HomeMy WebLinkAbout980637.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST FRANKLIN GREEN AND GREG BAKER FOR VIOLATION OF THE WELD COUNTY ZONING ORDINANCE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Franklin Green and Greg Baker, VI #9700220, are allegedly in violation of the Weld County Zoning Ordinance, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 14th day of April, 1998, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Tom Honn, Planning Consultant, represented the property owner at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until July 1, 1998, to allow adequate time for the property owners to bring the subject property into compliance by submitting an application for a Flood Hazard Development Permit either to the Town of Milliken or the County of Weld. CASE SUMMARY November 5, 1997 Initial complaint received. November 5, 1997 Information packet sent via facsimile from J.R. Schnelzer, Town of Milliken Administrator, Lucky 13 Sports Park- presented to Milliken Town Council 10-22-97. November 7, 1997 Letter submitted to the Town of Milliken from Kerri Keithley, Current Planner, addressing the confusion between the Lucky 13 annexation and the Mill Iron 5 annexation. Weld County received annexation material on the Mill Iron 5, but not the Lucky 13. The legal descriptions and size of parcel were different. November 14, 1997 Letter from J. R. Schnelzer, Town of Milliken Administrator, explaining that the applicant, Greg Baker, had been discussing his ideas with the Town of Milliken for some time, but had not officially filed a petition for annexation until November 10, 1997. December 17, 1997 Site inspection conducted by Julie Chester. A note was left for the applicant to contact the Department of Planning Services, as soon as possible. December 17, 1997 Telephone ball between Terri Baker and Julie Chester. She stated that Greg Baker is submitting final information for annexation into Milliken on January 6, 1998 and the Town Board will vote on January 14, 1998. The annexation has already passed the Planning and Zoning Board by a vote of 4 to 3. Julie explained that a Flood Hazard Development permit was still necessary through Weld County as the Town of Milliken had not officially annexed the property. Terri Baker also explained that they had only invited friends out to the property shooting and were not collecting any fees or membership dues at this time. December 18, 1997 Site inspection conducted by Julie Chester. There were approximately 15 people hunting and trap shooting on the property. December 22, 1997 Five day letter sent. December 31, 1997 Telephone call between Julie Chester and Jeff Stoll, Director of Environmental Protection. Jeff explained that the Health Department concerns regarding this operation would be noise levels, safety issues, hours of operation, and waste handling. January 5, 1998 Thirty day letter sent. January 14, 1998 Telephone call between Julie Chester and Rex Fletcher, U.S. Army Corps of Engineers. 980637 VI-9700220, Franklin Green and Greg Baker Page 2 January 6, 1998 Telephone conversation between Julie Chester and Tom Hellerich, Attorney for Green/Baker. Mr. Hellerich explained that they had contacted the Corps of Engineers and they had designed the bridge. He stated he did advise the applicant's about the appropriate permits required for the recreational facility. January 6, 1998 Telephone call between Julie Chester and Rex Fletcher, U.S. Army Corps of Engineers indicating no records were found for the work completed at this location. He would research further. March 16, 1998 Telephone call between Sharyn Frazer and Rex Fletcher, U.S. Army Corps of Engineers. The Corps has decided to proceed with a violation on this property. Public notice will be sent to the Department of Planning Services for comments. The Corps may allow an "after the fact" permit. However, a Flood Hazard Development permit must be applied for with the Department of Planning Services. March 16, 1998 Letter sent to Franklin Green and Mr. and Mrs. Baker, scheduling a meeting with the Board of County Commissioners on April 14, 1998. March 25, 1998 Telephone call between Julie Chester and Nanette, Town of Millken. The applicants were going to try for annexation into the Town of Milliken again without the recreational use. March 31, 1998 Telephone call.between Sharyn Frazer and Nanette, Town of Milliken. The Lucky 13 proposed annexation would go before the Planning and Zoning Board on April 1, 1998, and the Town Board on April 8, 1998. (See memo in file). The structures erected in the floodplain are still located on the property, therefore is a violation of Sections 26, 31.2, 31.3, 31.4, and 31.4.3 of the Weld County Zoning Ordinance. To bring the property into compliance a Flood Hazard Development permit must be applied for and approved through the Department of Planning Services. The Department of Planning Services also recommends that the County Attorney authorize legal action against any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties. This is not a use allowed by right in the Agricultural zone district. The violation can be corrected by obtaining a Flood Hazard Development Permit and a Special Review Permit for the recreational facility on the property. Another option would be to remove all structures that have built in the Flood Plain and to cease using the recreational facility on the property. It is the intention of this office to assist and cooperate with you without imposing undue hardships; however, we have no discretion in this matter if you fail to correct this violation. You have 30 (Thirty) days from January 5, 1998 to correct this zoning violation. Failure to do so will result in this office scheduling the violation before the Board of County Commissioners to consider whether to refer the violation to the County Attorney's office for legal action. Box 290 Milliken, Colorado 80543 RE: Lucky 13 Annexation located in Section 2, Township 4N, Range 67W of the 6th P.M., Weld County, Co. Dear Trustees: Weld County has been receiving many calls from area citizens regarding the proposed Lucky 13 Annexation to the Town of Milliken. To date, the county has not received any information regarding this annexation from the town. The County Zoning Enforcement Officer, Julie Chester, did request information on the use, as the county has been receiving complaints that the use of a shooting range is already occurring on the site, in violation of the Weld County Zoning Ordinance. Ms. Chester was sent a Lucky 13 Sports Park Information Packet which appears to have been presented to the Town Council on October 22, 1997. When I called the town on November 3, 1997 to inquire on the Lucky 13 annexation, I was told by Nanette Armstead, Town Clerk, that the Lucky 13 annexation was the same as the proposed Mill Iron 5 annexation that the county had already received. When reviewing the legal descriptions for the Mill Iron 5 and Lucky 13 annexations, I do not believe this to be the case. According to State Statutes, and in order for the county to offer comments on the Lucky 13 annexation, the Town needs to provide the county with information regarding the annexation, such as an annexation impact statement, annexation map, and other information regarding the proposed uses that would aid the county in reviewing the proposal. NSSF president Bob Delfay said "We predict that more shooters will visit target shooting facilities this summer than ever before, fueled by an increased in first-time shooters (both men and women}. What's more, those clubs that offer a quality recreational experience can look forward to seeing these new customers RETURN again and again." The NSSF's positive forecast is supported by a recent Roper-Starch-World-wide survey indicating that half of all Americans continue to view target shooting as a popular leisure-time activity and almost 30%of these feel that the shooting sports are becoming increasingly popular... Another highly encouraging statistic in the Roper-Starch poll is that there are 67,400,000 men and 47,500,000 women out there who would definitely(or probably) ACCEPT an invitation to try shooting, if ASKED. Whether they're serious competitive shooters or families trying out a new and exciting outdoor sport to share, all signs point to more Americans visiting local shooting ranges this year as they re-dis-cover a classic tradition that was really out of style. The recent National Survey of Fishing, Hunting and Wildlife-Related Recreation was conducted in 1996. The numbers and anglers(16 years and older) have remained relatively onstant.during the past five years. But the total EXPENDITURES by hunters and anglers rose by 69%i(hunting expenditures jumped a whopping 75% from $10.1. billion to$17.7 billion. Surprisingly, the numbers of bird-watchers,wildlife photographers,and other non- consumptive participants dropped 17% during the 5-year period(from 76-million to 63 million). But their expenditures rose 39% to 29 billion. This does not take into consideration the"multiplier effect"which,if factored in,would increase the economic activity to over $50 billion annually. Further,many of these dollars are spent in small rural towns,not in big cities with huge shopping malls.This type of spending is a"shot in the arm"for small towns which don't normally receive much "discretionary"spending,other than from hunters. The nation's hunters and target shooters spend some $8 billion annually on equipment, including firearms, ammunition, clothing, reloading equipment, optics and accessories.There are more than I,100 manufactures, 100 distributors and 14,000 retailers in the nation whose business is totally or largely dependent on the hunting and recreational shooting market. The economic benefit from the hunting and shooting industry also impacts wildlife conservation. In 1937,the sporting firearms and ammunition industry proposed,and actively supported,enactment of an 11%excise tax on sporting long arms and ammunition to fund wildlife conservation programs. In 1970,the firearms industry again proposed and supported enactment of a 10%excise tax on handguns-again for conservation. Currently, these taxes raise in excess of $140 million annually for wildlife management and habitat acquisition and improvements programs. More than $2,5 billion has been raised for conservation since these taxes were enacted. EDUCATION OF HUNTERS According to the Hunting Frequency Survey as well as the NSGA Sports Participation Study,the majority if hunters(about 86% ) , have at least a high school education. HUNTER ACCESS Due to the expanding population and resulting urban sprawl,access to land is a growing problem for a significant percentage of hunters.
