RE: SITE SPECIFIC DEVELOPMENT PLAN, MINOR SUBDIVISION FINAL PLAT IN THE
E (ESTATE) ZONE DISTRICT, AND VARIANCE FROM THE WELD COUNTY
SUBDIVISION ORDINANCE - JERKE
A public hearing was conducted on February 6, 1995, at 1:30 p.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated November 14, 1994, and duly published
November 24, 1994, in the Windsor Beacon, a public hearing was conducted on December 7,
1994, to consider the request of William H. and Charles W. Jerke for a Site Specific Development
Plan and Minor Subdivision Final Plat in the E (Estate) Zone District. At said hearing on
December 7, 1994, the matter was continued to December 28, 1994, pursuant to a notice dated
December 7, 1994, and duly published December 15, 1994, in the Windsor Beacon, to consider
the request of William H. and Charles W. Jerke for a Site Specific Development Plan, Minor
Subdivision Final Plat in the E (Estate) Zone District, and Variance from the Weld County
Subdivision Ordinance. At said hearing on December 28, 1994, said matter was again continued,
at the request of William Jerke, to February 6, 1995, at 1:30 p.m. Lee Morrison, Assistant County
Attorney, made this a matter of record. Keith Schuett, Planning Department representative,
entered the recommendations of the Planning Commission into the record as written, changing the
word "North" to "Central" in the second sentence of the third bullet under Item #2 on Page 1 of the
Planning Commission's resolution for said Minor Subdivision Final Plat. Mr. Schuett indicated this
matter was previously continued to allow changes to the internal roadway system and determine
adequacy of water. He stated a letter was received from Central Weld County Water District
indicating adequate water is available for residential use, but inadequate to meet fire flows. Bill
Jerke, applicant, was present and stated an agreement with the LaSalle Fire Department is close
to being resolved. He noted, however, the fire department is requesting a push-button valve
system at the hydrant to activate the well, which will cost several thousand dollars and has potential
problems. He stated he prefers to use the existing capabilities, which include a hand crank, to
minimize problems and save money. Responding to questions from the Board, Mr. Jerke stated
there is an existing road to the well and also noted for the record the letter from Central Weld
County Water District indicating adequate domestic water. Gary Sandau, LaSalle Fire Protection
District (FPD), stated a hydrant service with water available at all times is necessary for adequate
fire protection. He stated the requested valve system should not be a problem; however, it is
relatively new and he is not familiar with it. He noted a stand -pipe system may be adequate, rather
than an actual fire hydrant. Mr. Sandau referred to the installation of the valve system and the
revised drawing which includes the new fire protection line. Also responding to questions from the
Board, Mr. Schuett referred to the second bullet under Condition of Approval #1 and Condition of
Approval #3 concerning an improvements agreement and compliance with the requirements of the
LaSalle FPD, respectively. He suggested modifying Condition of Approval #2 concerning the fire
hydrant(s) which could be in accordance with the agreement between the LaSalle FPD and the
Jerkes. Mr. Morrison reiterated the water -delivery system for fire protection should be in
accordance with said agreement; however, the agreement should be provided to staff prior to
recording the plat. Commissioner Kirkmeyer suggested Mr. Jerke assure the Board today of
adequate fire protection and resolve the agreement with the LaSalle FPD. Mr. Schuett suggested
the words "fire hydrant(s)" in Condition of Approval #2 be modified to "water -delivery system". Mr.
Jerke stated he is unsure when an agreement will be resolved. Mr. Sandau explained the fire
department's response is limited to two pumpers and one tanker, and the problem is to figure out
a way to get someone to the well, which is one -quarter of a mile away, to turn it on, while others
are setting up to fight a fire. He noted the well will be used for irrigation 99 percent of the time;
however, the irrigation system must be able to be shut off and all the water must be put into the line
in case of a fire. Mr. Sandau reiterated this type of system is new to the district, and it currently

uses farmers overhead wells for water. Mr. Jerke stated there is an existing switch at the well, as
well as a hand crank to bring the water down. He reiterated concern about how long the new
switch would work and the cost, which would be a minimum of $3,000 to $4,000. Chairman Hall
clarified that Mr. Sandau prefers all turn -on capabilities at the hydrant; therefore, the issue is
whether the switch will be at the hydrant or at the well. Mr. Sandau confirmed there is a manual
override on the proposed electric switch and reiterated the district prefers the electric access at the
hydrant or stand pipe. Mr. Jerke confirmed the district's desire is outlined in its agreement and
discussed other problems with the request. Mr. Sandau confirmed the switch would be tested
regularly by the district. Mr. Jerke submitted two agreements to Mr. Morrison, who read them into
the record and clarified the differences. A copy of the district's agreement was retained and
marked as Exhibit L. Mr. Sandau confirmed for Commissioner Kirkmeyer that Code 25 of the
NFPA would be met with the turn -on system at either the well site or the hydrant. Commissioner
Kirkmeyer concluded that it should be Mr. Jerke's decision as to the location of said system and
suggested adding such language to the second bullet under Condition of Approval #1, which
concerns compliance with the requirements of the LaSalle FPD. Mr. Schuett suggested the
seventh bullet under Condition of Approval #1 be amended to read "water -delivery system for fire
protection" rather than "fire hydrant(s)" and a second sentence be added requiring manual or
remote turn -on capabilities at the stand pipe or at the well site. No public testimony was offered
concerning this matter. Mr. Schuett confirmed there are no problems with the existing second
bullet under Condition of Approval #1 because Mr. Sandau clarified options exist under Code 25.
He noted the words "fire hydrant" in Condition of Approval #3 should also be changed to "water -
delivery system", as well as any other instances. After further discussion, Commissioner Kirkmeyer
clarified the changes for Mr. Jerke who agreed with said changes and all other Conditions of
Approval. Mr. Schuett noted Condition of Approval #3 requires the subdivision improvements
agreement be approved by the Board and reiterated the change on Page 1 from "North" to
"Central". Commissioner Baxter confirmed the improvements agreement must be approved by the
Board and collateral must be secured prior to recording the plat. Commissioner Kirkmeyer moved
to approve the request of William H. and Charles W. Jerke for a Site Specific Development Plan
and Minor Subdivision Final Plat in the E (Estate) Zone District, based on the recommendations
of the Planning staff and the Planning Commission, with the Conditions of Approval as entered into
the record, including the following changes: change "North" to "Central" on Page 1, change all
instances of "fire hydrant" to "water -delivery system for fire protection", and include the additional
language submitted by Mr. Schuett to the seventh bullet under Condition of Approval #1. The
motion was seconded by Commissioner Webster, and it carried unanimously. Mr. Schuett
reminded the Board a Variance from the Subdivision Ordinance concerning the restriction to one
access has been requested to allow two accesses. No public testimony was offered concerning
this matter. Commissioner Webster moved to approve said request, and Commissioner Baxter
seconded the motion, which carried unanimously.
This Certification was approved on the 8th day of February, 1995.
