WELD COUNTY COUNCIL
December 6, 1995

ROLL CALL: The meetin• was called to order by Pr- -ident Jim Gardner and the
following members were pre ant, constituting a quo m of the members thereof: Vice
President Stephanie Hayward, ► •uncilwoman Jud Curtis, Councilman Ralph
Campbell, and Councilwoman Pa Malcom. Als-, present were: M.D. and Sharon
Hopper, June Gordon, Artie Elmquis ickey Jean Wilson, Kerry Janis, Janet
Meisinger and the Council secretary.
APPROVAL OF MINUTES: Councilwom- J s Curtis made a motion, seconded by
Councilman Ralph Campbell, to approv= the Nov. ber 6, 1995 meeting minutes. The
motion carried unanimously.
ADDITIONS TO THE AGENDA: ' her request Janet ='singer was added after
Sharon Hopper under public come ents. President Jim Ga aner added to new business
the letter from the third grader - Butler Elementary School. = d Hopper and Artie
Elmquist also asked to speak -during public comments.
APPOINTMENTS: Vice President Stephanie Hayward will try to att d the December
11, 1995 Elected Official Meeting. Councilman Ralph Campbell an ice President
Stephanie Hayward will •ecide which of them will be speaking to the PI- Wing
Commission at its Fe. uary 6, 1995 meeting. The Council will decide at i January
meeting how many . its members will attend the January 23, 1995 Commu 'cations
Advisory Meeting. he secretary will send the agenda of that meeting to Cou cit
members it is av able. President Jim Gardner handed out copies of the 1996
schedule for the lected Officials Meetings, noting that the time had been Chang -
from 10:00 a. . to 1:30 p.m..
P BLIC C ENT : Mr. Bud Hopper asked the Council to investigate the legality of
the Count Commissioners' Emergency Ordinance #185. Mr. Hopper believes that
Ordinan - #185 is illegal because it does not state the nature of the emergency as
requireby the Home Rule Charter, Section 3-14-(6).
Mr. Artie Elmquist asked the Council to look into why the state juvenile detention
facility in Greeley does not require approval of citizens. Mr. Elmquist stated his
concerns regarding the County issuing occupancy certificates for prison facilities that

Weld County citizens have not approved. Mr. Elmquist asked the Council to explore
the early -on time line about the state's need for the land for juvenile detention facility.
He said that early -on it had been said that there was not time for voters to vote on the
facility. But, the state ultimately decided to build in Greeley after the Charter
amendment stating voters would be allowed to vote on such facilites.
Vice President Stephanie Hayward said that the Council -eds to research who
will issue the occupancy certificates for prison facilities on "O" : treet. She also felt that
the Council should research the Colorado State Statues reg- ding when state powers
supersede county and city powers. President Jim Gardne anted to research if
County :w voids cities' rights.
Sh- on Hopper asked the County Council to re .ew the right of County citizens
to vote on th construction of the State Juvenile Det: tion Facility in Greeley. She said
that since vote approved the amendment to vote •n such facilities BEFORE this land
was given to the ate, a citizen vote is needed.
Mr. Hopper 'II send to Councilman Ral. Campbell information regarding
reimbursements for v: ted rights that Mr. El •uist referenced in his outlining of the
court case regarding th Del Camino pre -p- ole facility.
Councilman Ralph ampbell said teat he would find answers to these questions.
Who will issue the occupa y permit for he juvenile facility? Who owns the land?
When did the ownership oft - land =nge? Councilman Ralph Campbell will report
to the Council answers to thes ques ons.
Sharon Hopper requeste• ., the Council look into the cost to citizens of getting
copies from Weld County. Ms. H • • •er felt that $1.50 charge per page was too much.
Sharon expressed concern that e •mmissioners are already in a contractual
agreement with The Villa, and e Com • issioners were not forthright with that
information.
Councilman Ralph C- pbell asked haron Hopper to give him an approximate
date when it was stated by he Commissione that they did not have a contractual
agreement with The Villa. Councilman Ralph t ampbell said that the Council would get
a copy of the contract b: een the Commission s and The Villa. Mrs. Hopper said
that perhaps the Corn ssioners were saying that hey had no pre -parole agreement
with The Villa.
Janet Meisin• -r of Dacono spoke to the Cou it about the matter of jurisdiction
and misconstructio of government. She explained t e activity of common law courts
being formed acro-s America including Weld County. She also outlined the differences
between the national and state corporate and de jure governments.
CORRESPONDENCE:
President Gardner gave the list of 1996 Commissioners Coordinator assignments to
Council members. He also noted the mileage increase to twenty-seven cents per mile
in 1996.

COORDINATOR REPORTS:
Councilw• 'ian Judy Curtis reported the contacts she had ma• - regarding the
emergency o he Pawnee Grasslands in October. She st- -d her opposition to
staffing the disp- chers with EMTs. However, she felt th- there needed to be a
specific procedure •r list of questions asked by dispatcrers during emergency calls.
Councilwoman Judy urtis and Councilwoman Pam ' alcom said that the Council
should discuss these m=tters with the Communications Advisory Board.
Councilman Ralph Campbel aid that former C • ncilman David Young had previously
researched concerns about ru :I emergencies It appeared to Councilman Ralph
Campbell that the Council's prey •us concer were now happening. Councilwoman
Stephanie Hayward wondered if a hing :d changed procedurally since the City of
Greeley was handling emergency ca - d had anything changed since the Pawnee
incident.
The Council asked Council member Judy c rtis and Pam Malcom to prepare a list of
questions for the Communications : oard. It =s agreed that any such questions or
concerns should be sent to the C•-mmunication Board before any meeting that the
Council would have with the Bo- rd.
OLD BUSINESS:
CCI Conference
President Jim Gardner resorted on the CCI November Con ence. Councilman Ralph
Campbell suggested th- President Jim Gardner write a letter o the Commissioners
regarding the value of e conference and his experience there.
December 5 Work Session
Action regarding t e Council's December 5 Work Session was assignto the January
agenda.
1996 Council Budget
Vice Presiden Stephanie Hayward said that as many Council members as possible
should attend ture Council Budget Hearings. Councilman Ralph Campbell expressed
pleasure in Don Warden's presentation for the County Council. Councilman Campbell
felt that there should be a way to reward County departments for NOT spending all
their budgets. He expressed that government personnel are currently motivated to
spend all their budgets and ask for more. He mused that, in contrast, there should be a
way "savers" could be rewarded.

Council Letters
The Council discussed the timing of sending proposed letters to the Sheriff. Vice
President Stephanie Hayward was asked to compose a letter referencing the Home
Rule Charter. President Jim Gardner was asked to hand deliver the letter referencing
the September 6, 1995 Council motion. It was decided that signatures of all Council
members should be on any letters sent.

Payment of the Bills
Vice President Stephanie Hayward made a motion, seconded by Councilwoman Judy
Curtis, to pay the following bills: Councilman Ralph Campbell - $ 22.00
President Jim Gardner - $147.34
Councilwoman Judy Curtis - $ 60.00
Windsor Beacon - $ 5.69
Council's January 1996 Meeting Date
Councilwoman Pam Malcom made a motion, seconded by Vice President Stephanie
Hayward that the County Council meet January 3, 1996 at the Weld Centennial Center,
915 10th Street, Greeley, CO at 7:30 p.m.
Letter from Butler Elementary School
It was decided that the Council would invite the third graders of Class E-8 of Butler
Elementary School to the January Council meeting. The invitation would ask the third
graders to present their case for a Colorado State Insect in person. The Council felt
that this would be an opportunity for students to get involved in their government. Vice
President Stephanie Hayward also suggested that invitations to future Council
meetings be extended to area high school students.
Secretarial Research Requests
Council secretary will be attending the County training for Banner.
Designing an evaluation form for the Council secretary was assigned to Councilwoman
Judy Curtis.
Customer Service material from Mr. Don Feldhaus was distributed to Council members.

Councilwoman Judy Curtis requested secretarial research into the background of
Ordinance #173-C. Specifically, she wanted the history of the ten-year time
requirement for recorded exemptions. Council members requested a copy of
Ordinance #173-C
President Ji Gardner, Vice President Stephanie Hayward =nd Councilman Ralph
Campbell want - copy of the final Comprehensive Plan.
