HomeMy WebLinkAbout951353.tiff*R24469_11 RESOLUTION RE: DIRECTION FOR STAFF FOR PROCEEDINGS RELATING TO BRUNO AVENUE, COUNTRY ESTATES SUBDIVISION, WELD COUNTY, COLORADO WHEREAS, the Board of County 'Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on June 28, 1995, at 9:00 a.m., the Board considered two alternatives for Bruno Avenue in the Country Estates Subdivision, Weld County, Colorado, as follows: 1. Vacate those portions of Bruno Avenue between Weld County Road 33 and Matthews Avenue and between Tate Avenue and Weld County Road 35, with the center portion of Bruno Avenue between Matthews Avenue and Tate Avenue to be closed to motorized vehicles and accessible for pedestrians, horses, and bicycles. Said portion of roadway may be narrowed by vacating 10 feet to 15 feet on either side. 2. Vacate the entire stretch of Bruno Avenue. WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the recommendations of the Weld County Attorney's Office and the Weld County Public Works Department and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that Bruno Avenue shall be vacated; the Department of Planning Services shall proceed with the replat of both the Second and Third Filings of Country Estates Subdivision, Weld County, Colorado, to reflect the changes made to Bruno Avenue; and staff shall be directed to process the appropriate Quit Claim Deeds, etc. to return the right-of-way to the appropriate adjoining landowners in accordance with the replats. Barker, County Attorney Subject: Bruno Avenue, County Estates Subdivision I have placed on the agenda for June 28, 1995 the question of Bruno Avenue in the Country Estates Subdivision, Weld County, Colorado. The Board considered this matter at a work session on June 23, 1995. I was directed to ascertain from area residents whether they have any interest in forming a homeowners' association or other volunteer group to maintain the roadway, if the road is restricted to non -motorized traffic. A copy of the work session notes are attached. I spoke with Kathy Boerema regarding the viability of any volunteer effort to maintain the right-of-way. She told me that she didn't think it would be possible to get enough volunteers to participate and, in her opinion, vacating portions of Bruno Avenue and leaving other portions open to non -motorized traffic is a mistake. She told me that she would send a letter to the Board explaining her position. Attached is a copy of her June 9, 1995 letter. Also attached are copies of criminal incident reports which I received from the Weld County Sheriffs Office regarding Thomas Mitchell and Marion Miller. The ongoing dispute between Mr. Miller and Mr. Mitchell centers on whether Mr. Miller has the right to place permanent fencing within the road right-of-way. (The term "permanent fencing" in this case is the placement of metal tube -type corral fencing in cement -receptive posts.) It should be noted that Mr. Miller is the licensee in one of the two remaining License Agreements between Weld County and adjacent landowners. The License Agreements are for the private use of Bruno Avenue and do not allow for placement of permanent fencing within the road right-of-way; however, I believe that in the past ten years the Public Works Department has consented to the placement of such fencing. You have received a copy of a letter which I sent to Albert and Kathy Boerema dated June 20, 1995. Identical letters were sent to each of the landowners in the subdivision. The letter states the two alternatives which were discussed by the Board at the May 23, 1995 work session. Box 758 Greeley, CO 80632 Dear Ladies and Gentlemen: jVELD COUNTY ATTORNEYS OFFICE I am writing concerning your proposal about Bruno Avenue in Country Estates. In speaking with the Weld County Attorney, I understand this proposal involves vacating Bruno between WCR 33 and Mathews Avenue on the west and Tate Avenue and WCR 35 on the east. The portion between Mathews Avenue and Tate Avenue would be closed and replaced with a path for non -motorized traffic. At first this would seem a workable proposition but there are some serious problems with this solution that I feel need to be addressed by the County Commissioners. In checking with the U.S. Post Office in Fort Lupton, there are three addresses on Bruno Avenue that would have to be changed to either a Mathews or Tate Avenue address. The Department of Planning Services or the County Assessors Office would need to be involved in this change. First, who and how much usage of this pathway would there be? Other than pedestrians, bike riders, and horseback riders what other non -motorized vehicles would be allowed? Would horse drawn vehicles be allowed or does the County Commissioners consider them something else? Your suggestion for clean-up of the proposed pathway by a volunteer group of homeowners will not work. Volunteers would be nonexistent in a short period of time and the adjacent homeowners would be left with the clean-up as before the clo- sure of Bruno in 1985. There is no Homeowners Association for the subdivision of Country Estates. Without a Homeowners Association another question comes to mind. Who would be liable for injuries and damages incurred on or from this pathway? In your Private Use of the Right of Way Agreement dated August 28, 1985 with the adjacent owners along Bruno Avenue, 951353 Condition 3 states the private users agree to indemnify the county from being liable for injuries, etc during their use of this space. This then made the Private Users liable. A memorandum from the Department of Public Works, then known as the Road and Bridge Department, dated April 17,1985 allows a fence to be installed by the residents if they wish. The Private Users adjacent to Bruno Avenue on the east side of Mathews erected a fence closing off this portion. This fence has been taken down several times in the past few months. The last time was on May 27, 1995. The report was taken by Sheriff's Deputy Peter Wagner. A video was also taken into evidence concerning this incident. Deputy Wagner informed the Weld County Attorney of the incident on May 30, 1995. Most non -motorized pathways have spaced wooden posts or posts with a chain across (not feasible in this case) to keep the motorized traffic out. With such a blatant disregard for the law, who's to say this won't happen again. This is one instance where trying to be all things to all peo- ple is not the best option. A final decision needs to be made and then inforced. Therefore, the best decision in this matter would be in vacating Bruno Avenue and the property reverting to the adjacent property owners. BOTH MR. AND MRS. MILLER SAID THAT THEY HAD CAPTURED THIS EVENT ON VIDEO TAPE. I THEN WENT INTO THE BASEMENT OF THE MILLER HOME WHERE THEY SHOWED ME THE VIDEO TAPE THEY HAD TAKEN OF THOMAS MITCHELL TAKING THE FENCE DOWN. IN THE VIDEO TAPE, YOU CAN CLEARLY SEE THREE SUBJECTS DOWN AT THE BRUNO AVENUE LOCATION OF THE FENCE TAKING THE PANELS DOWN AND THE CUTTING THE STEEL POSTS WITH WHAT APPEARS TO BE SOME TYPE OF A CUTTING TORCH THAT IS IN THE BED OF A GRAY PICKUP TRUCK. MRS. MILLER STATED THAT SINCE SHE COULD NOT CLEARLY FOCUS IN ON THE FACES OF THE SUBJECTS FROM WHERE SHE WAS STANDING INSIDE THE RESIDENCE, SHE WENT OUT INTO THEIR YARD AND THEIR PASTURE AREA WHERE SHE WAS ABLE TO GET CLOSE ENOUGH TO GET VERY CLEAR SHOTS OF THOMAS MITCHELL AND HIS SONS. MRS. MILLER WAS EVEN ABLE TO WALK AROUND THE PICKUP TRUCK TO THE FRONT, SHOWING THAT THERE WAS NO FRONT GRILL NOR HEADLIGHTS NOR BUMPER, AND THEN TO THE REAR WHERE SHE WAS ABLE TO PHOTOGRAPH THE LICENSE PLATE WHICH IS COLLECTOR SERIES 05G97. THERE IS EVEN CONVERSATION BETWEEN MRS. MILLER AND SUBJECT MITCHELL, DURING WHICH TIME MITCHELL MAKES SOME REFERENCE TO MRS. MILLER'S DAUGHTER IN CALIFORNIA. MRS. MILLER STATES THAT SHE HAS NO CHILDREN AT ALL IN CALIFORNIA, AND DOES NOT KNOW ANYBODY IN CALIFORNIA. I DID TAKE THE VIDEO TAPE AS EVIDENCE. I ALSO WENT OUTSIDE WITH MR. AND MRS. We have three small children, and are aware of the situation with Bruno Avenue. We attended the meeting held in Fort Lupton on May 9th and we believe that Bruno Avenue SHOULD be open between Mathews Avenue and Tate Avenue. We are located on the north section of Tate Avenue. Our daughter has been using Bruno Avenue as a path for her horse to get to friends' houses on Mathews Avenue. There is no way that we would ever consider letting her ride her horse (or bicycles for our younger children) on Road 8, and Road 6 is -too far out of our sight to be letting them use as a crossover road to Mathews. This area is a country neighborhood. The difference between the city neighborhood and the country neighborhood as far as our children are concerned is that we do not have sidewalks to let them safely get to their friends houses. If Bruno Avenue were to be vacated, it would be comparable to a non -busy city street being closed, and those children having to use the busy street (with no sidewalk) to get where they are going. :It's just not safe! If Bruno Avenue was opened for pedestrian, horse, and bicycles only, at:least our children would have a safe path to get from one road to the other and could still be within our site almost the entire trip. It is our understanding that Bruno Avenue was created by all land owners giving up a small piece of their property. It is not logical to equally divide the extra land between all of the Country Estates if the road is narrowed. That would take a lot of time and be very expensive. However, it is not fair to the other Country Estates -land owners if the extra land were to be given to the adjoining land owners along Bruno Avenue. We believe the best solution to this problem is to leave Bruno Avenue open to pedestrians, horses, and bicycles ONLY, but to leave it the same width it -is, for everyone to enjoy. Barker, County Attorney - %�� subject• Bruno Avenue in Country Estates Subdivision In the past few months, Barry Kramer and I have received a number of telephone calls from residents living in the Country Estates subdivision regarding the status of Bruno Avenue. Country Estates subdivision is located between Weld County Roads 6 and 8, east of WCR 35. The subdivision encompasses the entire area of Section 23, Township 1 North, Range 66 West of the 6th P.M., Weld County, Colorado. Bruno Avenue is an east and west street which bisects the subdivision. A copy of the map showing the location of the subdivision is attached. Also attached is a copy of the plat map showing the subdivision, including Bruno Avenue. Bruno Avenue has a long and controversial past. The roadway has never been accepted for maintenance by Weld County. Prior to August, 1985, the avenue existed primarily as a dirt tract and was used by horseback riders, kids on motorcycles and ATV's, bicyclists, and pedestrians. A meeting of the Board of County Commissioners regarding the use of Bruno Avenue was held on August 28, 1985. All of the owners of lots within the subdivision were noticed and had the opportunity to attend. The hearing was designed to have the Board determine if there was a desire to vacate Bruno Avenue. The Board decided at the hearing to close the roadway and encourage agreements between Weld County and adjacent landowners for their private use of those portions of Bruno Avenue adjacent to their properties. A copy of the Board's Resolution is attached. Agreements with five of the seven adjacent landowners were approved by the Board in 1986. A copy of the agreement with Russell and Judith Miller is attached. The agreements with the adjacent landowners allow them to put the right-of-way to "any private use." The landowners cannot, however, take dirt, gravel, or sand from the right-of-way or place structures or buildings thereon. The agreements were non-transferrable and could be revoked by the Board at any time. Barricades were placed at either end of Bruno after the Board made its decision in August, 1985. Since 1985 there have been two items of correspondence received by the Board regarding Bruno Avenue. A letter dated May 27, 1992 was received from Stan Gembol, complaining about a proposed driveway -type use of Bruno Avenue by Kevin Kozba. A copy of that letter is attached. The second letter was dated September 23, 1993 from Tom and Cheryl Mitchell. Their letter complained about the firearm activities of Russell Miller. A copy of the Mitchells' letter is also attached. I can find no correspondence responding to either of these letters. I recall, however, speaking by telephone with Mrs. Mitchell. It was my understanding that she was waiting for a response from the Sheriffs Office and that she fully intended to pursue a criminal complaint against 951353 Board of County Commissioners Page 2 March 9, 1995 Mr. Miller. I checked with the Records Department and found only one incident report involving Mr. Miller, that being from November, 1994. A copy of the incident report is attached. As of this date, only one of the five original adjacent landowners who signed the agreement is still residing in the subdivision (the Millers). In January, 1989 the Nesters transferred ownership of their lot to the Lahayes and a new agreement was executed between the Lahayes and the County. Therefore, the Millers' and the Lahayes' agreements are the only ones which are still in effect. By memo dated December 28, 1994 George Cicoff recommended that Bruno Avenue be vacated. It may only be vacated through the resubdivision process set forth in the Weld County Subdivision Ordinance. I believe that each Commissioner has already received a copy of George's memo.
