Weld County Health Department 1517 16th Avenue Court MAY 0 8 1998 Greeley, CO 80631 f Subject: North Weld Sanitary Landfill (NWSL) Financial Assurance Plan Dear Mr. Jiricek: - • This letter provides information related to your memorandum dated February 13, 1998, to Mr. Glenn Mallory of the Colorado Department of Public Health and Environment (CDPHE). The WCHD's memorandum states that the NWSL must either provide funds to install the appropriate surface water controls or provide a demonstration that the existing and future controls are constructed to handle the 100-year, 24-hour storm event. NWSL believes the information provided herein demonstrates that its April 1997 Financial Assurance Plan includes sufficient funds forstorm water control improvements. The current surface water control structure for the covered portions of the disposal area was constructed as part of the Module 3 liner project during 1996. The construction details and location of the surface water control structure was included in the NWSL Phase 1 Module 3 Construction Plans dated November 1995, which was approved by CDPHE and WCHD on July 10, 1996 and July 18,, 1996 respectively. As shown on the construction plans, the surface water control structure consists of a drainage channel and surface water collection pond. The Module 3 drainage channel was tied in with the existing drainage channel, which was previously constructed during Module 1 and 2 liner projects. The surface water drainage channel is located along the south side of Modules 1, 2 and 3. This channel conveys surface water run-off from covered portions of Modules 1, 2 and 3 and surface water run-on from adjacent cut slopes within the Phase 1 excavation to a collection pond located east of Module .3. The area adjacent to the active disposal area, which includes,the surface water collection pond;will accommodate storm water improvements for the 100—year, 24-hour storm event. Based oh _; the conservative assumption that all of the precipitation from such an event (4.6 inches from NOAA Atlas 2, Volume III) would drain from the tributary.portion of the landfill to this area, the area would need to be excavated by an average depth of about 2.5 feet to hold this volume. The excavated soil, which is estimated to be less than 20,000 cubic yards, would be used • within the landfill footprint prior to placing final cover in,order to achieve the minimum grades set forth in the Colorado Solid Waste Regulations. As noted-in the NWSL Closure/Post-Closure Plan and Financial Assurance Plan, 60,000 cubic yards of a division of Waste Management Disposal Services of Lolrmri Letter Trevor Jiricek May 1, 1998 Page 2 soil was estimated to be required for achieving these minimum slopes. The remaining 40,000 cubic yards of soil would be obtained from nearby stockpiles or other suitable on-site sources. We trust this letter adequately addresses the issue raised in your February 13, 1998 memorandum to Mr. Mallory, and we therefore request the County's approval of the Financial Assurance Plan for NWSL. Since NWSL has established financial assurance in accordance with the Colorado Solid Waste Regulations, acceptance of this Financial Assurance Plan by the WCHD, and Weld County Board of County Commissioners will allow for the termination of the Letter of Credit and the disbursement of funds held in the corresponding Trust Account in Weld County which comprise the primary components of the previously existing Financial Assurance Agreement. • Should you have any questions concerning this response, please contact either of us at (970) 686-2800. We have further changed Section 3.2 of the WIP and extended the expiration date for the profiles from three years to five years provided the process generating the waste has not changed. The accompanying cover letter dated February 26, 1998, summarized the primary updates and revisions to the Plan, although other modifications were noted as well. The Division is approving the Plan provided that the facility abide by the conditions outlined in a Division letter dated July 8, 1997; and in correspondence from Weld County Health Department(WCHD), dated July 30, 1997. Such conditions provided for notification of WCHD, and the Division, if actual leachate volumes do not correspond to the predicted volumes for Phase 1, Module 3, as presented in the RUST Environment &Infrastructure,March 11, 1997 Report. Dear Mr. Scheere and Mr.Hedberg, The Solid Waste Unit of the Hazardous Materials and Waste Management Division (the Division) has reviewed the Updated Waste Identification Plan (WIP), dated November 1997, and received by the Division February 27, 1998 under cover letter dated February 25, 1998. Division review was requested as this Updated WIP is to replace the previously approved"Access Control Plan"(ACP)submitted in October of 1993. Prior to granting approval of the Updated WIP,the Division requests the following: I) The facility conduct a minimum of two (2) random load inspections per week, conducted in accordance with current accepted industry standard, and include all associated load inspection records as part of the facility's operating record for regulatory review. As stated in a recent letter from Mr. Trevor Jiricek of the Weld County Health Department, dated March 4, 1998, the facility should' review the document entitled"Waste Screening at Municipal Solid Waste Management Facilities," dated September 1993, prepared by the Solid Waste Association of North America. Reference to a letter from Mr. Steve Laudeman of the Division, dated October 2, 1997, is also recommended as it provides further comment on this issue. 2) The facility include language in the Updated WIP regarding expiration of a waste acceptance decision. The ACP, Section 3.2 provided for the application of an expiration date for the decision to be assigned, not to exceed three years from the date that the waste stream was approved for management, and to be renewed if the process generating the waste changes. Section 3.3 of the ACP also provided that prior to the expiration date, the underlying facts concerning the waste stream will be re-examined and a decision rendered in accordance with Section 3.2 as to whether to continue managing the wastes and whether expanded service is required. The Division believes that such expiration dates are valuable, and necessary, to the maintenance of appropriate waste screening and management techniques. 3) The facility add language to Section 3.3 of the Updated WIP which provides that any changes made • to written information provided by the generator be initialed and dated by facility personnel making such changes, and the reason for any/all changes noted, as well as the generator notified if the changes affect the precautions, conditions, or limitations of the decision portion of the Generator's Waste Profile Sheet/Decision. Refer to Section 3.5 of the ACP. QNWSL-WIP-2 Based on the Division's review of the Updated WIP,all other aspects of the plan are acceptable. As the Weld County Health Department has reviewed and approved the Updated WIP with the condition illustrated in#1 above, the Division will defer to the county regarding this matter and approve the plan with the above three stipulated requests. Access Control Plan) Dear Ms. Lujan and Mr. Jiricek: Enclosed for your information is a copy of the updated plan titled "Waste Identification Plan" (WIP) dated November 1997, prepared by Waste Management Disposal Services of Colorado, Inc. for the NWSL.;This plan describes the facility waste identification program,-including-waste screening- procedures for the detection and prevention of the disposal of polychlorinated biphenyl (PCB) and regulated hazardous wastes at NWSL in accordance with Section 2.1.2 of the Regulations Pertaining to Solid Waste Disposal Sites and Facilities (Regulations) (6 CCR 1007-2) revised November 30, 1995. This updated plan replaces the "Access Control Plan" previously submitted to the Colorado Department of Public Health and Environment (CDPHE) and Weld County Health Department (WCHD) on October 8, 1993. The NWSL WIP contains general editorial changes consistent with the requirements of the revised Regulations. The plan changes were also made in order to maintain consistency with the WIP previously approved by the WCHD for our Buffalo Ridge Landfill located in south-eastern Weld County. The focus and procedures of the updated NWSL WIP have not changed and continue to serve as a PCB and hazardous waste screening mechanism. The D&O Plan and SDP were updated by Waste Management Disposal Services of Colorado, Inc. (WMDSC)based on design modifcations made to the base liner and final cover systems at NWSL. These design modifications were approved by the Colorado Department of Public Health and Environment(CDPHE) and Weld County Health Department (WCHD). Please place the enclosed Drawings 9, 10 and 11 in your SDP and discard the previous drawings. In addition, the updated D&O Plan was reviewed and further modified by NWSL to include general editorial changes and updates since its last revision in January 1996. The primary revisions are described below: • Revised Section 1.6 and updated the list of site documents including document revisions. • Revised Section 4.9 to reflect approvals by CDPHE and WCHD concerning final cover design modifications. • Deleted Section 6.7.4 titled "Site Appearance". These revisions included requirements for owners and/or operators of solid waste disposal facilities to establish financial assurance sufficient to ensure payments of costs associated with closing the facility and conducting post-closure care activities. Waste Management Disposal Services of Colorado, Inc. (WMDSCI, then known as Waste Services Corporation entered into a Financial Assurance Agreement with Weld County patterned after the anticipated (draft) Subtitle D regulations. Accordingly, pursuant to Condition 3c of the Certificate of Designation Special Review Permit issued June 27, 1990, WMDSC submitted a Letter of Credit//38318 to the Weld County Board of County Commissioners on January 31, 1992. In addition, WMDSC established a Trust Fund with the Weld County Treasurer to be funded over several years (based on received volumes) not to exceed $113,172. The Letter of Credit would be canceled when the Trust Fund reached that amount. Although the Colorado version of the federal Subtitle D regulations (Regulations) became effective October 1993, the financial assurance provisions of the Regulations became effective April 9, 1997. Accordingly, WMDSC submitted a Financial Assurance Plan to the Colorado Department of Public Health and Environment (CDPHE), Weld County Health Department (WCHD) and Weld County Department of Planning Services in compliance with the provisions and requirements of the revised Regulations. The NWSL Financial Assurance Plan meets the specific financial assurance requirements for solid waste disposal sites as listed in Section 1.8 of the Regulations as described below: I. Maintain cost estimates, in current dollars, for hiring a third party to close the largest area of the facility requiring closure during the active life of the site. The cost estimate must also include costs associated with conducting post-closure care. 2. The facility must establish financial assurance sufficient to ensure payment of the third-party closure and post-closure care costs. Since submittal of the NWSL Financial Assurance Plan in April 1997, we have maintained financial assurance pursuant to both the Weld County Agreement and the Financial Assurance Plan for the NWSL. The April (997 Plan has been accepted by CDPIIE as meeting the financial assurance requirements of the Letter Board of Commissioners February 19, 1998 Page 2 Regulations and provides superior financial assurance, compared to the original Weld County Financial Assurance Agreement. This original agreement included provisions for an eventual fund of $113,172 compared with the April 1997 Plan which includes $845,753. In the future, this account will be adjusted, in order to provide continuing and adequate amounts of financial assurance in accordance with the Regulations. Consequently, we request the Board of County Commissioners accept the State approved Financial Assurance Plan dated April 1997. Since North Weld Landfill has established financial assurance in accordance with the Regulations, we further request that the Letter of Credit established under the Agreement be terminated and any funds held in the Trust be returned to WMDSC. We have enclosed a copy of the April 1997 Financial Assurance Plan for your information. Thank you for your consideration of this request. We look forward to your acceptance of the enclosed Financial Assurance Plan and release of the existing enclosed Agreement.
