HomeMy WebLinkAbout971165.tiffRESOLUTION RE: APPROVE COORDINATION AGREEMENT BETWEEN THE DEPARTMENT OF HUMAN SERVICES, FENWC, AND THE MONTROSE COUNTY HOUSING AUTHORITY AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Coordination Agreement for the Migrant Head Start Program between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, Family Educational Network of Weld County (FENWC), and the Montrose County Housing Authority, commencing June 9, 1997, and ending October 31, 1997, with further terms and conditions being as stated in said agreement, and WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Coordination Agreement for the Migrant Head Start Program between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, Family Educational Network of Weld County, and the Montrose County Housing Authority be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said agreement. Kirkmeyer (AYE) r) A-/4n7r 5& 971165 HR0068 COORDINATION AGREEMENT BETWEEN MONTROSE COUNTY HOUSING AUTHORITY AND FAMILY EDUCATIONAL NETWORK OF WELD COUNTY THIS AGREEMENT, made and entered into thisa3'day of , 1997, by and between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Division of Human Services' Family Educational Network, hereinafter referred to as "FENWC," of Weld County and the Montrose County Housing Authority, hereinafter referred to as "Housing Authority." WITNESSETH WHEREAS, FENWC has been designated by the Federal Department of Health and Human Services to operate a Migrant Head Start Program ("the Migrant Head Start Program") under the provisions of Title V of the federal "Economic Opportunity Act of 1964," as amended, for the northwestern region of Colorado; and WHEREAS, FENWC requires office, classroom, and playground space in order to implement the Migrant Head Start Program; and WHEREAS, Housing Authority desires to provide land on which to place office, classroom and playground space for the Migrant Head Start Program. WHEREAS, Housing Authority and FENWC agree to enter into a twenty (20) year agreement for the purpose of: enhancing early childhood learning opportunities facilitating successful transition of preschool aged children into the public schools, promoting parental involvement in all levels of the elementary schools, promoting educational success of public schools FENWC students. NOW THEREFORE, in consideration of the covenants, conditions, agreements, and stipulations hereinafter expressed, the parties do hereby agree as follows: 1. Term: The term of the Agreement between FENWC and Housing Authority shall be for the period beginning June 9, 1997 and ending October 31, 2017. 971165 2. Geographic Areas To Be Served: Migrant Head Start Programs services shall be provided to children who are eligible in Delta and Montrose counties. Portable classrooms will be located on Housing Authority premises, Olathe, Colorado. 3. FENWC RESPONSIBILITIES: a. FENWC will provide portable classrooms for early childhood education services at the aforementioned site, at no cost to Housing Authority. The portable classrooms will remain on Housing Authority property for a term of twenty (20) years contingent upon funding sources. One hundred eighty (180) days after FENWC ceases to run programs, the building will be removed and the area restored to original condition. The portable classrooms will be attached to Housing Authority water and sewer taps, where available. The location of the portable classrooms to be determined by the Housing Authority. FENWC will provide sidewalks, ramps, and landscaping comparable to other Housing Authority facilities, costs of installation to be divided equally with the Housing Authority. b. FENWC will pay for utilities, to include: gas, electricity, sewage, and water from May through September for the period of usage. Housing Authority will pay for all costs when using the buildings from October through April. c. FENWC will install one (1) telephone line in each portable building and pay for costs incurred. d. FENWC will reimburse Housing Authority for custodial services and snow removal at a rate of one dollar and fifty cents ($1.50) per square foot per year to include labor, equipment, materials, and supervision. Rates will be adjusted annually. e. FENWC will reimburse Housing Authority for building maintenance services at cost for labor, time, and materials. £ FENWC will implement the Migrant Head Start Program to be located on Housing Authority premises. 971165 g. FENWC will provide adequate insurance for the purposes of program operation, to include: child liability, property liability, and casualty liability insurance. h. FENWC will maintain an adequate child/staff ratio to ensure needed individualized language stimulation. There will be a maximum of 15 children per preschool classroom, with one teacher and one teacher aide. There will be a maximum of 10 children per infant or toddler classroom, with one teacher and two teacher aides. I. FENWC will coordinate efforts among public school staff, FENWC staff, and parents to maximize the opportunities for a successful transition of students and parents into the public school system. FENWC will provide support services such as transportation and child care to parents in order for them to attend training sessions and be actively involved in the Migrant Head Start Program and early childhood education programs. k. FENWC will provide ongoing training for FENWC staff and parents. 1. FENWC will provide adequate materials for staff and parents to enable them to implement teaching activities i.classroom and in the home. INaft m. Supervision of the FENWC staff at the Housing Authority site is the ultimate responsibility of FENWC. n. The FENWC teacher and teacher assistant will provide adequate coverage for the classroom. 4. HOUSING AUTHORITY RESPONSIBILITIES: a. Housing Authority will provide custodial and snow removal services for FENWC, see item 3-d for reimbursement rate. b. Housing Authority will provide maintenance services on a work order/loaded rate basis, see item 3-e. 971165 c. Housing Authority will bill FENWC by the 10th of the month for previous month's charges. Housing Authority permits FENWC to house early childhood programs located at 290 Hap Court, Olathe, Colorado, 81425. 5. Modification of Agreement: All modifications to this Agreement shall be in writing and signed by both parties. 6. Assignment: This Agreement shall be binding upon the parties hereto, their successors, heirs, legal representatives, and assigns. Neither party may assign any of its rights/obligations hereunder without the prior written consent of the other party. 7. Resolution of Disagreements: If a problem/disagreement should occur, the FENWC Director and/or Site Manager should be notified immediately. If the problem/disagreement still can not be resolved, it will be taken to a higher authority in both agencies. 8. Applicable Law: FENWC agrees to follow policies and procedures of applicable Housing Authority as construed in accordance with the Colorado School Finance Act of 1988, regulations and other applicable laws and regulations. (See Attachment I) 9. Termination: This Agreement may be terminated at any time by either party giving thirty (30) days written notice and is subject to the availability of funding. 971165 10. Entire Agreement: This Agreement constitutes the entire understanding between the parties with respect to the subject matter hereof, and may not be changed or modified. 11. Waiver or Immunities/Third-Party Liability: No portion of this Agreement shall be deemed to constitute a waiver of any immunities the parties or their officers or employees may possess, nor shall any position of this Agreement be deemed to have created a duty of care with respect to any persons not a party to this Agreement. 12. Non -appropriation: No portion of this Agreement shall be deemed to create an obligation on the part of Housing Authority, the County of Weld, State of Colorado, to expend funds not otherwise appropriated in each succeeding year. 13. Severability: If any section, subsection, paragraph, sentence, clause or phrase of the Agreement is for any reason held or decided to be unconstitutional, such decision shall not affect the validity of the remaining portions. The parties hereto declare that they would have entered into this agreement and each and every section, subsection, paragraph, sentence, clause, and phrase thereof irrespective of the fact that any one or more sections, subsections, paragraphs, sentences, clauses, or phrases might be declared unconstitutional or invalid. 14. Assurances: a. The Housing Authority agrees that it is an independent contractor and that its officers, employees, and clients do not become employees of Weld County, and therefore are not entitled to any employee benefits as Weld County employees, as a result of the execution of this Agreement. b. FENWC, the Weld County Board of Commissioners, its officers and employees, shall not be held liable for injuries or damages caused by any negligent acts or omissions of the Housing Authority, or its employees, while performing this Agreement. The Housing Authority, its officers and employees, shall not be held liable for injuries or damages caused by any negligent acts or omissions of FENWC, or its employees, while performing functions as described in this Agreement. 971165 By: Deputy Cle ATTESTING TO BOARD OF COUNTY COMMISSIONER SIGNATURES ONLY 971165 The Housing Authority shall provide adequate liability and worker's compensation insurance for all of its employees, engaged in the performance of this Agreement, as required by the Colorado Worker's Compensation Act. Likewise, FENWC, by and through the Board of Weld County Commissioners, shall provide adequate Liability and Workers' Compensation Insurance for all employees of FENWC engaged in the performance of this Agreement. c. No officer, member, or employee of Housing Authority and no member or their governing bodies shall have any pecuniary interest, direct or indirect, in the approved Agreement or the proceeds thereof. d. Housing Authority understands that monitoring and evaluation of the performance of this Agreement shall be conducted by the Weld County Division of Human Services and the results provided to the Weld County Board of Commissioners. e. Housing Authority and FENWC assure compliance with Title VI of the Civil Rights Act of 1986, and that no person shall, on the grounds of race, creed, color, sex, handicap, or national origin be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under the approved Agreement. Speckman, Executive Director, Human Services Coordination Agreement between FENWC and Montrose Housing Authority Enclosed for Board approval is the Coordination Agreement between the Family Educational Network of Weld County's Migrant Head Start Program and the Montrose County Housing Authority in Olathe, Colorado. The Agreement is to provide FENWC with land on which to place a modular unit on Housing Authority property to house office, classroom, and playground space for migrant children enrolled in the FENWC Migrant Head Start Program. FENWC currently has one modular unit located on the premises. The term of this Agreement is from June 9, 1997 through October 31, 2017.
