RESOLUTION
RE: APPROVAL OF RECORDED EXEMPTION #1723 - SCHILD
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under Section
30-28-101(10)(d), CRS, as amended, did determine at a public meeting held in the Chambers of
the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known
as Recorded Exemption #1723, does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land", and
WHEREAS, the request for Recorded Exemption #1723 was submitted by Richard D. and
Dorothy J. Schild, 41764 Weld County Road 15, Fort Collins, Colorado 80524, for property which
is described as Lot B of RE #514, being located in the NE% of Section 7, Township 7 North,
Range 67 West of the 6th P.M., Weld County, Colorado, being more particularly described in the
plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded,
and
WHEREAS, this request is to divide the property into parcels estimated to be approximately
43 acres and 34 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from
the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1723 submitted by
Richard D. and Dorothy J. Schild be, and hereby is, approved conditional upon the following:
1. Prior to recording the plat the applicant shall submit evidence to the Department of
Planning Services that parcel number 070507000029, owned by North Weld County
Water District, is excluded from Lot A. The exclusion shall be shown on the plat.

2. The applicant shall submit a mylar plat to the Department of Planning Services to
be recorded in the office of the Weld County Clerk and Recorder. The plat shall be
prepared in accordance with the requirements of Section 11.7 of the Weld County
Subdivision Ordinance. The plat shall be submitted within sixty days from the date
of approval by the Board of County Commissioners. The applicant shall be
responsible for paying the recording fees.
3. No new additional accesses shall be allowed to either Lot A or Lot B.
4. Prior to recording the plat, the applicant shall provide to the Department of Planning
Services staff evidence of the conveyance or reservation of North Poudre Irrigation

Dear Commissioners:
This request for a recorded exemption is submitted by Richard D. and Dorothy I Schild. The
parcel of land on which this request is being made is described as Lot B or RE -514, being in the
NE4 of Section 7, T7N, R67W of the 6th P.M., Weld County, Colorado. The property is located
south of and adjacent to WCR 84 and west of and adjacent to WCR 15. This request is to further
divide Lot B of RE -514 into two parcels of 43 acres and 34 acres, more or less. Both proposed
parcels are currently vacant farm ground. North Weld County Water District is proposed for the
water source and septic systems is proposed for sewage disposal.
The Department of Planning Services' staff has concerns that the proposed division is inconsistent
with the Agricultural Goals and Policies as stated in the Weld County Comprehensive Plan. The
division of this parcel would create two buildable lots thus contributing to a sprawl row type
development. The minimum lot size of parcels in the Agricultural Zone District is 80 acres which
is intended to retain viable farming operations and to accommodate modern agricultural equipment
and irrigation practices. This request, if approved, would allow for a residence on both proposed lots
thus reducing prime agricultural farm ground making farming practices difficult on both parcels
as well as introducing the possibility for additional residences into this area which causes conflict
between urban and rural uses. The surrounding land uses are primarily agricultural in nature

and when additional urban uses are introduced to this area add to conflicts with urban and rural
disparity. The proposed lot is identified as prime farmground of National importance by the
Department of Agriculture Soil Conservation Service. Reduction of prime agricultural ground is
in conflict with the Agricultural Goals and Policies of the Weld County Comprehensive Plan.
The applicant has stated in the application materials that the reason for the recorded exemption is
for agricultural purposes and for future sale. The Comprehensive Plan allows a lot in the A
(Agricultural) Zone District to be divided into two separate parcels if the intent of the recorded
exemption is met. This applicant however is not able to satisfy any of the three criterion. The three
criteria for dividing a lot in the A (Agricultural) Zone District as stated in the Comprehensive Plan
Agricultural Policy #7 is to:
A. Enable the property owner who is retiring an opportunity to live on or sell the existing farm
improvement.
B. Enable the property owner to sell off agricultural land that is nonproductive for one single
family dwelling homesite.
C. Enable the property owner to provide a residence for direct members of the farm family and
also for workers employed at the farm.
The Department of Planning Services staff has concerns that:
1. the intent of the Comprehensive Plan has not been met;
2. a reduction in prime agricultural farm ground;
3. and conflicts between urban and rural uses.
The Department of Planning Services staff request that the Board of County Commissioners
consider this request and determine if the standards of Section 11.5.1 through 11.5.7 of the Weld
County Subdivision Ordinance have been met.

This letter is to verify that we Richard and Dorothy Schild,
will sell parcels A and B of recorded exemption #1723 with
irrigation water, supplied by the North Poudre Irrigation
Company.
This will also entitle the new property owner of parcels A
and B to purchase, or rent additional irrigation water if their
irrigation needs increase in the future. Under the North Poudre
irrigation system, the water is separate from the land and is
purchased and sold independently.

THIS EASEMENT AGREEME,ft is made and entered into this *OT" day of

address te 41764 weld County Road 15, fort Collins, Colorado 80524, hereinafter
referred to as "the Grantors", and NORTH WELD COUNTY WATER DISTRICT, a Political
Subdivision of the State of Colorado ("North Weld"), the address of which le
33247 Highway 85, Lucerne, Colorado 80646, and EAST LARInER COUNTY WATER
DISTRICT, a Political Subdivision of the State of Colorado, the address of which
is 232 Link Lane, Post Office Box 2044, Fort Collins, Colorado 80522, hereinafter
jointly referred to as "the Grantees."
WITNESSETH:
For and In consideration of the transfer of six (6) North Weld 3/4' x 5/8"
water taps to the Grantors and other good and valuable consideration paid to the
Grantors by the Grantees, the receipt and adequacy of which is hereby confessed
and acknowledged, the Grantors do hereby grant, bargain, sell and convey to the
Grantees, their successors and assign., subject to all of the terms and
conditions hereinafter set forth, a perpetual easement for the construction,
installation, operation, maintenance, repair, replacement, alteration and change
of underground water lines, vaults and appurtenant facilities in, over, across
and upon the real property of the Grantors situate in the County of Weld, State
of Colorado, and located within the real property described on Exhibit "A"
attached hereto and incorporated herein by reference.
The parties acknowledge that said easement (hereinafter "the Easement") is
located on a parcel of property owned by the Grantors legally described on
Exhibit "B" attached hereto and incorporated herein by reference (hereinafter
"the Grantors' Property").
The Grantors do hereby covenant and agree to and with the Grantee. that the
Grantors are lawfully seized of the easement and the Grantors' Property and that
the Grantors have a good and lawful right to convey the Easement to the Grantees
and that the Grantors warrant the title thereto.
Further, it is hereby mutually covenanted and agreed by end between the
parties hereto as follows,
1. The Grantees shall and may, from time to time, exercise the right of
reasonable ingress and egress in, to, from, over, through end across the
Grantor.' Property, as necessary for the purpose of constructing, installing,
operating, maintaining, repairing, replacing, altering and changing said water
line and appurtenant facilities. The Grantees shall, at all time., utilize all
reasonable means to minimize any interference with the Grantors' use of the
Easement and shall, to the extent reasonably possible, use existing public or
private roads located upon the Grantors' Property for ingress and egress to the
Easement.
2. Following completion of the installation of the water line and
appurtenances upon the Easement, the Grantees shall restore any portion of the
Grantors' Property disturbed by the Grantees to substantially the same condition
existing at the time of the initial entry thereon, including repair of existing
fences disturbed or destroyed by the Grantees during construction activities
within the Easement. The Grantees shall pay the fair market value of any crops
of the Grantors, their tenants and 1 , which are damaged or destroyed as a
result of the future operation, maintenance, repair or replacement of the water
line and appurtenances.
3. The Grantors agree on behalf of themselves, their heirs, personal
representatives, administrators, successors and assigns, that they shall not
erect or place any permanent improvements of any nature upon the Easement without
the prior written consent of the Grantees, which consent shall be within the sole
discretion of the Grantees. The foregoing prohibition shall not prohibit the
Grantors from erecting fences upon the Easement for the containment of livestock.
4. Except as otherwise specified herein, the Grantors shall retain the
right to the undisturbed use and occupancy of the surface of the Easement
provided that the Grantors shall not obstruct or interfere with the rights of the
Grantees hereby created. The Grantees reserve the right to mark the location of
the Easement with markers set in the ground provided that any such markers
remaining after the period of Construction of the water line and appurtenance.

reasonable use of the Easement by the Grantors. The Grantors shall take no
action which would impair the earth cover over, or the lateral or subjacent
support for, said water lines and appurtenant facilities, except for normal
farming operations.

Rill Ditch or Lateral. All such taps may only be activated from existing water
lines of North Weld presently in place at the time of the execution of this
Easement Agreement and North Weld shall have no responsibility to install new
water lines or facilities to the interior of the above properties for the benefit
of the Grantors. In further clarification, the parties agree that all six (6)
water taps to be activated at the request of the Grantor. shall be installed on
the perimeter of the above properties from presently existing water distribution
facilities of North Weld. At the time of the activation of each tap, the
Grantors shall transfer to North Weld the equivalent of one (1) acre foot of
water rights which can be delivered to North Weld at the Soldier Canyon Filter
Plant located at 4424 LaPorte Avenue, Fort Collins, Colorado. For purposes of
this paragraph 5, one (1) share of The North Poudre Irrigation Company stock
shall be deemed equal to four (4) acre feet.
6. This Easement Agreement and all covenants hereunder shall be binding
upon the parties hereto, their transferees, successors, heirs, administrators and
assigns, and shall be deemed a covenant running with the land.
