RE: APPROVE THREE AGREEMENTS CONCERNING IMPROVEMENTS TO WELD
COUNTY ROAD 61 WITH PLATTE ENTERPRISES, INC., WESTERN SUGAR
COMPANY, AND BIJOU IRRIGATION DISTRICT AND AUTHORIZE CHAIR TO SIGN -
BRIDGE #61/54A
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with three Agreements Concerning
Improvements to Weld County Road 61 between the County of Weld, State of Colorado, by and
through the Board of County Commissioners of Weld County, on behalf of the Public Works
Department, and Platte Enterprises, Inc., Western Sugar Company, and Bijou Irrigation District,
with terms and conditions being as stated in said agreements, and
WHEREAS, after review, the Board deems it advisable to approve said agreements, copies
of which are attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the three Agreements Concerning Improvements to Weld County Road 61
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Public Works Department, and Platte Enterprises,
Inc., Western Sugar Company, and Bijou Irrigation District be, and hereby are, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to
sign said agreements.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 6th day of May, A.D., 1996.

AGREEMENT
CONCERNING IMPROVEMENTS TO COUNTY ROAD #61 BETWEEN BIJOU
IRRIGATION DISTRICT, A MUNICIPAL CORPORATION AND WELD COUNTY,
COLORADOILA

THIS AGREEMENT is made this / day of , 1996 by
and between Bijou Irrigation District, a Municipal orporation,
whose address is c/o Cathy Samples, 410 E. Railroad Ave . , Ft .
Morgan, Colorado 80701, hereinafter referred to as "Owners, " and
the County of Weld, a body corporate and politic of the State of
Colorado, by and through its Board of County Commissioners,
hereinafter referred to as "County. "
WITNESSETH:
WHEREAS, County finds it necessary to rebuild and improve the
bridge on County Road 61, which is Weld County Project No. 8125 , and
WHEREAS, Owners own the following described property:
(See attached Exhibit A) , and
WHEREAS, County needs additional right-of-way in order to
complete the said project, and
WHEREAS, Owners wish to cooperate with County in said road
improvement .
NOW, THEREFORE, the parties herein agree as follows :
1 . Owners agree to sell and County agrees to purchase the
right-of-way shown and/or described on Exhibit A,
attached hereto and hereinafter referred to herein as the
"Right-of-Way" for the sum of FIVE THOUSAND SEVEN HUNDRED
SEVENTY AND NO/HUNDREDTHS ($5, 770 . 00) DOLLARS .
2 . Owners agree to grant the Right-of-Way to County by Deed
of Dedication, in the form attached hereto as Exhibit B,
free and clear of all encumbrances .
3 . Owners agree to grant Temporary Construction Easements to
County in the form attached hereto as Exhibit C.
4 . County agrees to pay the costs of title insurance and
recording fees, if necessary as determined by County.
5 . The parties hereby agree that neither has made or
authorized any agreement with respect to the subject
matter of this instrument other than expressly set forth
herein, and no oral representation, promise, or
consideration different form the terms herein contained
shall be binding on either party, or its agents or
employees, hereto. This Agreement embodies all
agreements between the parties hereto and there are no

promises, terms, conditions, or obligations referring to
the subject matter whereof other than as contained
herein.
6 . Although the date of the transfer of the Right-of-Way
shall be the date of the delivery of the deed, it is
expressly agreed by the parties hereto that upon
execution of this Agreement by County and Owners, County,
its contractors, agents, employees, and all others deemed
necessary by County shall have the irrevocable right to
possess and use all of the Right-of-Way for the purpose
of construction, widening, and improvement of a portion
of said County Road 61 .
7 . Owner warrants that he/she is the owner of the Right-of-
Way and will defend title thereto against all claims .
8 . General taxes for the year 1996 for the Right-of-Way
shall be apportioned to the date of delivery of the deed
based on the most recent levy and the most recent
assessment . Owner represent and warrants that all
general taxes levied prior to such year have been paid in
full by owner.
IT IS MUTUALLY AGREED that the terms and conditions of this
Agreement shall extend to and be binding upon the heirs, executors,
administrators, successors, and assigns of the respective parties
hereto.
IN WITNESS WHEREOF, the parties have set their hands on the
day and year first above written.

TEMPORARY CONSTRUCTION EASEMENT
KNOW ALL MEN BY THESE PRESENTS: That BIJOU IRRIGATION
DISTRICT, a Municipal Corporation, Grantor, whose legal address is
c/o Cathy Samples, 410 E. Railroad Ave. , Fort Morgan, Colorado
80701, in consideration of TEN DOLLARS and 00/100' s ($10 . 00)
DOLLARS, in hand paid, and other good and valuable consideration,
does hereby grant, bargain, sell and convey to THE COUNTY OF WELD,
a body corporate and politic of the State of Colorado, by and
through it' s Board of County Commissioners, Grantee„ a Temporary
Easement for use during construction of road and bridge
improvements, together with all rights and privileges as are
necessary or incidental to the reasonable and proper use of such
easement in and to, over, under and across the tract of land
described as follows :
See attached Exhibit "A" , hereby made a part of this contract .
1 . Said Temporary Easement shall commence on April 15 1996
and shall expire and be of no further force or effect on April 15,
1997 .
2 . During the term of this Temporary Easement, Grantor shall
not erect or construct, or allow to be erected or constructed, any
building or other structure which may interfere with Grantee' s full
enjoyment of the rights hereunder.
3 . As a condition of the granting of this Temporary Easement
the Grantee covenants and agrees to restore said lands,
landscaping, fences, or other improvements to a level comparable to
their original condition and to pay Grantor the cost to reimburse
any loss to growing crops resulting from the construction
contemplated herein.
4 . The parties hereto agree that neither has made or auth-
orized any agreement with respect to the subject matter of this
instrument other than expressly set forth herein and no oral repre-
sentation, promise, or consideration different from the terms
therein contained shall be binding on either party, or its agents
or employees, hereto .

5 . Grantor warrants that it has full and lawful authority to
make the grant hereinabove contained, and promises and agrees to
defend Grantee in the exercise of its rights hereunder against any
defect in Owner' s rights to make the grant hereinabove contained.
6 . Whenever used herein, the singular number shall include
the plural, the plural the singular; and the use of any gender
shall be applicable to all genders . All of the covenants herein
contained shall be binding upon and inure to the benefit of the
parties hereto, their respective personal representatives,

Colorado, by and through its Board of County Commissioners,
hereinafter referred to as "County. "
WITNESSETH:
WHEREAS, County finds it necessary to rebuild and improve the

CONCERNING IMPROVEMENTS TO COUNTY ROAD #61 BETWEEN THE WESTERN
SUGAR COMPANY, A DELAWARE CORPORATION AND WELD COUNTY, COLORADO
THIS AGREEMENT is made this 26th day of April , 1996 by
and between The Western Sugar Company, a Delaware Corporation,
whose address is 1700 Broadway #1600 , Denver, Colorado 80290 ,
Attention Thomas F. Chandler, President, hereinafter referred to as
"Owners, " and the County of Weld, a body corporate and politic of
the State of Colorado, by and through its Board of County
Commissioners, hereinafter referred to as "County. "
WITNESSETH:
WHEREAS, County finds it necessary to rebuild and improve the
bridge on County Road 61, which is Weld County Project No . 8125, and
WHEREAS, Owners own the following described property:
(See attached Exhibit A) , and
WHEREAS, County needs additional right-of-way in order to
complete the said project, and
WHEREAS, Owners wish to cooperate with County in said road
improvement .
NOW, THEREFORE, the parties herein agree as follows :
1 . Owners agree to sell and County agrees to purchase the
right-of-way shown and/or described on Exhibit A,
attached hereto and hereinafter referred to herein as the
"Right-of-Way" for the sum of ONE THOUSAND AND
NO/HUNDREDTHS ($1, 000 . 00) DOLLARS .
2 . Owners agree to grant the Right-of-Way to County by Deed
of Dedication, in the form attached hereto as Exhibit B,
free and clear of all encumbrances .
3 . Owners agree to grant Temporary Construction Easements to
County in the form attached hereto as Exhibit C.
4 . County agrees to pay the costs of title insurance and
recording fees, if necessary as determined by County.
5 . The parties hereby agree that neither has made or
authorized any agreement with respect to the subject
matter of this instrument other than expressly set forth
herein, and no oral representation, promise, or
consideration different form the terms herein contained
shall be binding on either party, or its agents or
employees, hereto . This Agreement embodies all
agreements between the parties hereto and there are no

promises, terms, conditions, or obligations referring to
the subject matter whereof other than as contained
herein.
6 . Although the date of the transfer of the Right-of-Way
shall be the date of the delivery of the deed, it is
expressly agreed by the parties hereto that upon
execution of this Agreement by County and Owners, County,
its contractors, agents, employees, and all others deemed
necessary by County shall have the irrevocable right to
possess and use all of the Right-of-Way for the purpose
of construction, widening, and improvement of a portion
of said County Road 61 .
7 . Owner warrants that he/she is the owner of the Right-of-
Way and will defend title thereto against all claims .
8 . General taxes for the year 1996 for the Right-of-Way
shall be apportioned to the date of delivery of the deed
based on the most recent levy and the most recent
assessment . Owner represent and warrants that all
general taxes levied prior to such year have been paid in
full by owner.

Enclosed you will find one original agreement document for Platte
Enterprises, Inc . , Western Sugar Company and Bijou Irrigation
District . As you will note, all of these agreements have been
signed and acknowledged by the appropriate representatives from
each entity and are ready for acceptance and signatures from the
Board of County Commissioners of Weld County. In some cases, the
landowners have gone forward with executing the accompanying Deed
of Dedication and Temporary Construction Easement exhibits . Once
you have obtained the appropriate signatures on each of the
enclosed agreements, please prepare payment checks in the
appropriate amounts based on the owner' s tax I . D. numbers as
referenced on each agreement . Once I have received copies of
signed agreements and payment checks back from you, I will forward
same on to the respective owners in order to make payment and
obtain signed deeds, temporary construction easements, payment
agreement forms and completed W-9 forms .
