Pursuant to my letter of June 22, 1990, this letter
is to inform you of this Department's continued
efforts to remedy the failing individual sewage
disposal system at Grand Mesa Eggs.
A meeting was held at our office on July 3, 1990
with the following people in attendance:

Dan Hudgens, General Manager, Grand Mesa Eggs Inc.
Bill Hamann, P.E., Westwater Engineering
Darleen L. McKissen & Phil Romeo, Sanitarians, Mesa
County Health Department
The purpose of the meeting was to determine if the
Mesa County Health Department can legally be
involved in the design and review of the R.P.E.
system currently proposed for the facility.
Section 3.6 of the Mesa County Individual Sewage
Disposal Systems Regulations states:
"State Approval Required: Site approval
from the Colorado Department of Health,
Water Quality Control Division shall be
required for a system with design capacity
greater than 2,000 gallons per day."
Meter readings from Ute Water Conservancy District
reflect monthly water usage that range from 686,600
gallons in December 1989 to 1,419,600 gallons in
June 1989. These figures indicate the facilty has
an average use that ranges from 22,148 gallons per
day to 47,320 gallons per day. Their most current
reading for April 1990 indicated an average daily
use of 26,513 gallons per day, which is well in
excess of the 2,000 gallon per day limitation.

After lengthly discussion, the following was
determined:
1. Grand Mesa Eggs will install a permanent meter
on the water line that serves the office and egg
washing portion of the facility. The installation
is to be completed in ten (10) days.
2. Daily readings from the meter will be recorded
for a 30 day period.
3. The Engineer will sample the existing septic
tanks to determine: (a) Biochemical Oxygen Demand
(BOD); (b) Total Suspended Solids (TSS); and (c) pH
readings. The Engineer will reflect in his reports
the time(s) when enzymes are being added to the
system, provide a week to 10 day "settling" interval
without the addition of enzymes, and a final testing
period reflecting readings without the use of
enzymes.
4. The Engineer will provide a diagram on water
flow at the facility.
It is the intent of this Department to obtain
accurate figures that ultimately affect the proper
operation of the individual sewage disposal system.
Should it be determined that the facility requires a
system with a design capacity greater than 2,000
gallons per day, then we will deny any permits and
refer the facility to the Colorado Department of
Health, Water Quality Control Division. The purpose
of the testing is to arrive at a solution that will allow em the handling
the facility.
Another meeting will be held at our office on August
15, 1990 at 1:30 P.M. with the same parties present.
At that time, information from the 30 day monitoring
process will be presented. I will inform you of the
results of that meeting.

Commissioners. Also, feel free to contact me if you

Dear Ms. McKissen:
In response to your letter of May 9, 1990, concerning our
septic system, it is probabl-y necessary to go back and review,
to inform you of our on going effort to resolve this problem.
In the early part of December 1989 we completed the expansion
of the septic system, that was then approved by the Mesa
County Health Department. With the addition, the system
worked just fine throughout the winter months. A short
while after the ground completely thawed this spring the
water started surfacing again. At this time we had our
plumber open the field up and inspected all of the lines.
The inspection reviled that all of the lines were open and
operable. Because of the water still surfacing we pumped
all three holding tanks empty for three straight days.
During this process a crack was found in one of the tanks
and it was repaired. We contacted the engineering firm
that designed the expansion for advise, he advised additional
enzymes and reducing the volume of water discharge into
the system. We started the enzyme treatment immediately.
About one week following these procedures the water started
to surface again (approximately April 7th 1990). So we
dug two large pits to contain the surfacing water, so as
not to allow it to run into the ditch and on to the drainage
ditch. At this point we contacted Calgon Vestal Laboratories
to ask for their assistance in the matter as we are buying
egg wash soap from them. They have ran numerous test on
the sewage and sent us enzymes from the laboratories in
an attempt help restore the leeching ability of the field.
They also recommended that we nuetralize the acid rinse
water before allowing it to go into the system. We immediately
implemented this procedure. Since the water was continuing
to surface we have also consulted a waste water expert from
Arkansas who has delt with similar septic systems to ours.
He has sent us enzymes and a water treatment to use on the
leech field and we are currently on his suggested program.
Thursday May 31st we contacted another waste water engineer
to assist us here locally. Monday June 4th we dug several
test holes around the leech field to determine how much

water is in the ground around the field. There was quit
a bit of water in the soil. We also dug test holes looking
for more good soil in another area for possibly expansion.
We fell that we may have located a good area to locate another
field. At this time I am awaiting a call from the engineer
to advise me on our situation. I wanted to let you know
that we are working to resolve this as quickly and effectively
as possible. However we do need a little more time.

NOTICE OF VIOLATION
Dear Mr. Hudgens:
Due to a complaint received by this office, an
inspection was made of the Grand Mesa Eggs property
located at 1133 21 Road, Fruita, Colorado, on April
25, 199O. During that inspection it was noted that
sewage was being discharged onto the surface of the
ground from the on -site individual sewage disposal
system. According to office records, the discharge
is in the area of the system designed to handle the
waste from the egg washing portion of the facility.
Subsequent inspections have been conducted on April
30, 199O and May 7, 1990 which reveal that the
sewage continues to discharge onto the surface of
the ground.
This condition is in violation of Section 3.1 of the
Mesa County Individual Sewage Disoosal Systems
Regulations and must be corrected.
Section 3.1 of the Mesa County Individual Sewage
Disposal Systems Regulations states:
"General Sanitation Requirements: The owner of any
structure where people live, work, or congregate
shall insure that the structure contains adequate,
convenient, sanitary facilities and a sewage
disposal system in good working order Under no
condition shall sewage or effluent be permitted to
be discharged upon the surface of the around or into
waters of the state, unless the sewage or effluent
meets the minimum requirements of these Regulations
or the water quality standards of the Colorado Water
Quality Control Commission, whichever are
applicable."
Repairs must be made to the existing individual
sewage disposal system to insure that no sewage is
discharged as noted above and that the system will
work properly in accordance with the Regulations.

individual sewage disposal system, an application
for a permit must be obtained from this office,
completed and returned for review, before a permit
can be issued for the repair. The repair must be
designed by a Registered Professional Engineer.
Section 3.3 A. of the Regulations states:
"Prior to commencing construction, any person who
wishes to install, alter, or repair an individual
sewage disposal system shall obtain a permit from
the Department and shall furnish the following
information on forms provided by the Department."
An Application form has been enclosed for your
convenience.
Section 3.5 of the Regulations states:
"Final Design: No permits shall be issued for the
following systems unless they are designed by a
Registered Professional Engineer and after they have
been reviewed by the Health Officer:...C. Systems
which service commercial, business, institutions,
industry, or multifamily dwellings."
A reinspection will be conducted June 18. 1990 to
determine that compliance has been met. Failure to
correct by that date may result in a Cease and
Desist Order being issued regarding the use of the
individual sewage disposal system.

Inspections were made of the property noted above on April 25 and
April 30, 1990 to determine compliance with the Mesa County
Individual Sewage Disposal Systems Regulations and Section 25-1-
612, Dead Animals, C.R.S., 1973.
On April 25, it was noted that what appeared to be sewage
effluent was standing on the surface of the ground above the
system's leaching area. There was no evidence that effluent was
entering any waters of the State, i.e. surface waters. This
condition, however, is in violation of the Regulations.
The dead chicken and broken egg disposal site revealed that,
except for two or three chicken carcasses, all remains were
properly buried.
The inspection made on April 30 revealed that the condition of
the leaching was the same as noted on April 25. The dead chicken
and broken egg disposal site revealed recent improper burial,
however, with many exposed carcasses.
Darleen McKissen, the area Sanitarian, and I met with Ernie
Greenwood, the corporation's representative who will be working
at this location for about a month, on April 30. He requested a
week to ten days to try to solve the problems at both sites.
Darleen will make inspections approximately every three days to
determine if compliance has been met. Notices of Violation will
be sent to the company at the end of the week or ten days if
there has been no correction. Darleen will continue to monitor
the property and will work through the correction procedure
regarding the failing sewage disposal system (plan review, permit
issuance, inspections).
If the sewage disposal system begins to drain into the
irrigation or drainage systems or other surface waters, the State
Health Department's Water Quality Control Division will be contacted.
At this time there are no regulations enforceable by this
Department regarding odors.

Dear Mr. Cunningham:
I have received your April 13, 1987 letter and entered
it into our files. I visited the site as well on April 14,
at the request of Travis Jordan. When the system has been
fully completed please submit certification as required in
Section 3.7 of Mesa County Individual Sewage Disposal Systems
Regulations which states:
"If the system has been designed by or constructed
under the supervision of a Registered Professional
Engineer, he shall at this time certify to the
Department that construction and installation of the
system have been completed in accordance with the
terms of the permit and these Regulations. If the
inspection discloses any significant departure
from the description or design of the system as stated
in the application and permit, or if any aspect of the
system fails to comply with the Regulations, approval
shall be withheld, and the original permit shall be
deemed to have expired. Written notice of deficiencies
causing the disapproval shall be given the permittee.
The permit then may be reviewed upon payment of the
required fee. Another inspection shall be made upon
notification that the deficiencies have been corrected
and the system brought into compliance with these
Regulations."

RE: Changes to Meter and Aerator Systems at Wastewater
Lagoon
Dear Dan,
The purpose of this letter is to outline some
recommended changes for the flow metering system and the
aerator system for the wastewater lagoon being constructed at
Grand Mesa Eggs:
A. Flow Meter Systems. There is a good possibility
that the 1 1/2 inch turbine meters that we specified
could have some clogging problems, since they are
designed primarily for clean water. Unfortunately,
there are no inexpensive meters for wastewater.
After reviewing various options, I am recommending a
metering system which is less expensive, but will be
just as effective and will have no problems with
clogging. For this system, we would eliminate the
two meters and two meter boxes entirely. In lieu of
this, we would install an hour meter on each pump.
This records the number of hours that the pump
operates. We will then install a side discharge
pipe for each pump to allow measurement of the flow
into a 5 gallon bucket. This will allow you to
calculate the pump rate; it should stay nearly
constant during its entire pumping cycle. Thus, in
order to calculate the flow, you will merely have to
multiply the number of hours that the pump is run
times the gallons per hour pumping rate. The side
discharge pipes would extend far enough above ground
so you could place a 5 gallon bucket underneath it.
B. Aeration System. For the aeration system, we have
obtained bids from two different companies, Aeration
Industries and Aeromix, both located in Minnesota.
Enclosed is a copy of the bids. The original design
called for two 2 HP aerators; this is the horsepower
needed to provide oxygen for future demand, which
was based on a discharge of 3,000 gallons per day.
For the present flow of 2,000 gpd, a single 3 HP
aerator would be adequate to provide oxygen

according to our calculations. Therefore, we
obtained bids for both the 2 HP and the 3 HP. The
low bidder was Aeration Industries; their single 3
HP aerator unit is 53079, and the two 2 HP units are
$5138, for a savings of over 52000. In addition,
there will be a cost savings on the electrical
control systems, since you will only need one
control box. If it is unlikely that you will be
reaching your maximum discharge of 3,000 gpd within
the next 5 years, we would recommend that you
purchase the 3 HP unit. You had initially given us
a copy of the Aeration Industries catalog; since we
have an extra copy, we are returning that. This
provides additional information on this type of
aerator.
We are also sending a copy of this letter to the Health
Department so they are aware of these changes. If you need

from the chlorination rinse that they use to do a final rinse on the eggs.
He said they are using right at 1,000 gallons a day in that process. He said
he is conducting investigative work, trying to find a smaller nozzel to help
restrict flow during that chlorination rinse process.
He will come into the office tomorrow or Monday to submit his application to
begin the surge pump repair Process.

10/29/90 - Call from Dan Hudgens, Grand Mesa Eggs. He was checking on the
status of the surge tank work. I informed him that I had spoke with Bill Hamann
and had also generated a letter addressing Department concerns, at Bill's
request. Mr. Hudgens will contact Mr. Hamann to check status. Mr. Hudgens
stated that they have experienced water surfacing at the leach field area for
the past two weeks. He has been monitoring the runoff to contain it. He said
they have discontinued using the "Actane" and said he may order more. He will
discuss using the additive with Mr. Hamann.
11-7/90 - Reviewed letter from Mr. Hamann. Changes and concerns on the original
submittal have been adequately addressed.
11-19-90 - Inspected site. System is failing again. Effluent surfacing at west
end of bed and running south westerly a considerable distance, parallel to an
empty irrigation ditch. Some files noted. Damp areas noted in center of bed
and on north central side of bed, in the areas of the two monitoring pipes.
Disposal site not observed. A fence has been placed across the access road and
sheep are present in that field. Dan Hudgens no in the office.

Dan Hudgens to call (858-7556). He is out of town in Wyoming or Utah.
11-20-90 - Spoke with Dan Hudgens and he states system failure is worse. He feels

11-20-90 — Stopped at site and talked with Mr. Hudgens. Inspected the disposal
site. It is basically in the same area, access is from the north of the building.
The site has been moved east, nearer the corn fields. Area was properly covered
however, moisture on the side walls is present. A picture was taken. He did state
that access during the wet periods would present a problem as the road is slick.
A truck slipped and almost went into the drainage ditch. Evidence of feathers where
the spill occurred. Carcasses were picked up and moved to the disposal site. They
plan to build up the bank in that area. The septic system area was also inspected.
Pictures were taken showing the trenching that has occurred on the top of the
bed from the runoff: the green coloration from algae growth; the expansive area
with runoff from the system. A total of 4 pictures were taken today.
MR. Hudgens stated: 1) They are using way over 2800 gallons a day at present;
2) He checked daily averages last week to arrive at that figure; 3) He expects
a decrease in water usage, and then an increase again as the holidays approach;
4) They have not had an increase in the number of employees, however, they are
working longer hours, therefore there is an increase in water usage from that
aspect also. He further stated that he is using a weekly treatment of Actine.
He has been in contact with Bill Hamann and he is aware of the problems. Stated
that Mr. Hamann feels the surge pump may be the answer to the problem. Will obtain
the necessary permit very soon, in order to begin the repair work.
11-20-90 - I contacted Berda at Ute Water. She has provided a printout of water
usage for Grand Mesa Eggs.

A. INTRODUCTION
In a memo dated July 5, 1'99), the Mesa County Health
Department directed Grand Mesa Eggs, Inc. and its consultant,
WestWater Engineering, to conduct a study to determine the
cause of the leach field failure at the Grand Mesa Eggs
processing facility. Specific items to be studied were:
1. Water flows to the office and egg washing areas. A
separate meter was to be installed for this purpose.
2. Water quality testing of BOD, TSS and pH. In
addition, a record of enzyme additions to the septic
tank was to be maintained.
A diagram on water flaw distribution was to be
provided.
This report presents the preliminary results of that
study, along with the engineer's evaluation of probable
causes of the problem. It also includes some preliminary
recommendations for upgrading the facility.
B. WASTEWATER FLOWS
Water Distribution and Uses. Grand Mesa Eggs obtains
its potable water supplies from the Ute Water distribution
system. Ute Water has installed a master meter in the
service line leading into Grand Mesa Eggs. After entering
the facility, the service line divides with flow going to the
following two main areas (Figure Al):
1 ) The Chicken House - This water is used as drinking
water for the c=hickens. There is no waste water
discharge from the chicken house.
2' The Proc=essing Plant and Offices - This water is used
` for washing the eggs, and also supplies water for
domestic and irrigation uses. A second meter was
installed on the pipeline which provides water to
this area.
Water use records were obtained by the Mesa County
Health Department from Ute Water for the 12 month period from
May 1989 through April 1990. This data is shown in Table 1.
Average water usage during this period was 30,34E qpd. There
are approximately 480,000 chickens at the plant at present,
and the estimated water usage in the chicken house is 5 1/2
gallons per 100 birds. This rate of water usage would
require 26,400 gallons per day. The chicken house is also
washed down twice a week, which uses a small amount of water.
This water is washed down into drains and then into the
manure piles.
As discussed, the remainder of the water goes to the
processing and office areas. Meter readings from the period
from July 11 through August 9, 1990 are shown in Table
2.
Water meter readings were taken from the meter once a day at
approximately mid -morning. Flows ranged from a high of 3980
qpd to 2230 qpd. Average weekly flows during the first two
weeks were approximately 3200 qpd. Grand Mesa Eggs then
initiated a series of steps to reduce water flow, such as
correcting leaks in the toilets and reducing some of the wash
down water. The average flow during the latter three weeks
was about 2800 qpd.
There are five identifiable water uses cuff the flow line
in which the meter is installed, as follows:
1. The egg processing area, which includes an egg
washing machine and wash down water.
The office area, which includes toilets and
lavatories.
Evaporative coolers in the chicken house.

4. A humidifier in the cooling room.
5. A lawn area.
The latter three items use water which does not
discharge to the waste water system. Following is an
estimate of the water used by these facilities:
1. Evaporative Cooler - There are three evaporative
coolers with a total output of 19,300 cfm. The
manufacturer estimated 1.3 gallons per 1000 cfm, for
a total water usage of 25.1 gallons per hour or 602
gallons per day.

2. Humidifier --- The humidifier is used to increase
humidity up to 75% in the 60x90 ft. cooler. Its
estimated water usage is 8 to 12 gallons per hour or
about 5:40 gallons per day average.
Lawn Area - The lawn i s O ft. -x 1 1 0 ft. We have
estimated water usage on a lawn in the Grand Valley
area at about .35 inches per day in July, and at
about .30 inches per day in August. In July, a 4400
sq . f t . lawn would use 962 gallons per day.

The above three uses total 1804 qpd. Subtracting this
amount from the 2800 qpd flowing through the meter leaves
approximately 1000 qpd going to the leach field. This seems
1 ow.
Meter readings made during a one week period in February
1989 recorded 1800 qpd. This is probably a more realistic=
estimate of the amount of wastewater going to the leach
field.
In order to verify actual wastewater flews, a 60 degree
V --notch weir was set up in the outfall l pipe. It was
necessary to cut into the existing 4 inch pipe and rig up the
temporary weir. A Model 3000A Manning Dipper was set up to
record 24 hour flaws, starting on Friday, August 10, 1990.
There are certain problems which make accurate flow
measurement of the waste water difficult. First, the flows
are highly variable, since the waste water from the egg
washing machine is dumped in a very short time, resulting in
very high peaks, which can flood out the weir. At other
times, flows are very low. A 60 degree weir was needed to
measure the wide range of flaws; however, this compromises
accuracy. A 1/8 inch error in setting up the meter or
measuring the depth of flow over the V -notch can result in a
discrepancy of 800 gallons per day in a 60 degree V -notch
weir. A smaller weir, such as a 22 1/2 degree V -notch weir,
might be desirable for more accurate measurements; however,
it would not be able to absorb the peak discharges,
particularly since it is sitting in a 6 inch pipe and there
is limited head.
The flow chart data collected to date is not
sufficiently accurate to determine exact daily flow. The
chart from the period of August 10 to 14 is shown in Figure
1. The chart illustrates the substantial flow variation
throughout the day.
The major conclusion that can be drawn at this time is
that the waste water flows probably average slightly below
2000 qpd, This is based on the February 1989 measurements,
which are the most accurate data available at this time. One

method to verify flows may be to install a separate meter in
the water lines going to the processing facility and the
laboratory facilities.
C. LJASTE:-DATER DUALITY
Data Collection. The two main sources of wastewater at
Grand Mesa Eggs are the lavatory and toilet facilities and
the egg processing facility. Each has a separate discharge
line with its own septic tank. The septic tanks are standard
concrete 1250 gallon units. The discharge line from the egg
washing plant has a second septic= tank (upstream of the
initial septic tank), which is used as an eggshell collection
tank. The discharge lines from the domestic waste side and
from the egg processing side combine downstream of the last
septic tank.
Wastewater samples were collected at the inlet cif the
first septic tanks on each discharge line from the building.
A third sample was collected downstream of the eggshell
collection tank. The fourth sample was c=ollected at the
distribution box just above the leach field.
It was intended that the samples would be 24 -hour
composites. A sample was toll-ected at early morning, at
noon, and late afternoon, and it was intended that the
samples would be mixed prier to testing. However, the
laboratory tested each sample individually. Thus, there
three days worth of sample collection data and three sets
test data for each day.

The samples were tested for -DOD, suspended solids and pH
by Neil Tripp.
Test Results. Results of the water quality analysis are
shown in Table 2. As can be seen, the DOD and suspended
solids tests show very high concentrations compared to
normal domestic wastewater. The BOD entering the leach
field averaged between 3000 and 4000 mg/1, and suspended
solids averaged between 1::00 and 1500 mg/1. Normal
domestic waste has a BOD and suspended solids strength
of between 200 and 300 mg/l. The pH from the egg
washing machine is also quite high compared to domestic
waste ( 9 compared to 7) .
The BOD in the discharge from the eggshell collection
tank is higher than the inlet. In addition, the sample
collected at the distribution box above the leach field
shows almost no reduction in BOD and suspended solids
through the septic tank (this is based upon the average
of all samples collected, since some samples show a
significant reduction and some show a significant
increase).

The FOOD and suspended solids from the domestic waste is
much lower than normal residential domestic waste
sample. This is probably due to sampling error, since
it is very difficult to get a representative sample
because of the very erratic usage of the facilities.
Discussion of Results. The wastewater from the egg wash
machine is the major contributor to the high BOD and
suspended solids readings and ph readings. The egg wash
machine uses a high -strength soap obtained from Calgon.
I:algorl-Vestal Laboratories in St. Louis provided data
sheets on the chemical composition of the soap; this
information is shown in the Appendix. According to the
data sheets, the soap is an alkaline cleaner, with its
two main c=hemic=als being sodium metasilicate and sodium
hydroxide. Soap is added in powder form; 16 cups (equal
to 26-27 standard measuring cups) are added per
approximately 300 gallons. The temperature range of the
soap discharged from the unit is about 100 degrees
Fahrenheit. The manufacturer's recommended
concentration of soap is 1/6 to 2 ounces per gallon.
No information was available from the manufacturer on
the BOD of the soap. A sample was collec=ted from the
egg washing machine and sent to Neil Tripp for analysis.
Results of that test showed 1610 mg/1 BOD for the clean
soap.
It is passible that some of the BOD is due ti: the
material washed off the eggs; however, visual
observation indicates that this is probably a very small
contributor, since the eggs are relatively clean coming
into the machine.
The high pH is obviously due to the soap; however, this
appears to be well neutralized in the septic tank.
Treatment Efficiency. The wastewater is receiving very
poor treatment in the septic tank. This could be due to
several factors, as follows:
1. The soap itself may be poorly biodegradable in the
concentrations present in the wastewater. According
to the manufacturer the soap is biodegradable;
however, this may only occur after it is diluted
with ether wastewater, such as occurs in a sewage
treatment plant. Since the soap represents the
majority of wastewater into the septic tanks, it may
be too highly concentrated for bacteria
(particularly anaerobic bacteria) to provide
treatment. It should be noted that the BOD test
shows a very high BOD, and this could only occur
when bacteria can degrade the wastewater; however,
the material is greatly diluted in the BOD test
bottle, which may allow the bacteria opportunity to
function.
Another cause for the poor treatment is passible
stirring and disturbance in the septic tank:. The
egg washing machine is dumped in a few seconds,
releasing about 28') gallons at a dump. Although the
septic tank does have baffles, the rate of inflow
may be sufficient to stir up the tank. Also,
because of the nature of the wastewater <and the
short de.tneti'_'n time), there may be very little
settling c.ccuring in the septic tank. This is one
of the main treatment processes by which settling
tanks work. The anaerobic processes in the septic
tanks operate at a very slow rate and it is
necessary for the wastes to settle out of liquid
stream into the bottom of the tank: where the
bacteria will have adequate time to work on them.
D. EVALUATION OF LEACH FIELD CLOGGING.
General. The basis for clogging of the leach field
appears to be related :more to the water quality rather than
excessive volume or poorly percolating sail. The high -
strength, high pH wastewater from Grand Mesa Eggs may result
in complex physical, chemical, and biological reactions with
the adjoining soil. •Several references were researched to
determine if the limited test data available could provide
some insight into the cause of the clogging. It should be
noted that our literature review is somewhat c=ursory at this
time, and is intended to provide more of a general, overall
review of the problem and provide some direction for future
analysis.
The literature review indicates that there are two
probable causes for failure of the leach field: 1) Clogging
of the soil due to biological reactions and accumulation of
organic matter, and 2) excessive sodium in the wastewater
discharge.
Biological Clogging. Biological agents and their
activities are the most important cause of clogging in
soils (McGauhey and Krone, 1967). The rate of clogging
greatly increases if the area around the leach field
becomes anaerobic. This would occur when water would
start to pond in the area and rises above the level of
the soil and water interface. There is very little
information available regarding the effects of high -
strength wastewaters on leach fields. Winneberger
provided the following equation to adjust the area of
leach fields to account for higher strength wastewater:
Adjusted area required = Area required for standard
septic tank pretreatment x (BOD + TSS 2 0) 1/3.

Applying this formula to the situation at Grand Mess
Eggs would result in an increase in the leach field size
to account for the higher strength sewage of 268%.
It should be noted that the standard USPHS curves and
formulas were developed using domestic systems with
standard —strength wastewater. The procedure was to
evaluate exiting systems; percolation test rates were
compared with the actual loading on a field. The
initial study included a number of systems that had
failed s... correlations =could be made between overloading
and percolation rates. Thus, it can be inferred that
the standard PHS tables and equations may not apply to
the high -strength sewage.
Chemical Changes in the Soil. McGauhey and Krone (1967)
indicated that high concentrations of sodium decrease
the permeability of the soil. The Public- Health Service
conducted studies on the effect of water softener uses
in septic tank systems. Water softeners contain a high
percentage of sodium. They found that a continuous
discharge of sodium did not affect the permeability of
soil; however, when the high sodium water was followed
by water with considerably lower salt concentration, the
soil would disperse immediately and become sticky and
relatively impermeable.
As mentioned, the soap used at Grand Mesa Eggs has a
sodium base. The exact concentration is not known;
however, further testing -would be desirable to determine
the sodium -ion concentration.
E. RECOMMENDATIONS
Further testing of water flows and chemical and
biological quality is recommended in order to verify the
exact causes of the leach field failure at Grand Mesa Eggs;
however, there is sufficient information to give some
preliminary indication on probable causes of the problem.
The following section outlines some possible solutions
which should be evaluated in detail following input from the
Mesa County Health Department and collection of additional
data. The solutions to the problem fall into three
categories: 1) changes in the in—house process to change the
characteristics of the wastewater, 2) modifications in the
septic tank leach field system, and 3) installation of a
different type of treatment car disposal system.
In -House Changes. The most obvious change that could be
made in-house would be to change the type of soap used
in the wash dawn process. Obviously the soap would have
to be one that does not have a sodium base to prevent
the ,_:hemi'::al reactions that may be taking place.
Secondly, the soap should have a much lower BOD and
suspended solids •_r)ncentration when mixed with water.
Another possibility might be to greatly reduce the
-amount of soap used and dilute the wastewater with clear
water. The soil might be able to handle a lower BOD
solution.
Improvements to the Septic Tank/Leach Field System. For
the septic tank system, it may be desirable to increase
the detention time by installing a larger tank.
Additional baffles may be desirable to prevent surges
and perhaps enhanc=e settling. It may also be necessary
to, install a flow equalizing tank to prevent the surges
into the existing septic tanks. The addition of a
polymer or other settling chemical may be helpful to
enhance settling in the septic tank systems.
A second leach field might be helpful in that the leach
fields could be alternated. This would help to prevent
anaerobic c=onditions from developing; however, this may
not salve the problem and may just prolong the life of
the field.
Alternate Treatment or Disposal Systems. There are two
possible concepts for a treatment system: 1) an aerated
process, such as an activated sludge unit, aerated basin
or an aerated lagoon, or 2) an evaporation pond. If an
aerated (aerobic) system is used, its purpose would be
to reduce the BOD and suspended solids to a level
whereby the discharge could be disposed of in a leach
field without clogging the soil. Obviously the sodium
problem would also have to be resolved before this
should be installed. The evaporation pond would be a
fairly simple concept; however, it would have to be
adequately sized to provide evaporation through the
winter months, and some aeration may be desirable in
order to prevent odor problems. Off -site discharge of
the wastewater does not appear tco -be feasible at this
time due to the distance from existing sewer lines or
receiving waters.

After receiving your letter, dated May 9 1990, concerning disposal
practices of dead chickens, I have taken several steps to improve
upon and hopefully correct the problem. I have met with each
individual that has a part in the disposal process, to inform
each of them of the proper procedures and the importance of properly
performing these procedures each and every day. Since that time
I have made a routine inspections and have not observed any instances
of failure to properly dispose of and cover the dead chickens.
Thank you for bringing this matter to my attention, as we, at
Grand Mesa Eggs; are wanting to and trying to be good neighbors

COMPLAINT: The encroachment of odors and flies from Grand Mesa Egg Inc
Dear Dr. Aduddell:
On April 12, 1993 I purchased a home located at 1080 - 20 Road. On or about the third
week in April, 1993, my wife and I started noticing a very pungent odor in the air at
varying times during the day and evening. In addition, we had extreme fly infestation
problems in the area.
I started asking questions of neighbors, Mesa County Health Department, and the Mesa
County Planning and Zoning Department and have come to the conclusion that Grand
Mesa Egg, Inc. is responsible for both of these issues. I have come to Grand Junction
after seventeen years of country living in southeast Idaho, so this is not a case of "city
person" not accustomed to country air. The odors and flies are produced from
antiquated techniques or lack of any desire to control the impacts to the environment of
their manure operations. Over time some percentage of any population could become
tolerant of the odor; however, the flies generated from their manure pile are in such
numbers that entry into your own home on some days allows several hundred flies to
enter with you.
Meal time is very pathetic in that the family members must compete with the flies for
food. It is inhumane to allow my family pets out of doors because of the constant
torment imposed on them.
I am a mid -level manager at my place of employment. As part of my job, I am expected
to entertain a variety of guests, so I bought a home in the country with a full-size
swimming pool with this in mind. The pool cannot be used as any source of enjoyment,
and entertainment activities are out of the question due to the embarrassment that I
would suffer, both emotionally and professionally. I have been told by members of your

staff that this problem with Grand Mesa Egg has been ongoing for several years and all
efforts have failed to place basic humanitarian controls on their manure treatment
operations. Candid conversations with several county and city representatives have
advised me to do what everyone else is trying to do - "pass the buck", sell the house to
the next unsuspecting soul. As this community is attempting to attract new residents to
the area, we would probably be successful in selling the house; however, it would be
indecent.
This company was allowed into the community as an economic development prospect to
bring additional, reasonable paying jobs to the valley with no economic losses imposed
on the public. Regrettably, we received one more sweatshop and a substantial
downgrade of life in the area. Few area residents would have an issue with the existence
of the chicken farm if it were producing its intended products: eggs, chicken parts and
chickens for resale; however, I believe that when they started their manure
manufacturing operation, they have crossed the line. Was Grand Mesa Egg required to
have an environmental impact or assessment performed?
I would like your office to become actively involved in this issue. Require Grand Mesa
Egg to relocate their manure operation to an area that would not subject residents to
this fly infestation problem and associated odor. Controlling odors and flies from
chicken manure is not a new technology. Other cities and counties are using
methodologies that minimize these effects. Why can't we?

I have been asked by Dr. Aduddell, Health Department Director, to
respond to your letter of complaint dated October 27, 1993. The
Environmental Health Division will be placing a higher priority
on the egg farm issue and will seriously attempt to alleviate the
problems which you have described in your complaint. We have
assigned the area Sanitarian the task of researching the problem
and developing potential legal paths and physical solutions. We
are planning to hold a series of meetings with Grand Mesa Eggs
officials this winter. Hopefully we can persuade them to pursue
a course of corrective action prior to the spring thaw.
Although, I do not foresee a quick and easy solution to this
problem, I am confidant that a reasonable degree of relief is
possible. We will inform you of any progress in this regard.

The Environmental Health Division, Mesa County Health Department,
hereby acknowledges your complaint of odor and flies emanating
from the Grand Mesa Eggs facility. We have received similar
complaints in the recent past and will attempt to address these
issues in the coming months. The Division is in the process of
obtaining all available information on waste handling
alternatives which we will make available to the egg farm
operators. It is our intention to meet with and help the
operators develop a successful control plan which we hope to see
implemented prior to the spring thaw.
Although we cannot guarantee a complete elimination of flies and
odor from the facility, we feel that there is a good possibility
of a reasonable reduction in these offensive impacts.

Inspections were made of the property noted above on April 25 and
April 30, 1990 to determine compliance with the Mesa County
Individual Sewage Disposal Systems Regulations and Section 25-1-
612, Dead Animals, C.R.S., 1973.
On April 25, it was noted that what appeared to be sewage
effluent was standing on the surface of the ground above the
system's leaching area. There was no evidence that effluent was
entering any waters of the State, i.e. surface waters. This
condition, however, is in violation of the Regulations.
The dead chicken and broken egg disposal site revealed that,
except for two or three chicken carcasses, all remains were
properly buried.
The inspection made on April 30 revealed that the condition of
the leaching was the same as noted on April 25. The dead chicken
and broken egg disposal site revealed recent improper burial,
however, with many exposed carcasses.
Darleen McKissen, the area Sanitarian, and I met with Ernie
Greenwood, the corporation s representative who will be working
at this location for about a month, on April 30. He requested a
week to ten days to try to solve the problems at both sites.
Darleen will make inspections approximately every three days to
determine if compliance has been met. Notices of Violation will
be sent to the company at the end of the week or ten days if
there has been no correction. Darleen will continue to monitor
the property and will work through the correction procedure
regarding the failing sewage disposal system (plan review, permit
issuance, inspections).
If the sewage disposal system begins to drain into the
irrigation or drainage systems or other surface waters, the State
Health Department's Water Quality Control Division will be contacted.
At this time there are no regulations enforceable by this
Department regarding odors.

is small and contained away from any ditches. Burial site has 2 or 3 dead
carcasses (from previous trench) exposed. There is an odor and some flips present.
No evidence of trucks parked elsewhere on property; just behind the facility.
5/25/90 - Spoke with "Brent" at the site. Mr. Hudgens and Mr. Greenfield were not
able to be reached. Told "Brent" about the complaint re: parking truck from Mr. Fry.
Inspeceted both sites, along. This time I went on the north side of the chdinlink
fence to view the actual field and runoff. A ditch and a hole (8' wide x 20' long
and 4-5' deep) has been excavated just west of the septic system area Water runs
into the hole. Hole was full, eggs present, odor bad, water running a steady stream.
Pictures were taken. Inspected disposal site 14n activity nhvinnc since last inspec-
tion.
5/21/90 - Call from Dan Hudgens. He stated hole was dug about 2 weeks ago to keep
runoff from the ditches. Has no concerns with water table due to depth of disposal
site trench and he said there was drain tile installed 16' deep in that area. Office
records from 11/12/86 perc test) indicate HSWT at 6'. Also addressed the complaint.

Dear Mr. Fry:
The Mesa County Health Department has been actively
involved in efforts to alleviate citizen complaints
at the Grand Mesa Egg Company facility. Although
our authority does not extend to all complaint areas,
we have attempted to offer recommendations where we
lack regulatory authority. The areas which we have
clear authority, the individual sewage disposal
system for the egg washing operation and the dead
chicken burial operation are being constantly mon-
itored for compliance. Overall odor problems, the
storage and handling of manure, application of manure
as commercial fertilizer, and property trespass issues
are beyond the scope of our regulations. We therefore,
recommend that citizens in the affected area of the
plant contact those agencies under which potential
regulatory involvement would be found.
Regarding the storage, handling and use of chicken
manure it is recommended that you contact the Colorado
Department of Agriculture. Mr. Jerry Mc Donough,
telephone number 243-9373, may be able to assist you
in that regard.
Odor is addressed under the Colorado Department of
Health, Air Pollution Control Division, Stationary
Sources Section. Mr. John Clouse, telephone number
331-8576, is the head of the section in the main
office in Denver.
Property trepass would be under review by the Mesa
County Sheriff's Department, telephone number 244-
3521.
We hope that this information will be of value to you
in the event of future complaints. We will be perform-
ing surveillance on those operations which fall under

RE: Plans and Specifications for Eagwash Wastewater
Treatment System
Dear Mr. Hudgens:
As you are aware, this office has reviewed and approved the
plans and specifications for the proposed wastewater
treatment plant.
A site inspection was conducted on July P. 1991 which
revealed that work on the proposed system has not yet begun.
Inspection also revealed that the existing leach field is
still failing, resulting in effluent being discharged into an
evaporation pit located northwest of the leach field.
At the meeting held on November 29, 1990 at the Mesa County
Health Department, the following deadlines were established:
1. Construction of the lagoons were to begin by April 1,
1990.
2. The lagoons were to be completed by July 1, 1991.
During our telephone conversation today, you proposed the
following deadlines:
1. Commence construction on the lagoon by July 16, 1991.
2. The lagoons are to be completed by September 3, 1991.
It will be necessary for this Department to inspect all
plumbing pertinent to the actual separation of human waste
from the industrial wastes. It will be necessary to remove
the pvc pipe that allows the existing individual sewage
wellness in a Safe Environment

fill the evaporation pit. This Department will continue to
monitor the existing individual sewage disposal system for
proper operation.

6-14-90 - Call from Bill at Westwater-Engineering. A percolation test hole
has-been excavated adjacent to the existing field. Reports sandy soil to 6'
depth. sandy clay 6'-10' with ground water table at 8'. Percolation rate of
2.35 minutes per inch. Plans to use 1800 gallons/day and then to increase the
figure 50%. Draftsman is nn vacation. but hopes to have plans to our office
no later than Tuesday, June 19, 1990. Technology Management (Carlin Chambers)
is involved in analy?ing the soil conditions due in part to the pH of 2-1 caused
by the acid wash the facility uses weekly. Instructed Bill to submit plans,

empty and clean, and are to be parked by the manure sheds. He did try to
contact mr. try concerning the situation.
5/29/90 - Reported pit area to Steve DeFeyter. He said that would not constitute
an approved repair, verified that no permits had been issued, and said to wait
until the NOV date was due (6/18/90).

6-7-90 - Site inspected. Large hole is full of runoff from septic system, eggs
and flies present at that site. Odor noted downwind from large hole. Virtually
no runoff water in the trench. Five new holes have been excavated at the site.
See attached drawing. Standing water in all five holes. Flies and odor present
at each hole. Tank has also been exposed (water present). Disposal site inspected
and is in an acceptable condition. No odor or flies.

6-8-90 - Call to Dan Hudgens. He is aware of the stockpiling of manure. He said
the odor from the pile should dissipate in a couple of days. If not. they have
a product that can be sprayed on the I9ile to help camoflauge the odor. Also, he
did walk the field on 19-1/? Road Thrusday at 6:40 P M One chicken wing was
noted in the field.
6-8-90 - Received attached letter from Grand Mesa Eggs addressing the proper
maintenance of the disposal site. Also, manure truck operators are instructed to

Dear Mr. Byers:
Due to a • nmi'Iainl. being: received by this office,
an inspection was male of the Grand Mesa Eggs
property located at. 1133 21 Road, Grand Junction,
Colorado, on November H, 1989. During that
inpsecti_on it was noted that sewage was being
discharged onto the surface of the ground from the

condition is in violation of Section 3.1 of the

Section 3.1 of the Me*A_CountY_IlidLyidual_Leuag;
Iiibi≥ il_ayt`teluez_Regulati Juu states:
-General Sanitation Requirements: The owner of
any structure where people live, work, or
congregate shall insure that the structure
contains adequate, convenient, sanitary facilities
and a sewage disposal system in good working
order. Under no condition shall sewage or
effluent be permitted to he discharged upon the
surface of the ground or into waters of the state,
unless the sewage or effluent meets the minimum
rectttirmerrts of these Regulations or the water
quality standards of the Colorado Water Quality
Control Commission, whichever are applicable."
Repairs must be made to the existing individual
sewage disposal system to insure that no sewage is
discharged as noted above and that the system will
work properly in accordance with the Regulations.
Before any work is begun on repairs to the
individual sewage disposal system, an application
for a permit must be obtained from this office,
completed and returned for review, before a permit
can be issued for the repair. The repair must be
designed by a Registered Professional Engineer.
Section 3.3 A. of the l<er LlsaLiQI1a states:

"Prior to commencing construction, any person who
wishes to install, alter, or repair an individual
sewage disposal system shall obtain a permit from
the Department and shall furnish the following
information on forms provided by the Department:"

determine that compliance has been met. Failure to
correct by that date may result in a Cease and
Desist Order being issued regarding the use of the
individual sewage disposal system.

RE: Grand Mesa Eggs
As you may recall, a meeting was held at Grand Mesa Eggs, 1133
21 Road, Grand Junction, Colorado on June 4, 1991. The
following persons attended the meeting: Dwain Watson, Water
Quality Control, Colorado Department of Health; Dan Hudgens,
Grand Mesa Eggs; Bill Hamann, Westwater Engineering; Phil Romeo
and Darleen McKissen, Mesa County Health Department.
Dwain Watson reported that he was pleased with the report
submitted by Bill Hamann of Westwater Engineering. It has not
been determined if Grand Mesa Eggs will be required to obtain a
discharge permit. He will contact the State Health Department
for the final decision concerning a discharge permit. During
conversation, Mr. Watson stated that the State Health
Department is acting as a technical assistant to the Mesa
County Health Department.
Basically, the new facility for the treatment and disposal
facility for wastewater from the egg wash facility will consist
of a bentonite lined aerated lagoon. Their proposal is to
conduct routine irrigation five times and then irrigate with
the wastewater on the sixth irrigation. During winter months,
they propose to pump the wastewater back into the existing
septic system on a daily basis. At present, Mr. Hamann stated
that the leachfield is handling 600 gpd of domestic waste.
This figure includes the wastewater from the proposed showers.
He is proposing to pump 800 gallons daily from the lagoon into
the leachfield on a daily basis. The Mesa County Health
Department will require the installation of a meter to monitor
the actual amount of wastewater pumped into the leachfield.
The proposed area for the lagoon was discussed. During an
inspection of the area, it was determined that the lagoon would
be better located in the northwest portion of the property,
between the fields and chicken houses. Discussion revealed the
following: (1) that the facility may add 2 more chicken
houses; (2) that the existing leachfield should be inspected to
insure it's original integrity, i.e. no broken pipes, etc; (3)
that relocating the lagoon to the northwest portion of the
property would leave adequate room for repair of the existing
leachfield, should system failure occur or continue; (4) that
field surveys will be conducted to determine the topography of
the land in the proposed area. Further discussion was held on
the feasibility of capturing the tailwater from the wastewater
irrigation cycle and pumping that water back into the existing
leachfield. Mesa County Health Department is opposed to the
proposal, unless proper plans are submitted and approved to
adequately remove all solids, soils, etc. prior to entering the
leach field. Again, the installation of a meter would be
to take 45 days. Grand Mesa Eggs will install the facility.
He stated that they are prepared to commence construction as
soon as all plans are approved and it has been determined if a
discharge permit will be required. He does not feel that they
can meet the July 1, 1991 deadline. Mesa County Health
Department stated that we would evaluate their progress as of
July 1, 1991 and would be willing to extend the deadline if
construction was in progress.
Dwain Watson contacted the Mesa County Health Department on
June 7, 1991 and left word that a discharge permit would not be
required for the land application process at Grand Mesa Eggs

On 6/15/88 Dr. George Cianko,
Environmental Health Director, and Donald E
Whetstone, -Environmental Health Supervisor
visited with Mr. Bill Byers, Manager of the
Chicken Farm at 1131 21 Road.
During the inspection, some manure was
noted on the roads as you discribed. The
manure truck was stopped on the road and
inspected by all three of us. Bill Byers and
the driver was told that they should keep the
truck cleaner and maintain it in good
condition so that no more chicken manure will
drop from it. If necessary they were told to
wash the truck before driving on the road.

enough to end me the existing regulations on
poultry ranching. 1 am enclosing a photo copy for

Please note, hc,nilativn ;'5-1 61,2 deals with the

involved with violating this statute. Regulation
25-1-613'givo3 the local health department the right

health of inhabitants, within its town, city or

Because of the past number of complaints,the
deprtment fuels that. a nuisance -problem exists
along with complaints of residents in the close
proximity (1/1 mile) of being sick. It- will be;
necessary for the area manager, Mr. William Byers,
to contact the department with a remedial plan to
correct the operational --'£unction of the plant and
eliminate the sources of the complaints by the
neighbors as soon as possible to the Department's
satisfaction.

Dear Mr. Hudgens:
Due to a complaint received by this Department,
inspections were made of the Grand Mesa Eggs
property located at 1133 21 Road, Fruita, Colorado
on April 25, 1990 and April 3O, 1990. The complaint
addressed the disposal practices of waste chicken
parts and eggs on the west portion of the property.
The inspection of April 25, 1990 revealed several
chicken carcasses that were exposed in the
burial/disposal site. Some flies were noted. The
April 3O, 1990 inspection, that you were present
for, revealed the chicken carcasses were not being
completely covered each time after they were dumped.
Please be informed that C.R.S. 25-1-612 provides for
the proper disposal of dead animals and the
maintainence of such areas.

such regulations respecting nuisances, sources of filth, and -causes of sickness
within its respective limits and on board any car or train of cars as it shall

25-1-612. Dead animals - disposition - penalty. No person shall put any
dead animal or part of the carcass of any dead animal into any lake, river,
creek, pond, road, street, alley, lane, lot, field or meadow, or common or
in any place within one mile of the residence of any person, unless the same
and every part thereof is burned or buried at least two feet underground.
If the owner thereof knowingly permits the same to remain in any of the
aforesaid places, to the injury of the health or to the annoyance of any citizen
of the state, he is guilty of a misdemeanor and, upon conviction thereof,
shall be punished by a fine of not less than five dollars nor more than fifty
dollars, together with the costs of prosecution. In default of the payment
thereof, he shall be imprisoned in the county jail of the county in which con-
victed for not more than ten days. such penalty to he imposed by any court
of competent jurisdiction. Every twenty-four hours said owner permits the
same to remain after such conviction shall he deemed an additional offense
against the provisions of this section, and upon conviction thereof he shall
be punished by a further fine of not less than ten dollars nor more than thirty
dollars, together with the costs of prosecution, to be recovered as aforesaid,
and in default of the payment thereof be punished by imprisonment in the
county jail for not more than thirty days or by both such fine and imprison-
ment.

I have been asked by Dr. Aduddell, Health Department Director, to
respond to your letter of complaint dated October 27, 1993. The
Environmental Health Division will be placing a higher priority
on the egg farm issue and will seriously attempt to alleviate the
problems which you have described in your complaint. We have
assigned the area Sanitarian the task of researching the problem
and developing potential legal paths and physical solutions. We
are planning to hold a series of meetings with Grand Mesa Eggs
officials this winter. Hopefully we can persuade them to pursue
a course of corrective action prior to the spring thaw.
Although, I do not foresee a quick and easy solution to this
problem, I am confidant that a reasonable degree of relief is
possible. We will inform you of any progress in this regard.

The ongoing odor and fly problems at the Grand Mesa Eggs, Inc. facility located in
your area need to be formally addressed by this Department . Therefore I am
assigning you to the long term task of attempting to resolve this situation. I will
do what I can to assist you in this effort and will participate when and where I can.
As I have requested, you should be reviewing Department files to gain an
understanding of past complaint problems. To gauge reasonable future progress
performance deadlines need to be set. For the present let us use the following
schedule:

Establish contact with company officials, inspect the facility and surrounding
premises -- prepare and submit a status report. You, I and Dr. Aduddell meet
and discuss the situation.
January 1994:
Following study and internal discussions on the matter we formally meet with
company officials to discuss the problem. We request that they provide within 30
days control plans on specific areas of concern which we have identified.
February 1994:
We meet with GME officials to discuss control plans and implementation
schedules.
March to spring thaw and beyond:
Initial control plan implementation and verification inspection. Thence, monthly
and/or complaint inspections based upon intensity of fly and odor problem.
