HomeMy WebLinkAbout961016.tiff SUMMARY OF THE WELD COUNTY PLANNING COMMISSION MEETING May 21, 1996 A regular meeting of the Weld County Planning Commission was held May 21, 1996, in the County Commissioners' First Floor Hearing Room (#101),Weld County Centennial Center, 915 10th Street, Greeley, Colorado. The summary of the last regular meeting of the Weld County Planning Commission held on May 7, 1996, was approved with a correction: Cristie Nicklas was present. CASE NUMBER: 89-GG PLANNER: Keith Schuett REQUEST: Amendments to Sections 10, 24, 25, 33, 34 and 53 of the Weld County Zoning Ordinance. Keith Schuett explained these proposed amendments will bring the Zoning Ordinance in-line for better clarification . Examples were given where interpretation vs. the need for clearer written clarification regarding communication towers in the Commercial and Industrial zone districts, temporary fireworks stands, temporary Christmas tree sales,etc. Keith also explained that the Weld County Health Department does not allow septic systems in the Floodway zone. The Zoning Ordinance needs to be amended to concur with this requirement. Ron Sommer asked if this amendment would only address new proposed septic systems in the Floodway zone. He wanted to know if there were any systems in existence and what would a property owner owner need to do to replace an existing one. Keith explained the Floodway zone requires sanitary sewer systems. Lee Morrison explained that any new or replacement system would have to be designed to meet current standards. The Vice-Chairperson asked if there was anyone in the audience who wished to speak for or against this application. No on wished to speak. Jack Epple moved Case 89-GG, Amendments to Sections 10, 24, 25, 33, 34, and 53 be forwarded to the Board of County Commissioners with the Planning Commission's recommendation for approval. Arlan Marrs seconded the motion. The Vice-Chairperson asked the secretary to poll the members of the Planning Commission for their decision: Ron Sommer - yes; Cristie Nicklas - yes; Marie Koolstra - yes; Jack Epple - yes; Arlan Marrs - yes; Ann Garrison-yes. Hodges (Continued from April 2, 1996, regular scheduled meeting). APPLICANT: Ronald Green (Green Acres Retirement Community) REQUEST: A Change of Zone from A (Agricultural) to PUD R-1 (Planned Unit Development for residential and open space uses. LEGAL DESCRIPTION: Part of the SW4 of Section 4, T2N, R68W of the 6th P.M., Weld County, Colorado. LOCATION: South and adjacent to State Highway 56; east and adjacent to Weld County Road 1. Todd Hodges explained that the applicant has indicated a request for a continuance until July 2, 1996, to evaluate the possibility of annexation into the Town of Berthoud. The Vice-Chairperson asked if there was anyone in the audience who wished to speak for or against this application. No one wished to speak. Eastin APPLICANT: Rocky Mountain Trust C/O Rusty Green (Del Camino East Phase I) REQUEST: Change of Zone for A(Agricultural)to a PUD (Planned Unit Development) (C-1, C-2, C-3, I-1, 1-2) LEGAL DESCRIPTION: The SW4 of Section 11,T2N, R68W of the 6th P.M.,Weld County, Colorado LOCATION: North of and adjacent to Weld County Road 22; approximately 1/4 mile east of 1-25 Frontage road. Ron Sommer asked to be excused a decision regarding this application and stepped down. Shani Eastin, explained this application is for a Change of Zone from A(Agricultural)to PUD (Planned Unit Development, C-1, C-2, C-3, 1-1, and 1-2). The proposed site is located in the Mixed Use Development area. The Tri-Area Planning Commission, Frederick, Firestone and Dacono were sent referral information. Surrounding land uses include agricultural to the north, prime farmland to the east, agricultural land and an existing Special Review permit for a violin shop to the south and the Colorado Army National Guard to the west. This application is determined to be compatible with the surrounding land uses and is consistent with the Weld County Zoning Ordinance, as amended. Responses from referral entities have been included in the packets submitted to each Planning Commission member. Service providers will include Central Weld County Water Conservancy District and St. Vrain Sanitation District. Access to the proposed site (lots) is restricted from Weld County Road 22. Shani also explained the need for the addition of the word "of in Condition of Approval#7. The PUD site is not located within the Geological Hazard or Airport Overlay District. Portions of the site do lie in a floodplain. Soil conditions on the site do no present moderate or severe limitations to the construction of structures and/or facilities proposed for the site. • SUMMARY OF THE WELD COUNTY PLANNING COMMISSION MEETING May 21, 1996 Page 3 Barb Brunk, representative, Rocky Mountain Consultants introduced Stan Olson, property owner, Rusty Green, representative for the owner, and Dan Brand, a planner with Rocky Mountain Consultants. She explained this is a conceptual plan that would be relative to other uses in the proposed Mixed Use Development area. Man Marrs asked her about road improvements and maintenance. Barb Brunk explained that a traffic study and improvements agreement would be negotiated at the appropriate time. The Vice-Chairperson asked if there was anyone in the audience who wished to speak for or against this application. No one wished to speak. C/O Cathy Patchett REQUEST: Amendment to Comprehensive. Plan in MUD area LEGAL DESCRIPTION: Located in part of the S2 of the NE4 of Section 6, T2N, R68W of the 6th P.M.,Weld County, Colorado. (Approximately 74 acres) LOCATION: 1/4 mile north of Highway 119, 1/2 mile east of Weld County Road 1. Kerri Keithley, explained the Department of Planning Services had received a letter from the applicant with a request to withdraw the application. They have determined the proposed site is not appropriate for their purpose. The Vice-Chairperson asked if there was anyone in the audience who wished to speak for or against this application. No one wished to speak. Arlan Marrs moved Case Number CompAmend 7, be withdrawn. Ron Sommers seconded the motion. Plan in MUD area LEGAL DESCRIPTION: Located in part of the N2 of Section 14, T2N, R68W of the 6th P.M., Weld County, Colorado. (154.6 Acres) LOCATION: 1/2 mile east of Highway 1-25, south and adjacent to Weld County Road 22 SUMMARY OF THE WELD COUNTY PLANNING COMMISSION MEETING May 21, 1996 Page 4 Kerri Keithley, stated that a clarification would need to be made at this time, the applicant should be referred to as Rocky Mountain Trust. Rocky Mountain Consultants is the representative for Rocky Mountain Trust. Kerri Keithley explained the Department of Planning Services has received a letter from Fred and Gretchen Webb, and it has been included in the Planning Commission member's packet. This request is for an amendment to the Comprehensive Plan within the I-25 Mixed Use Development area. This property is located approximately 1/2 mile east of Interstate 25 and south of and adjacent to Weld County Road 22. Surrounding land uses include Del Camino Center to the west and residential uses to the north and east. This site which is a 155 acre parcel, currently carries an undesignated land use category in the conceptual plan. The applicant is proposing a business/industrial land use classification for the west portion (75 acres) of the site. This designation is consistent with the surrounding properties in the area. Godding Hollow runs through the center of the parcel. The applicant proposes to utilize this as open space and a physical separation for buffering the industrial and residential uses which would help assure compatibility between the two land uses. The applicant is also proposing a pedestrian trail along Godding Hollow to provide a recreational amenity. Staff has received a referral from the St.Vrain Valley School District indicating their capacity concerns at the elementary school level. They have requested additional information on the senior and empty nester restrictions from the applicant. Department of Planning Services has received two letters in opposition of the request. The letter address specific developmental concerns which would be addressed at a future change of zone or sketch plan review phase of the development. The Department of Planning Services' believes the intent of the Comprehensive Plan has been met. Arlan Marrs asked about the proposed neighborhood center. Barb Brunk explained the new urbanism concept plan where people can walk to shops, recreational facilities, swimming pools, etc., with community areas to bring the neighborhood together. She reminded the Commission that this would be a senior"empty nester" community. Barb Brunk then asked Monica Daniels-Mika if she would like to address the Planning Commission with more information regarding this concept. Monica gave an overview and explained there are components being explored now but a study has not been adopted.
