Notice is hereby given that at 7:00 13.2.m, on February 20,
1997, at the Town Meeting Room, Nunn Community Center, 185
Lincoln Avenue, Nunn, Colorado, the Nunn Board of Trustees will
hold a public hearing on the petition of LEROY A. BELLMORE and
PEGGY J. BELLMORE for annexation of the territory described below
for the purpose of determining and finding whether the area
proposed to be annexed as BELLMORE ADDITION to the Town of Nunn
meets the applicable requirements of the Municipal Annexation Act
of 1965, and is considered eligible for annexation.
Notice is also given that at such time and place the Nunn
Board of Trustees will also hold a public hearing for the purpose
of establishing zoning districts within BELLMORE ADDITION to the
Town of Nunn, said districts which are more particularly
described below.

PETITION FOR ANNEXATION
TO: THE BOARD TRUSTEES OF THE TOWN OF NUNN, COLORADO
RE: Petition Known As: Bellmore Annexation to the Town of Nunn.
Date: January 07, 1997
We, Leroy A. Bellmore and Peggy J. Bellmore, the undersigned landowners ("Petitioner"), in
accordance with the Colorado law, hereby petitions the Town of Nunn and its Board of Trustees for
annexation to the Town of Nunn of the following describe '. unincorporated territory located in the
County of Weld and State of Colorado, to -wit:
See Exhibit A "attached (the "area proposed to be innexed).
As part of this petition, the Petitioner further states to the Board of Trustees of Nunn, Colorado,
that:
1. It is desirable and necessary that the territory described in Exhibit "A" be annexed to the Town
of Nunn.
2. The requirement of §31-12-104 and §31-12-105, C.R.S., as amended, exist or have been met
in that:
a. Not less than one -sixth of the perimeter of the area proposed to be annexed is contiguous
with the Town of Nunn or will be contiguous with the Town of Nunn within such time
as required by §31-12-104, C.R.S.
b. A community of interest exists between the arca _ roposed to be annexed and the Town
of Nunn.
c. The area proposed to be annexed is urban or will be urbanized in the near future.
d. The area proposed to be annexed is integrated with or is capable of being integrated with
the Town of Nunn.
e. No land within the boundary of the territory proposed to be annexed which is held in
identical ownership, whether consisting of one tract or parcel of real estate or two or
more contiguous tracts or parcels of real estate, has been divided into separate parts or
parcels without the written consent of the landowner or landowners thereof, unless such
tracts or parcels wer.. separated by a dedicated street, road or other public way.

dollars ($200,000.00) for ad valorem tax purposes for the year next preceding the

g. No annexation proceedings have been commenced for any portion of the territory
proposed to be annexed for the annexation of such territory to another municipality.
h. The anncxation of the territory proposed to be annexed will not result in the detachment
of area from any school district.
The annexation of the territory proposed to be annexed will not have the effect of
extending the boundary of the Town of Nunn more than three miles in any direction
from any point of the boundary of the Town of Nunn in any one year.
Prior to completion of the annexation of the territory proposed to be annexed, the Town
of Nunn will have in place a plan for that area, which generally describes the proposed:

parkways, playgrounds, squares, parks, aviation fields, other public ways, grounds, open
spaces, ?ublic uti`ities, and terminals for water, light, sanitation, transportation, and

such plan to be updated at least once annually.

4. Accompanying this petition are four copies of an annexation map containing the following
information:
a. A writte r legal description of the boundaries of the area proposed to be annexed;
b. A map :: towing the boundary or the area proposed to be annexed, said map prepared and

c. Within tie annexation boundary map, a showing of the location of each ownership tract

d. Next to the boundary of the area proposed to be annexed, a drawing of the contiguous
boundary of the Town of Nunn and the contiguous boundary of any other municipality
abutting the area proposed to be annexed, and a showing of the dimensions of such
contiguous boundaries.
5. Upon the Annexation Ordinance becoming effective, all lands within the area proposed to be
annexed will become subject to all ordinances, rules and regulations of he Town of Nunn,
except for general property taxes of the Town of Nunn which shall become effective as the
January 1 next ensuing.

attached Annexation Agreement.

A RESOLUTION (ONCERNING LEROY A. BELLMORE AND PEGGY J. BELLMORE
PETITION AND lINDING SUBSTANTIAL COMPLIANCE OF PETITION WITH
STATE ANNEXAT:'0N LAWS.
WHEREAS, the Town of Nunn is granted the authority under the
Municipal Annexation Act of 1965 to annex land under the
requirements f §31-12-104 and §31-12-105 C.R.S.; and
WHEREAS, LEROY A. BELLMORE and PEGGY J. BELLMORE submitted
an annexation petition to the Town of Nunn on January 7, 1996,
for annexatiol of property located west of County Road 29 and
south of Coun' ' Road 100 (Parcel 1), and property located west of
U. S. Highway .5 and north of County Road 100 (Parcel 2), being
more particul, .ly described as follows:

substantial compliance of the annexation petition in conformance
with §31-12-101, et seq.; and
WHEREAS, §'1-12-108, C.R.S. requires that the Board of
Trustees establish a date, time and place to hold a hearing to
determine if the proposed annexation complies with §31-12-104 and
§31-12-105, C.R S., cr su:h parts thereof, to establish
eligibility for annexation to the Town of Punn; and
4HEREAS, the Town Clerk shall deliver notice and publish the
date, time, and place for said hearing pursuant to State law.
NOW THER':FORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF
THE TOWN OF NUNN, COLORADO,
1. The Board of Trustees has found substantial compliance
of the annexa.ion petition in conformance with §31-12-101,
C.R.S., et seg.
2. The public hearing for determination of the proposed
annexation petition for compliance with §31-12-104 and §31-12-105
is hereby set fcr February 20, 1997, at the Town Meeting Room,
Nunn Communit! Center, 185 Lincoln Avenue, Nunn, Colorado,
beginning at /:(0 p.m.
3. Thi; resolution shall become effective immediately upon
its passage.
