Dear Mr. Wallace: This letter is a follow up to my letter sent to you dated October 28, 1997. In my letter I stated that additional information was required from you with regards to the proposed roping arena. This information was to be submitted to my office no later than November 4, 1997, to be part of USR-1167 application. The additional information was not received. Please be advised that your request for a roping arena will not be part of USR-1167 application request. USR-1167 will strictly cover the Commercial Use of a Sports Marketing Business. Please be advised that if some point in the future you choose to operate a public roping arena that you will need to amend the current special use permit or apply for a new special use permit. This case is scheduled to be considered at the November 18, 1997, Planning Commission Meeting. Once again, USR-1167 will only be addressing the Sports Marketing Business. Eastin ORIGINAL HEARING DATE: October 21, 1997 CASE NUMBER: USR-1167 HEARING DATE: November 18, 1997 APPLICANT: Brian and Lisa Wallace ADDRESS: 15501 WCR 13 Platteville, CO 80651 REQUEST: A Site Specific Development Plan and Special Review Permit for a Commercial Use (Sports Marketing Business) in the A (Agricultural) Zone District LEGAL DESCRIPTION: Lot A of RE-1888, part of the NE4 of Section 13, T3N, R68W of the 6th P.M., Weld County, Colorado LOCATION: West of and adjacent to WCR 13; Approximately '/z mile north of WCR 32 PARCEL ID #: 1207-13-1000086 ACRES: 5 The Department of Planning Services staff recommends that this request be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Department of Planning Services that the applicant has shown compliance with Sections 24.3 of the Weld County Zoning Ordinance, as amended, as follows: a. Section 24.3.1.1 -- This proposal is consistent with the Weld County Comprehensive Plan which allows for commercial and industrial uses to locate in the Agricultural Zone District when the impact to surrounding properties is minimal, and where adequate services and infrastructure are available. b. Section 24.3.1.2 -- This proposal is consistent with the intent of the A (Agricultural) Zone District in that no prime productive farm ground is being taken out of production. Section 24.3.1.3 -- The proposal will be compatible with the existing surrounding land uses which are rural residential acreages, pasture land and agricultural uses. d. Section 24.3.1.4 -- The proposed use will be compatible with future development of the surrounding area as permitted by the A (Agricultural) Zone District and with the future development as projected by the Comprehensive Plan or Master Plan of affected municipalities. The subject property lies within three miles of the Town of Mead. Their comments are attached and incorporated into the Conditions of Approval and Devlopement Standards. e. Section 24.3.1.5 -- The proposal is not located within the Flood Hazard Overlay District Area identified by FEMA. f. Section 24.3.1.6 -- The subject property is not prime farm ground. g. Section 24.3.1.7 -- The Design Standards (Section 24.5 of the Weld County Zoning Ordinance, Operation Standards (Section 24.6 of the Weld County Zoning Ordinance), Conditions of Approval and Development Standards ensure that there are adequate provisions for the protection of health, safety, and welfare of the inhabitants of the neighborhood and county. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. The Department of Planning Services's staff recommendation for approval is conditional upon the following: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review Plat prior to recording the plat. The completed plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners.(Planning) 2. The applicant shall attempt to address the concerns of the Mountain View Fire Protection District as stated in their referral letter dated September 15, 1997. (Planning) 3. The existing septic system being currently used for the residence is adequate for up to 8 (eight) employees. In the event the employee number increases to more than eight, the system must be enlarged in accordance with the Weld County I.S.D.S. Regulations.(Health Dept.) 380175 Page 3, USR-1167 4. Prior to recording the plat the applicant shall meet with the Public Works Department and discuss the site distance and maintainance issues as stated in a referral from Don Carroll, Project Administrator, dated September 9, 1997. A copy of the meeting and any agreements shall be submitted to the Department of Planning Services. (Public Works) 9801 Page 4, USR-1167 SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS Brian and Lisa Wallace USR-1167 1. The Site Specific Development Plan and Special Use Permit is for a Commercial Use (Sports Marketing Business) in the a (Agricultural) Zone District, as indicated in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon.(Planning) 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance, as amended.(Planning) 3. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. (Health Dept.) 4. No permanent disposal of wastes shall be permitted at this site. (Health Dept.) 5. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris and other potential nuisance conditions.(Health Dept.) 6. Fugitive dust shall be controlled on this site. (Health Dept.) 7. The maximum permissible noise level shall not exceed the commercial limit of 60 db(a) as measured according to 25-12-102, Colorado Revised Statutes. (Health Dept.) 8. The facility shall utilize the existing public water supply. (Health Dept.) 9. Restroom facilities in the on-site residence shall be available to employees of the Sports Marketing Company.(Health Dept.) 10. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance, as amended.(Planning) 11. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance, as amended.(Planning) 12. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated hereon and all applicable Weld County regulations.(Planning) 980175 Page 5, USR-1167 13. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing standards and all applicable Weld County regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services.(Planning) 14. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. As I indicated to you on the phone, this office has not received any additional information with regards to the roping arena as requested October 21, 1997, by the Department of Planning Services. Please be advised that our office must receive the additional information from you no later than November 4, 1997. Your case was originally scheduled to be considered by the Planning Commission on October 21, 1997. At this meeting is was requested by staff and yourself to continue this case until the next Planning Commission meeting, November 4, 1997, to allow you the opportunity to submit additional information with regards to the roping arena. At this time this office has not received the additional information. Staff is will request at the November 4, 1997, Planning Commission meeting that this case once again be continued until November 18, 1997, to allow you to submit the additional information. As stated previously, this information is required to be submitted no later than November 4, 1997. If the information is not submitted staff will request that this case continue with the Sports Marketing Business only and that the arena not be considered a part of the application. All three had a misconception of what we our requesting, the type of business activities, the type of buildings and structures we are proposing and the general intent of our application for a special use permit. Therefore, as per your request I thought that maybe I could clarify a few misunderstanding. Progressive Sports Marketing implements and manages sponsorship contracts on a national basis for the sport of rodeo. We have contracts with National Sponsors to implement and manage specific sponsorship programs with rodeos across the United States and Canada. All of our business is conducted by phone, therefore we have no customer'traffic. The sponsorship programs we manage require us to ship promotional materials to and from approved events. These items may include arena banners, posters, rodeo programs, rodeo tickets, and other promotional materials. We may be required to print with laser printers information specific to each' event ie: dates on rodeo posters, information on rodeo tickets. We are not a printing company nor our we a ticketing agency. - In addition, we would like to construct a roping arena as shown on the map that was included with our application. The arena may have jackpot rodeo events from time to time. We will not selling admission tickets to these events. The primary use for the arena will be for training and practicing with our own horses. We are asking to use a small portion of the 5 acres to operate the Sports Marketing Company. The business will require space for parking of employee vehicles and a future building as described below to house the business activities. All of the proposed buildings and improvements will be constructed with the intent that they can be used solely for agricultural purposes in the future. The proposed building that will be used to house the business will be a barn and can be converted back into a barn in the future. All business activities will be housed in structures comparable to those found in an agricultural zones. NO buildings of a design similar to those found in a typical commercial or industrial area will be constructed. The only people that visit our site in addition to our employees will be Federal Express. Federal Express will Pick-up and drop of packages once a day as a regularly scheduled stop. There will be NO customer traffic. There will be NO commercial signage for the sports marketing business on the site.The only equipment used on this site will be personal computers. Animals on the site will be used for personal use and not used by the sports marketing business. The majority of the acreage will be used for the upkeep of our family's horses. Thus providing several acres of open grassland within the area. I would appreciate it if you would include a copy of this letter with our application and provide it to'the entities mentioned above.
