RE: APPROVAL OF RECORDED EXEMPTION #1693 - HAFFNER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under Section
30-28-101(10)(d), CRS, as amended, did determine at a public meeting held in the Chambers of
the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known
as Recorded Exemption #1693, does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land", and
WHEREAS, the request for Recorded Exemption #1693 was submitted by Jake Haffner,
1474 Weld County Road 47, Hudson, Colorado 80642, for property which is described as Lot A
of RE #430, being located in part of the SW 1/4 of Section 25, Township 1 North, Range 65 West
of the 6th P.M., Weld County, Colorado, being more particularly described in the plat which shall
be provided by the applicant and known as Exhibit "A", said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels estimated to be approximately
2.7 acres and 2.2 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from
the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1693 submitted by
Jake Haffner be, and hereby is, approved conditional upon the following:
1. The applicant shall submit a mylar plat to the Department of Planning Services to
be recorded in the office of the Weld County Clerk and Recorder. The plat shall be
prepared in accordance with the requirements of Section 11.7 of the Weld County
Subdivision Ordinance. The plat shall be submitted within sixty days from the date
of approval by the Board of County Commissioners. The applicant shall be
responsible for paying the recording fees.
2. A Weld County septic permit is required for any proposed home. The septic system
shall be installed according to the Weld County Individual Sewage Disposal System
(ISDS) regulations.
3. Prior to recording the plat, the applicant shall submit a 30 -foot non-exclusive access
and utility easement and maintenance agreement to the Department of Planning
Services for review and approval.
4. The plat shall show the 30 -foot non-exclusive access and utility easement.

This request for a recorded exemption is submitted by Jake Haffner. The parcel of land
under consideration is describes as Lot A of Recorded Exemption 430, being in part of the
SW4 of Section 25, T1 N, R65W of the 6th P.M., Weld County, Colorado. The property is
located east of and adjacent to Weld County Road 47 and approximately 1/2 mile south
of Weld County Road 6. The parcel of land under consideration is the total contiguous
land holdings of the applicant.
The property under consideration is Lot A of RE -430, which was approved by the Board
of County Commissioners in 1979. The approval of RE -430 divided a 160 acre parcel into
155.05 and 4.95 acres, more or less. The existing 4.95 acre parcel, which is Lot A of RE -
430, lies north of the subject site and contains two residences. The applicant is now
requesting to further subdivide this property into two parcels of 2.7 and 2.2 acres, more or
less. Access to both lots would utilize the existing 30' non-exclusive access and utility
easement onto Weld County Road 47. Individual wells will provide water service to
proposed Lot A and Lot B and septic is used for sewage disposal. The applicant has
stated that the residential use on both proposed lots will not change.
The Department of Planning Services' staff has concerns that this proposal is inconsistent
with efficient and orderly development and the agricultural goals and policies as stated in
the Weld County Comprehensive Plan. Conflicts in land use between landowners are
imminent where one lot is surrounded by another lot. An approximately 30' wide access
easement across Lot B for the benefit of Lot A is not efficient and orderly development,
particularly if the landowners are not family members. Splitting land in this manner and

creating a lineal subdivision is clearly not efficient or orderly development. Additionally, the
applicant is evading the intent of the recorded exemption application process by creating
multiple lots without utilizing the subdivision process. This results in an area of piecemeal
type development.
The Department of Planning Services' staff requests that the Board of County
Commissioners consider this proposal and determine if the standards of Section 11.5.1
through 11.5.7 of the Weld County Subdivision Ordinance have been met.

CONDITIONS OF APPROVAL
1) This well shall be used in such a way as to cause no material Injury to existing water rights. The issuance of the
permit does not assure the applicant that no injury will occur to another vested water right or preclude another
owner of a vested water right from seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction and Pump Installation Rules
2 CCR 402-2, unless approval of a variance has been granted by the State Board of Examiners of Water Well
Construction and Pump Installation Contractors in accordance with Rule 17.
3) Approved pursuant to CRS 37-92-602(3)(c) for the relocation of an existing well, permit no. 30451. The old well
must be plugged and abandoned according to the Water Well Construction and Pump Installation Rules within
ninety (90) days of completion of the new well. The enclosed well abandonment report form must be completed
affirming that the old well was plugged and abandoned.
4) The use of ground water from this well Is limited to ordinary household purposes inside one (1) single family
dwelling, the watering of domestic animals and livestock on a farm or ranch, and the irrigation of not more than
20,000 square feet of home gardens and lawns. This well is to be located on a 4.9 acre parcel at 1474 WCR #47,
Hudson, Colorado.
5) The maximum pumping rate shall not exceed 15 GPM.
6) The average annual amount of ground water to be withdrawn shall not exceed 1 acre-foot.
7) This well shall be constructed not more than 200 feet from the location specified on this permit.
8) The depth of this well shall not exceed 65 feet which corresponds to the base of the alluviamaterial located
above the Arapahoe aquifer.
