HomeMy WebLinkAbout952356.tiffi RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION #1812 - WARDLAW WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10)(d), CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption #1812, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption #1812 was submitted by Robert H. Wardlaw, 27712 Weld County Road 62, Gill, Colorado 80624, for property which is described as Lot B of Amended RE #837, being a part of the S% of the NE% and part of Lot 1, Section 3, Township 5 North, Range 64 West of the 6th P.M., Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 9.50 acres and 39.26 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1812 submitted by Robert H. Wardlaw be, and hereby is, approved conditional upon the following: 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. 2. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. LOCATION: North of and adjacent to WCR 60 1/2; west of and adjacent to WCR 57. REQUEST: This request is to: (1) Divide a parcel of land containing 49 acres +/-, into Lot A with 9.5 acres +/- and Lot B with 39.26 acres +/-. STAFF RECOMMENDATION: Staff has concerns about the number of previous recorded exemptions in the NE4 of the section, and the number of building sites in the immediate area. Dear Commissioners: This request for a recorded exemption is submitted by Robert H. Wardlaw. The parcel of land under consideration is described as Lot B of AmRE-837, being a part of the S2 of the NE4 and part of Lot 1, Section 3, T5N, R64W of the 6th P.M., Weld County, Colorado. The property lies within the urban growth boundary of the town of Kersey. There is an existing residence on proposed Lot B, with no structures on proposed Lot A. Proposed Lot B is in agricultural production with a feedlot on the property. Proposed Lot A is for a future single family dwelling. A septic system is proposed for Lot A for sewage disposal. Proposed Lot B is currently served by a septic system. Water is provided by the North Weld County Water District for proposed Lot B and can be provided for proposed Lot A. The Weld County Department of Public Works is asking that there only be one access per legal parcel, no additional accesses shall be granted. Proposed Lot A consists of 9.50 acres, more or less, leaving proposed Lot B with 39.26 acres, more or less. Proposed Lot A is to be used as a building site for a single family dwelling, with proposed Lot B remaining in agricultural production with the current structures. According to the applicant, the purpose of the recorded exemption is "to sell the new smaller Lot 'A'." The applicant states "it is anticipated that at some future date a small part of Lot 'A' will be used for a residence, the remainder continuing to have an agriculture use." The Department of Planning Services has concerns about the number of building sites in the immediate area. This recorded exemption would constitute the third recorded exemption in the NE4 of the section. Enable the property owner who is retiring an opportunity to live on or sell the existing farm improvements. B. M., Weld County, Colorado. Dear Ms Dunn and Mr. Hodges: We the undersigned submit the following application to divide Lot "B" amending Recorded Exemption No. 0963 -3 -1 -RE 837. Our request to amend the existing Recorded Exemption would split the existing Lot "B" into two lots. The smaller of the two lots would be Lot "A", approximately 9.50 acres, the larger Lot "B" will have approximately 39.26 acres. The existing Lot "B" is an impr- oved lot. Our plans are to sell the new smaller Lot "A". It is anticipated that at some future date a small part of Lot "A" will be used for a residence, the remainder continuing to have an agr- iculture use. We have no plans to change the use of amended Lot "B" it will remain the basis of our livestock operation. From Mr. Hodges previous work and guidance in obtaining approval for the USR pertaining to our feeding operation, Mr. Hodges is familiar with our property. All of the land, except the feedlot and improvement area, is irri- gated, each parcel will have ample irrigation water, so that each can be farmed as they have been. Delivery and distribution of irrigation water to each lot will be through the same concrete ditch and underground pipeline system we currently utilize. The existing underground and gated pipe irrigation system currently in place, will continue to be used for water distribution and irriga- tion of the land. The split we are proposing is a split whereby amended Lot "A" will be independent of amended Lot "B" in the irri- gation system. Included you will find engineering information regarding de -watering the detention facilities servicing our feedlot operation. The information includes a soil analysis from Weld Laboratories, Inc, and determination of usage of soil nutrients by crops utilizing feedlot runoff water for irrigation of crops. The engineers report concludes that 27 acres can easily handle the contained feedlot runoff water. The parcel, newly created Lot "A", that we desire to sell is planted to alfalfa hay and we will be planting the parcel we are keeping to alfalfa. 952356 • The subject property is located in an agriculture zone, the proposed Recorded Exemption is consistent with the zoning. It is our intent that both lots will remain agriculturally zoned. No change in use is contemplated and the use is fully compatible with the existing use and tenure of the area. A water tap for domestic water for newly created, amended, Lot "A" is available from North Weld County Water District. A letter from the water district stating that the district is able to provide a tap for Lot "A". The letter is a part of and attached to this req- uest. Both lots will utilize septic tanks or standard systems required by the Weld County Health Department. Amended Lot "B" is improved, having a water tap and septic system in place. The proposed Amended Recorded Exemption is compatible with other properties in the area and is not inconsistent with the effic- ient and orderly development of the area. The property is not located in a flood plain, geologic hazard or Weld County Airport District. It complies with the Weld County Zoning Ordinance. Fire Protection is provided by the Kersey Volunteer Fire Depart- ment. Public Service Company provides electrical service to the area. US West provides telephone service. The volume of runoff from a 25 -year 24 -hour storm of 3.0 inches, using SCS runoff curve 90 (1.98 inches of runoff) results in a total volume of 94,363 cubic feet for your 4,000 head feedlot. 2. This volume of water (approximately 95,000 cubic feet) is equivalent to 0.969 inches (or approximately 1 inch depth) of water over 27 acres. 3. Since alfalfa may be irrigated three to five times per season with 3 to 6 inches of water per application, the runoff containment volume can easily be applied during the irrigation season. 4. State regulations require that runoff detention facilities be de -watered within 15 days after a major runoff event to regain the detention volume for a second storm. Since corn, alfalfa and other feed crops can be irrigated at least this frequently, the 27 acres can easily handle the contained feedlot runoff water. 5. The feedlot runoff water can be blended with ditch water for most irrigations during the growing season. 6. Alfalfa at a 4 -ton -per -acre yield utilizes the following amounts of nutrients per acre: 180 pounds N 18 pounds P (= 40 pounds P2O5) 150 pounds K (= 180 pounds K2O) 952351 PAGE 2 Feedlot runoff is composed of the following: 4 pounds/1000 gal. - N 9 pounds/1000 gal. - P.O., 5 pounds/1000 gal. - K,O 7. The runoff detention facilities total volume is 95,000 cubic feet or 712,500 gallons. Total nutrient quantity is: 2,850 pounds N 6,412 pounds P20,, 3,562 pounds K,O 8. 27 acres of alfalfa utilizes the following: 4,860 pounds N 1,080 pounds P,O,, 4,860 pounds K.O 9. These calculations show that 27 acres of alfalfa can fully utilize the nutrients N and K,O from a 25 -year 24 -hour runoff event. The crop cannot use the amount of P,O,, contained in the same volume of runoff. Once every 25 years, there may be excess P,O, for a normal crop on the 27 acres. However, most years, there will be far less than the 95,000 C.F. (712,500 gallons) of runoff water available. Also, the nutrient waste concentrations used in these calculations are for beef animals. This feedlot raises primarily young dairy animals; the nutrient (P,O,,) quantity is 4 pounds/1000 gallons, rather than 9 pounds/1000 gallons for beef. In this case, an alfalfa crop can use much of the nutrient on just 2.7 acres. It is important to note that phosphorus is not very soluble in water and readily fixates to soil and organic matter. So even though a particular crop may not fully use all the available phosphorus, very little, if any, will reach the groundwater. In summary, 27 acres is more than adequate land for feedlot runoff irrigation for your feedlot and the stormwater runoff associated with the design storm. 952356 PAGE 3 • • For most years, when the runoff water volume is far less than the 25 -year design storm runoff, an alfalfa crop can fully utilize the nutrients contained in the stored feedlot runoff water. Commissioner Webster seconded the motion, which carried unanimously. 952351 BC0016 BIDS: PRESENT AND APPROVE WELD COUNTY SHERIFF MOBILE COMPUTER TERMINALS - COMMUNICATIONS AND SHERIFF'S DEPARTMENTS: Pat Persichino, General Services Director, requested the low bid from PCS for $2,601.00 per unit, $54,621.00 total, be approved on an emergency basis. Mr. Warden explained the urgency of this bid is to provide compatibility with the City of Greeley and stated funding is from an energy impact grant. Commissioner Baxter moved to approve staffs recommendation, and Commissioner Harbert seconded the motion. Mr. Persichino responded to further questions from Commissioner Harbert confirming Connecting Point did not submit a bid because it cannot get the hardware. Mr. Warden further explained it would take a number of weeks for the Connecting Point to get a Panasonic dealership. The motion then carried unanimously. PRESENT AND APPROVE SNOW PLOW BLADES - PUBLIC WORKS DEPARTMENT: Mr. Persichino stated Public Works staff recommends emergency approval of the second low bid from J & S Contractors Supply for a total amount of $8,344.20, because the low bidder cannot deliver for three to four weeks. Dave Becker, Public Works Department, further explained Tecom previously ordered the blades but has not done so this year, and there is only one set left. He stated this bid will actually save money, and Mr. Warden confirmed this matter is outside of Tecom's contract. Mr. Persichino reiterated a lower price has been obtained through this bid. Mr. Becker stated Tecom no longer wants to order the blades and reiterated the low bidder does not have the blades available now. Commissioner Harbert moved to approve staffs recommendation, and Commissioner Webster seconded the motion, which carried unanimously. APPROVE HOUSEHOLD HAZARDOUS WASTE SERVICES - HEALTH DEPARTMENT (CONT. FROM 11/08/95): Mr. Persichino stated approval of this bid was delayed from November 8, 1995, for further research, and staff now recommends all bids be rejected. He further explained one of the bidders submitted a bid for Class C landfill waste, which will save approximately $10,000.00 but was not included in the specifications. Therefore, staff recommends the specifications be adjusted and the bid be reopened next week. Commissioner Webster moved to reject all bids, and Commissioner Baxter seconded the motion, which carried unanimously. BUSINESS: NEW: CONSIDER SERVICE AGREEMENT ADDENDUM WITH OCCUPATIONAL HEALTHCARE MANAGEMENT SERVICES, INC., AND AUTHORIZE CHAIRMAN TO SIGN: Mr. Warden explained OHMS provides third party administration for Worker's Compensation for 1996 and 1997. He stated this addendum includes a three -percent increase, which is the first increase in three years, and staff recommends approval. Commissioner Baxter moved to approve said addendum and authorize the Chairman to sign. The motion, seconded by Commissioner Harbert, carried unanimously. CONSIDER CANVASS BOARD CERTIFICATION OF NOVEMBER 7, 1995, COORDINATED ELECTION: Commissioner Webster moved to approve said certification, and Commissioner Baxter seconded the motion, which carried unanimously. CONSIDER AGREEMENT FOR SB118 TAX CREDIT FOR EASTMAN KODAK COMPANY AND AUTHORIZE CHAIRMAN TO SIGN: Mr. Warden explained tax credits may be granted to taxpayers meeting criteria of the Board's policy adopted by Resolution on February 20, 1991, which has been done with a number of major businesses. He stated Kodak has completed a $29 -million expansion and requested a tax credit of $460,000.00 be granted. Mr. Warden confirmed the County, as the taxing authority, has enough funds with the mill levy and assessed value to honor the credit from 1996 through 1999. Commissioner Webster moved to approve said agreement and authorize the Chairman to sign. The motion was seconded by Commissioner Baxter, and it carried unanimously. Further discussion ensued concerning accesses, and Mr. Barker read language into the record for Conditions of Approval concerning the irrigation water for Lot A and limiting the number of accesses to one for Lot A. Mr. Goranson suggested the arm on the north end of the property line for Lot A be included in Lot B rather than in Lot A, and the west boundary of Lot A be moved to the east. Mr. Barker concurred, and Mr. Collins confirmed the arm is just a farm access. Mr. Wardlaw clarified the arm was created by the previous owner and once was the only ingress to Lot B. PLANNING: CONSIDER RESUBDIVISION S #387 OF LOT 21, INDIAN HILLS SUBDIVISION - CARLSON AND AMELING: Todd Hodges, Planning Department, entered staffs recommendation for approval into the record and explained the northern lot line of Lot 21 will be adjusted to add two acres, and the ten -foot utility easement will be vacated. He confirmed a 15 -foot utility easement will be added and the applicant has provided the utility providers' signatures under separate cover, which is acceptable to the Utility Advisory Committee; therefore, he suggested the following changes to Condition of Approval #2b: delete the language "placed on the plat and" and add the language "and recorded with the plat" after " ... border of Lot 21" and before "as approved by the ..." He explained the primary interest is to acquire a recorded exemption on the ten -acre, nonproductive parcel, since Ms. Carlson is retiring. Mr. Francis stated Duane and Kimberly Ameling, co -applicants and owners of Lot 21, would like to acquire two additional acres to provide more privacy for their residence; therefore, the Planning Department staff suggested this resubdivision process to adjust the lot lines prior to proceeding with the recorded exemption. He noted Public Works requested to meet with the applicant prior to recording the plat to establish an access for Lot A, with no additional accesses to be granted. Mr. Goranson stated further concerns with the number of recorded exemptions and building sites in the immediate area and consistency with the intent of the Comprehensive Plan. He reviewed the Conditions of Approval and noted the applicant must amend USR #1057 for the feedlot to show a change in the boundary of the Permit. Mr. Goranson also referred to letters from Weld Laboratories, Inc., and Don Carlson, P.E., concerning soils and runoff, respectively, and answered questions from the Board concerning previous recorded exemptions in the area and property boundaries. Chairman Hall explained, since only four Commissioners are present, the applicant may request a continuance or, in the event of a tie vote, Commissioner Kirkmeyer would review the record and cast the deciding vote. Responding to questions from the Board, Mr. Collins referred to staffs letter of recommendation and clarified Mr. Wardlaw is planning to retire and turn the farm over to his sons while living un the farm. He further clarified Lot A will he sold, with irrigation water, as nonproductive land for a single-family dwelling to provide for expansion of equipment and improvements; however, there is no need to provide housing for family or employees at this time. Mr. Collins also clarified the request fits into the area and noted the number of surrounding houses. Responding to further questions, Mr. Collins confirmed Mr. Wardlaw has owned the property for about fifteen years and actually has added to it since the purchase. He stated part of Lot A is seep and the soil has high salt and pH levels, making it difficult to grow anything but alfalfa.
