Dear Glen:
The question which you submitted to me, concerning the use
of road fund money, specifically Highway Users Tax funds, in the
disposition of your trash problem must be answered in the negative.
Article 10, Section 18 of the Colorado Constitution forbids
such use. However, if you were constructing and maintaining a
road out to a trash dump such use, I believe, would be permissable,
otherwise not.
