Approved with Conditions The Department of Planning Services has determined through the review, that the standards of Section 11.4.2.1 through 11.4.2.6 of the Weld County Subdivision Ordinance have been met. This Recorded Exemption is approved with the following conditions in accordance with information submitted in the application and the policies of the County. 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations. 2. WCR 49 is designated on the Transportation Plan Map as an arterial status road which requires 100 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. The access shall be placed in such a location to have adequate sight ,istance in both directions and not below the crest of a hill or where physical obstructions are present. Lot of AmRE-442, the 60 acre parcel, will be allowed one residential access only because of the land locked situation. If a drainage culvert is required, a 15-inch CMP is the County minimum size. If the applicant chooses to place a larger culvert, please contact the Public Works Department to adequately size your culvert. (Lot A) Direct access from a public road shall be limited to one access per legal parcel for residential, no circle drives. This policy shall apply to all new and existing accesses within the unincorporated areas of weld County. Properties within municipalities or other counties which access Weld County roads are also subject to this policy. (Lot A) Utilize the existing agricultural, oil and gas, and ditch roads that are necessary for your agricultural operations. No additional accesses shall be granted. (Lot B) 4. Prior to recording the plat: A. The total acreage included in Lots A and B of AmRE-442 combined shall meet the 80 acre minimum (;. lot size. Each of the two remaining parcels being amended out of Lot B shall individually meet the 80 acre minimum lot size. The applicant shall submit deeds, duly recorded with the Weld County Clerk and Recorder, verifying such lot sizes to the Department of Planning Services. ,✓ B. There is presently 60 feet of right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (Ordinance 89, as amended), the required setback is measured from the future right-of-way line. REQUIREMENTS: The access shall be placed in such a location to have adequate sight distance in both directions and not below the crest of a hill or where physical obstructions are present. Lot A, the 60 acre parcel, will be allowed one residential access only because of the land locked situation. Lot B, the 266 acre parcel, shall access from WCR 36 (residential) because of the arterial status of WCR 49. If a drainage culvert is required, a 15-inch CMP is the County minimum size. If the applicant chooses to place a larger culvert, please contact the Public Works Department to adequately size your culvert. (Lot A) Direct access from a public road shall be limited to one access per legal parcel for residential, no circle drives. This policy shall apply to all new and existing accesses within the unincorporated areas of weld County. Properties within municipalities or other counties which access Weld County roads are also subject to this policy. (Lot A) Utilize the existing agricultural, oil and gas, and ditch roads that are necessary for your agricultural operations. No additional accesses shall be granted.
