The Defendant K.N. Front Range Gathering Company may have had some right in the property by virtue of an easement only for a pipeline granted in instrument recorded August 13, 1993, in Book 1397, under Reception No. 2346150, Weld County Records. 12. The Defendant The Board of County Commissioners of the County of Weld may have had some right in the property by virtue of a Road Maintenance Agreement recorded March 10, 1994, in Book 1430, under Reception No. 2377517, Weld County Records. 13. The Defendant Panhandle Eastern Pipeline Company may have had some right in the property by virtue of a right-of-way easement only for a pipeline and cathodic equipment granted by instrument recorded September 27, 1974, in Book 724, under Reception No. 1645680, Weld County Records,and recorded February 25, 1975,in Book 733, under Reception No. 1654750, Weld County Records. 14. MOTION TO JOIN PARTIES AND AMEND COMPLAINT Plaintiff Asphalt Paving Co., by and through its attorneys, Banks & Imatani, P.C., pursuant to Rules 15 and 19, F.R.C.P., respectfully moves this Court for an order to join parties and amend its Complaint, and in support thereof states: 1. This is an action in rem to quiet title to certain real property located in Weld County, Colorado ("Property"). Plaintiff Asphalt Paving Co., a Colorado corporation, by and through its attorneys, Banks & Imatani, P.C., for its claim states as follows: 1. Plaintiff is the owner and in possession of the real property situated in Weld County, Colorado, described in "Exhibit A" attached hereto and incorporated herein by this reference (the "Property"). Although Plaintiff is the owner and is in possession of all of the lands described in the attached Exhibit A,this action pertains only to that strip of land across the lands described in Exhibit A which existed as a drainage ditch across these lands in 1897. In 1897, the Defendant Frederick Wattenberg conveyed to Christian Wattenberg by deed recorded October 19, 1897, in Book 155, Page 37, Weld County Records, that part of the Northeast Quarter of Section 25 lying West of a certain drainage ditch to one party and on the same date, conveyed that part of the Northeast Quarter of Section 25 lying East of that certain drainage ditch to Defendants Anna Wattenberg, Fred Wattenberg, Julius Wattenberg, and Christian Wattenberg by deed recorded October 19, 1897, in Book 155, Page 38, Weld County Records. This action pertains to that portion of the Northeast Quarter of Section 25 which lies between the West side and the East side of that drainage ditch as it existed in 1897. (Copies attached as Exhibits C and D). 2. Attached to the Complaint as "Exhibit B" and by this reference incorporated herein, is a copy of the Affidavit of Jeffrey W. Keller, President of Plaintiff, which Affidavit verifies the adverse possession of the property by Plaintiff and Plaintiffs' predecessors in interest for a period of time in excess of the applicable Statutes of Limitation. The original Affidavit is attached to the original Complaint filed in this matter. 2 2. This action was originally filed in the District Court of Weld County, Colorado as Case No. 97-CV-632. This case was removed to the United States District Court for the District of Colorado upon the request of the United States Attorney on behalf of defendant United States of America, which claims some right in the Property by virtue of an easement for electric transmission line. 3. Plaintiff has since discovered four additional parties who are heirs of Frederick Wattenberg, who was one of the earliest title owners of the Property. Said heirs are parties necessary to allow complete relief among those already parties. In addition, said heirs may claim an interest in the Property, and their absence may cause persons already parties to this action to be subject to a substantial risk of multiple or inconsistent obligations by reason thereof. 4. Plaintiff also desires to designate the Public Trustee of Weld County as the successor representative of two dissolved corporations, X O Exploration, Inc. and Wattenberg Improvement Association, Inc., who have previously been named in this action. 5. Plaintiff additionally desires to omit Defendant Denver Pacific Railroad and Telegraph Co., which has no interest in the Property. 6. This matter is not set for trial. 7. The amendments to Plaintiffs complaint are necessary to properly quiet title to the Property as defined in the complaint. 8.
