This is not a case of neighbor against neighbor as we all agree that everyone is entitled to create a
business, run it, make a living, and provide jobs for others if they can.
As I understand it, the Pyles had a location in the LaSalle area where they kept their trucks and
run their business. About four years ago, they bought 5 acres and home with agriculture buildings
in our neighborhood zoned agriculture by Weld County. They moved in with one or two trucks
causing no alarm in the community. However, the last three years we have seen then convert the
agriculture building into a truck shop, made a living area out of the two car garage attached to
the house, add six more trucks to the business and at least six more cars to the yard, move in two
trailers for their help to live in and extend their hours of activity on the property from 3:00 a.m. to
sometimes 10:00 p.m.
All of the above was done with no zoning or health permits until the Zoning Commission caught
them and made them remove a porta-potty that they were using for the trailers. The trailers have
not been moved and no one comes to empty the septic systems, if they have them. The house and
septic systems were designed in 1977 for a single family unit of 4 people.
They also had established a new driveway from the property via WCR 62 without even talking to
the Weld County Road Department.
Now, this might not seem much, but when they start the trucks early in the mornings., let them
warm up (which you have to do with diesel trucks) and the diesel fumes go into the neighbor's
home, shine the truck lights in neighbor's windows, change tires late in the evening and make
their own zoning, health, and road rules, this turns into a problem. The trucks and trailers are
equipped with dingers, as the law requires, that sound off when the rigs are backed up. Try
sleeping when those go off at 4 a.m. only 100-500 yards from your open bedroom window.
As we see it, they have a trucking and commercial business in an agricultural zone developed by
the Weld County Zoning Regulations, but I suspect that it should be taxed differently than an
agriculture property. Is this being done?

We have enclosed two petitions with the signatures of all landowners in a 2 mile radius of the
property, except four that don't sign petitions and two that are residents outside the U.S. The
landowners have a great deal invested in the area zoned as agriculture.
Now, if you permit the Pyles to the get the Special Use Permit for a use no way connected to
agriculture or the area land use, living style, or quality of life in the neighborhood, this zoning
change will have a great affect on the selling price of all agricultural and residential property in the
area. What is next for our area—"tire mountain"?
Ron Richardson lives directly across the road west of the Pyles and has lived there for years. He
operates a trucking business but his trucks are kept in a commercial zone area northwest of
Greeley, fully 10 miles from where he lives. If this permit is granted, he might just as well move
them home and then we will have two truck terminals in the area.
This hearing has a tendency to pit neighbors against neighbors. This should not be the case. We
have a Weld County Planning Service with a Weld County Master Plan which should take care of
this in the office. When there are as many violations to county health, occupancy, road. and
zoning codes as are present, the action here should be swift and final.

The location of a Truck Terminal is of concern to me. It is of
concern because it is in the middle of an Agricultural area. In this truck
terminal there are five or six Gas & Oil Transports. These transport come
& go at all hours of the day & night. The transports do not fit in this
Agricultural area. If I go to bale hay at 3am , It's because the dew cam c iu
or to change the water at this time it's because its done. This only happens
once or twice a year — not everyday. Also there are two camp trailers at
this same location. They are used for housing the drivers of the transports.
C>ur wishes, would be to leave this area zoned Agricultural
/Residential. Moving the truck term inals back to Kersey or Greeley where
they would be in Commercial zoning area.
Our land is adjacent to Weld County Road 62 & 57.

I am strongly opposed to the Special Use Permit requested by Wilma Pyle (USR-1225) to "Park our
trucks and keeping our business (hauling of crude oil)" at 29950 WCR 57., Greeley, CO 80631 and I will
address my opposition to her remarks as follows:
1. Where, when, and how is the oil disposed of when they are changing the oil in their trucks?
2. No part of what she is proposing is agricultural, except for her small garden.
3. N/A
4. I am part of the retired couple that is south of her property. We have 10 acres surrounding our
house, with pasture and corrals for cattle. We also own the 25 acres east of her property which
we have in corn and we question the contamination of our crops.
5. A&B. Where does the waste for the two trailers go? Where do the trailers get water? Is the
septic tank on a house that was built in 1977 adequate to hold the waste of three separate
families? Do they need a separate permit for these trailers? (We had to get a permit to build our
house with all of the necessary inspections.) What about the wiring and the use of propane gas to
these two trailers? Do they pass code? Have they ever been checked by the county?
C. The hours of operation are not as stated. We have heard the trucks go out as early as 3 a.m.
and return as late as 10 p.m. Also, some of these trailers go out more than one time per day. The
diesel fumes from the trucks (since they let them run each morning for at least 15 minutes) come
directly into our home and fill our home up with the fumes before we get a chance to close all of
the windows. Also, their drivers come in and talk loudly back and forth to each other and wake
up the whole neighborhood. I have called them several times to request that they move their
trucks and refrain from making so much noise at 5 a.m.
D. The proposed extension to the garage on the north will not allow them to exit the building
with the large trucks and make the turn without crossing over an underground irrigation pipe
which is not on their property.

F. When the Pyles first moved here, they only had one truck; and now they are requesting that
they be permitted to have 7 trucks with trailers. Also I question the number of cars they state will
be on the property. On most days, there are 11-13 cars there (they state only 8).

I. Again, is the present septic tank large enough to cover three families? Has the Health
Department been contacted regarding this? Where will they be running their New (as they have
stated) leach field. Will it be closer to the property line and going into our fields'?

7. They make no response to reclamation procedures. What about the grease pit that is in the
garage? Was a permit ever taken out to have this on the property?

10. How are they disposing of the waste at the present time? We do not see anyone picking up the
waste.
I think they were aware that they were in violation of the zoning when they moved their business on to
this five acres and I do not feel that they would conform to any plan (either theirs, since they are not
doing so at the present time, or yours) if this permit was granted. I strongly oppose the granting of
this permit and I will be in attendance at the hearing to express my opposition.

When I built my house eleven(11)years ago, I worked with the Planning Commission (Bob Huffman)
and obtained all of the building permits to build the house and all of the permits passed inspection.
When our house was finished in 1988, in an agricultural zone, I never thought that I would have a truck
depot and trailer court without a permit next to me. There is agricultural land in all directions from this 5
acres, north, south, east and west. My property and farm ground borders this five acres on the south (10
acres house and corrals) and east (25 acres of corn in 1998).
I have been concerned about the contamination of the soil on their place washing down i.n my crops when
we have any heavy rains since their 5 acres slopes downhill into my field.
I always thought the zoning laws were to protect the community. The Pyles need to set up their trucking
business in a commercial zone like the other trucking firms that haul crude oil, especially with their trucks
carrying hazard material plackers.
They park their trucks helter/skelter on their 5 acre lot (not as proposed in their plan) with several of their
trucks parked only 200 feet from my home. The pictures I am providing will back up this claim.
In the summer time, when we have our windows open, they start up the diesel trucks in the morning and
let them run to warm up for at least 15 minutes or more. The fumes come over and through my windows
into our home. It happens most every morning from 3 a.m. to 6 a.m. and we have to jump up out of bed
and close all of the windows, but then the diesel fumes are in my home
All of the property owners in this community are in ag related business and operating in an ag zone. It is
the feeling of the property owners that I have talked to that we want to keep our ag zoning and not let
special permits be granted, especially when the Pyle business contributes nothing to ag in general. They
also cause undue traffic and wear and tear on county roads 60 1/2, 62, and 57 and the county has spent
thousands of dollars in the past two years to upgrade and improve these roads. We are appreciative of
Weld County for improving roads 60 ' , 62, and 57.
I feel that our air space (my wife's and mine) is being violated and the diesel fumes from their trucks are
harmful to our health. I am strongly opposed to granting a permit to the Pyles to go on with their
business and operation in this ag zone.

Wilma Pyle
This is pertaining to the application submitted for the business of hauling and parking of tankers and
employees living on property. This is an agricultural and residential area. There are several families
in this area with farming and some raising of livestock. Basically, it's a very quiet area until this
business started. We've noticed a great increase in traffic up and down Rd 57 and 60 I/2; this seems
to be a 24 hour business. We have seen or heard these trucks coming and going at all hours of day
and night. The noise is great, the dust is plentiful and the traffic is constant. The road is pitted from
heavy traffic, sometimes as many as 20 truck$ up and down the road a day. Also, the great number
of people that are living in this house result in parties and loud music until all hours of the night and
day. During the winter, there have been numerous times these trucks have gelled and been stalled in
the road making the road impassable.
We live in a fairly well maintained area, consisting of houses ranging in the mid 100s to 200s and this
is a real eyesore degrading our property values.
We strongly advise against zoning this a business. It really impacts too many family's peace and
quiet of rural living. This certainly isn't the reason we moved into this area 11 years ago.
