Hall, Chairman Commissioner Barbara J. Kirkmeyer, Pro -Tern - ABSENT Commissioner George E. Baxter Commissioner Constance L. Harbert Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Gloria Dunn The following business was transacted: I hereby certify that pursuant to a notice dated December 12, 1994, and duly published December 22, 1994, in the Windsor Beacon, a public hearing was conducted to consider the request of Paul and Louanne Timm for a Site Specific Development Plan and Special Review Permit for a Commercial Use (Bed and Breakfast Facility) in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Gloria Dunn, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record as written, including three Conditions of Approval and ten Development Standards. Paul Timm, applicant, was present and stated the site is actually in the SE 1/4 of Section 12 rather than in the NE 1/4. Mr. Morrison confirmed the vicinity map is correct and the site is shown as being in the SE 1/4; however, the legal description is within the ownership of Mr. Timm. Let the record reflect Commissioner Kirkmeyer is now present. Mr. Morrison stated the notice was mailed to all owners adjacent to Mr. Timm's ownership; therefore, there is no problem with the notice. Mr. Timm noted that Weld County maintenance ends at Roads 59 and 130 and questioned whether the private drive would be maintained. He explained a previous verbal agreement was made between his father-in-law and Weld County to not maintain to the end of Road 130, but to cut across the field and maintain the drive. Discussion ensued, and Mr. Morrison stated only Weld County rights -of -way and roads used by the general public are maintained by the County. After further discussion, Mr. Paul clarified he would not state that such an agreement does not exist; however, he would agree to whatever is necessary. No public testimony was offered concerning this matter. Mr. Paul confirmed all Conditions of Approval and Development Standards are acceptable and stated he is familiar with the standards for bed and breakfast facilities. Commissioner Harbert moved to approve the request of Paul and Louanne Timm for a Site Specific Development Plan and Special Review Permit for a Commercial Use (Bed and Breakfast Facility) in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record.
