds the income-producing potential that any large-scale farming operation could justify. Therefore, it has become necessary to break my farm down into smaller more marketable parcels of land to accomplish my long-term goals. I am requesting the approval of a recorded exemption in conjunction with a subdivision exemption request to remove my son's residence as well as my own personal residence from an 82± acre tract. The reason I have applied for this proposed recorded exemption in conjunction with a subdivision exemption is that there are two separate residences and the buyer of this tract does not require or need the homes (see Map A). Lot A is the personal residence of my son, David Claus. Due to financing requirements, it is necessary that a separate Deed of Trust (Mortgage) be established for my son for both his and my tax purposes. Lot SE, the proposed subdivision exemption lot is my personal residence which I will be living in while the Buyer markets the remainder of the farm. A great deal of planning has been incorporated into this application utilizing input from the City of Mead and the Weld County Planning Department. This application is resulting in only one additional building site. Each of the parcels created follows natural boundaries while preserving as much of the agricultural integrity of the land as possible. However, because of concerns from citizens with past annexing of larger 200+acre tracts, the city planners want to identify and bring in only smaller acreage tracts at any one time. It is impractical to maintain larger farms like mine within these boundaries since the city residences bordering these farms do not appreciate the livestock odors, heavy machinery noise, inconsistent hours, occasional dust and other inconveniences associated with large-scale farming. However, smaller acreage tracts can be more easily and attractively maintained as speciality or hobby farms until the time arrives to annex and incorporate those parcels into the city. Now that you know my situation and the background for my decisions, I am confident that we can proceed with maximum cooperation between all agencies to accomplish these goals. I honestly believe that this proposal can be an example of some real planning that encourages growth in the proper areas through following design guidelines of the Weld County Comprehensive Plan. The Claus's or their buyer's may want to apply for a recorded exemption on the E1/2 of this parcel. However, when the State laid out the highway they placed a 250 foot right-of-way along the east side of this parcel. (See attached strip map). The rules for recorded exemption are not dear on the point of this type of right-of-way. It is felt that for the purposes of being considered for recorded exemption, the Claus's should not be penalized because the state placed this highway right-of-way on their land. It should be pointed out that if the only land the Claus's owned was the E1/2 of the SE1/4 then this request would normally be granted. (see attached hand drawn map) It is our opinion, that the E1/2 of the SE1/4 containing the state owned 1-25 right-of-way should be treated like an 80 parcel (like it originally was) and be given the same considerations and privileges that any other 80 acre parcel would be given. Before submitting an application for a recorded exemption, it is important to have a clarification on this point. Dear Commissioners: This request for a recorded exemption in conjunction with a subdivision exemption is submitted by Clayton C. Claus. The parcel of land under consideration is part of Section 3, T3N, R68W of the 6th P.M., Weld County, Colorado,particularly described as a 82.23 acre (+/-)parcel, described in a deed recorded January 12, 1996. The property is located south of and adjacent to the Lake Hollow Estates, located within the Town of Mead. Proposed Lot A consists of one residence,as does the proposed subdivision exemption lot. There is no residence currently on proposed Lot B. Lot B consists of approximately 12 acres of prime irrigated land, the remainder being in pasture and the Parmalee Reservoir. Agricultural production and residential development to the northeast of the property is consistent with the surrounding area. Existing septic systems provide proposed Lot A and the proposed subdivision exemption lot with sewage disposal. Lot A has two existing accesses off of WCR 36, while both proposed Lot B and the proposed subdivision exemption lot are also serviced by one existing access off of WCR 36. Proposed Lot A and the proposed subdivision exemption lot are currently serviced by a tap from the Little Thompson Water District. The applicant is proposing to divide a 82.23 acre (+/-) parcel into a proposed Lot A of 3.2 acres (+/-), proposed Lot B of 75 acres(+/-), and a subdivision exemption lot of 4 acres(+/-). The applicant states the interests of the public,the homeowner,and the subdivider would be protected because "...The Seller's interest would be safeguarded since he would be able to market the property and meet his sons's tax requirements and also expedite his own long-term financial retirement plan through being able to sell these lots separately." Staff acknowledges that the property is indeed within the urban growth boundary of Mead, but feels the intent of the recorded exemption is not to promote future residential development. Furthermore, Staff acknowledges the right of the applicant to establish 80 acre parcels, but because the applicant is now asking for consideration of whether or not this application is consistent with the goals and policies as set forth in the Weld County Zoning Ordinance and the Weld County Comprehensive Plan, Staff feels that it is not consistent with efficient and orderly development. By approving the recorded exemption in conjunction with a subdivision exemption, Staff feels the creation of a 4 acre(+/-) island lot could not be considered efficient and orderly development. Furthermore,the road which will service proposed Lot B and the subdivision exemption lot may serve as future justification for an additional recorded exemption on the adjacent 90 acre (+/-)directly to the east. On October 6, 1995, a recorded exemption was submitted on the SE4 of Section 3, T3N, R68W of the 6th P.M., Weld County, Colorado. This recorded exemption (RE-1813)was later vacated after the applicant decided it would be in his best interest to re-apply for a recorded exemption with a subdivision exemption. Staff felt this RE-1813 was more consistent with the intent of the recorded exemption. There was no additional buildable sites created, all of the irrigated cropland would still be maintained on proposed Lot B, and no future rationale for future splits would be justified with the approval of the recorded exemption. Staff feels that should it be the intent of the applicant to either annex into the Town of Mead, or to further accommodate the sight for future development,that the applicant annex or utilize some other mechanism through the County other than a recorded exemption. Furthermore, Staff feels that the intent of the recorded exemption is not to accommodate a site for possible future development. The Department of Planning Services requests the Board of County Commissioners consider this application and determine if sections 11.5.1 through 11.5.7 of the Weld County Subdivision Ordinance have been met. A water supply statement. The statement will include evidence that a water supply of sufficient quality, quantity, and dependability will be available to serve the two proposed lots. A letter from a water district, municipality, or a well permit are examples of evidence for domestic use. The water supply statement should also contain the type and quantity of irrigation water available to the site, if applicable. Please see attached Exhibit B, a letter from the Little Thompson Water District stating that two existing water taps are currently servicing the two home sites (Lot A and SE) and that one additional tap could be provided with conditions for the larger parcel (Lot B). The larger parcel includes mostly pasture ground, a lake and a 12 acre irrigated field. Explain the reason for the proposed recorded exemption and how each proposed lot will be used. At the current time the proposed smaller parcel is the residence of the son of the property owner. The son is responsible for all farming operations . Due to financing requirements, it is necessary that a separate Deed of Trust (mortgage) be established for the smaller residence for the son for tax purposes . 2 . Describe the location, size and present use of the area where each proposed new lot will be created. At the present time the entire acreage is approximately 155 total acres . The son resides in one residence on the property and the father resides on another residence on the property. The entire parcel is used for ag and rural residential at this time . 3 . Explain how the proposal is consistent with the Weld County Comprehensive Plan and any adopted municipal plan, if applicable. The proposal is consistent with the Comprehensive Plan as this is a family farming operation and does not result in a new residence being constructed.
