RESOLUTION
RE: DIRECTION FOR STAFF FOR PROCEEDINGS RELATING TO BRUNO AVENUE,
COUNTRY ESTATES SUBDIVISION, WELD COUNTY, COLORADO
WHEREAS, the Board of County 'Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on June 28, 1995, at 9:00 a.m., the Board considered two alternatives for
Bruno Avenue in the Country Estates Subdivision, Weld County, Colorado, as follows:
1. Vacate those portions of Bruno Avenue between Weld County Road 33 and
Matthews Avenue and between Tate Avenue and Weld County Road 35, with the
center portion of Bruno Avenue between Matthews Avenue and Tate Avenue to be
closed to motorized vehicles and accessible for pedestrians, horses, and bicycles.
Said portion of roadway may be narrowed by vacating 10 feet to 15 feet on either
side.
2. Vacate the entire stretch of Bruno Avenue.
WHEREAS, the Board of County Commissioners heard all of the testimony and statements
of those present, studied the recommendations of the Weld County Attorney's Office and the Weld
County Public Works Department and all of the exhibits and evidence presented in this matter and,
having been fully informed, finds that Bruno Avenue shall be vacated; the Department of Planning
Services shall proceed with the replat of both the Second and Third Filings of Country Estates
Subdivision, Weld County, Colorado, to reflect the changes made to Bruno Avenue; and staff shall
be directed to process the appropriate Quit Claim Deeds, etc. to return the right-of-way to the
appropriate adjoining landowners in accordance with the replats.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Bruno Avenue shall be vacated subject to replat of both the Second and
Third Filings of Country Estates Subdivision, Weld County, Colorado, to reflect the changes made
to Bruno Avenue; and the Department of Planning Services staff be, and hereby is, directed to
prepare and process an application for replat and that the Quit Claim Deeds and/or other
documents be prepared as needed to return the right-of-way to the appropriate adjoining
landowners in accordance with the replats.

Bruno Avenue, County Estates Subdivision
I have placed on the agenda for June 28, 1995 the question of Bruno Avenue in the Country Estates
Subdivision, Weld County, Colorado. The Board considered this matter at a work session on
June 23, 1995. I was directed to ascertain from area residents whether they have any interest in
forming a homeowners' association or other volunteer group to maintain the roadway, if the road
is restricted to non -motorized traffic. A copy of the work session notes are attached. I spoke with
Kathy Boerema regarding the viability of any volunteer effort to maintain the right-of-way. She told
me that she didn't think it would be possible to get enough volunteers to participate and, in her
opinion, vacating portions of Bruno Avenue and leaving other portions open to non -motorized traffic
is a mistake. She told me that she would send a letter to the Board explaining her position. Attached
is a copy of her June 9, 1995 letter.
Also attached are copies of criminal incident reports which I received from the Weld County
Sheriffs Office regarding Thomas Mitchell and Marion Miller. The ongoing dispute between
Mr. Miller and Mr. Mitchell centers on whether Mr. Miller has the right to place permanent fencing
within the road right-of-way. (The term "permanent fencing" in this case is the placement of metal
tube -type corral fencing in cement -receptive posts.) It should be noted that Mr. Miller is the licensee
in one of the two remaining License Agreements between Weld County and adjacent landowners.
The License Agreements are for the private use of Bruno Avenue and do not allow for placement
of permanent fencing within the road right-of-way; however, I believe that in the past ten years the
Public Works Department has consented to the placement of such fencing.
You have received a copy of a letter which I sent to Albert and Kathy Boerema dated June 20, 1995.
Identical letters were sent to each of the landowners in the subdivision. The letter states the two
alternatives which were discussed by the Board at the May 23, 1995 work session.

I am writing concerning your proposal about Bruno Avenue in
Country Estates.
In speaking with the Weld County Attorney, I understand this
proposal involves vacating Bruno between WCR 33 and Mathews
Avenue on the west and Tate Avenue and WCR 35 on the east.
The portion between Mathews Avenue and Tate Avenue would be
closed and replaced with a path for non -motorized traffic.
At first this would seem a workable proposition but there
are some serious problems with this solution that I feel need
to be addressed by the County Commissioners.
In checking with the U.S. Post Office in Fort Lupton, there
are three addresses on Bruno Avenue that would have to be
changed to either a Mathews or Tate Avenue address. The
Department of Planning Services or the County Assessors Office
would need to be involved in this change.
First, who and how much usage of this pathway would there be?
Other than pedestrians, bike riders, and horseback riders what
other non -motorized vehicles would be allowed? Would horse
drawn vehicles be allowed or does the County Commissioners
consider them something else?
Your suggestion for clean-up of the proposed pathway by a
volunteer group of homeowners will not work. Volunteers would
be nonexistent in a short period of time and the adjacent
homeowners would be left with the clean-up as before the clo-
sure of Bruno in 1985. There is no Homeowners Association
for the subdivision of Country Estates.
Without a Homeowners Association another question comes to
mind. Who would be liable for injuries and damages incurred
on or from this pathway?
In your Private Use of the Right of Way Agreement dated
August 28, 1985 with the adjacent owners along Bruno Avenue,

Condition 3 states the private users agree to indemnify the
county from being liable for injuries, etc during their use
of this space. This then made the Private Users liable.
A memorandum from the Department of Public Works, then known
as the Road and Bridge Department, dated April 17,1985 allows
a fence to be installed by the residents if they wish. The
Private Users adjacent to Bruno Avenue on the east side of
Mathews erected a fence closing off this portion. This fence
has been taken down several times in the past few months.
The last time was on May 27, 1995. The report was taken by
Sheriff's Deputy Peter Wagner. A video was also taken into
evidence concerning this incident. Deputy Wagner informed the
Weld County Attorney of the incident on May 30, 1995.
Most non -motorized pathways have spaced wooden posts or posts
with a chain across (not feasible in this case) to keep the
motorized traffic out. With such a blatant disregard for the
law, who's to say this won't happen again.
This is one instance where trying to be all things to all peo-
ple is not the best option. A final decision needs to be made
and then inforced. Therefore, the best decision in this matter
would be in vacating Bruno Avenue and the property reverting
to the adjacent property owners.

Our recommendation for Bruno Avenue between Tate Avenue and
Weld County Road 33 is to close the road so that a fence
may be installed by the residents, if they wish. However,
we do not want to vacate this road; we would like to retain
the right-of-way in case it is needed in the future. By
retaining the right-of-way, we can also avoid possible land -
locking if new growth develops.

NARRATIVE/FACTS:
ON 052795, I WAS DISPATCHED TO 2510 MATTHEWS AVENUE IN THE COUNTRY
ESTATES SUBDIVISION ON REPORT OF A NEIGHBORHOOD DISPUTE AT THAT
LOCATION. INFORMATION FROM DISPATCH WAS THAT A NEIGHBOR OF THE
REPORTING PARTY WAS CURRENTLY TEARING DOWN A FENCE OWNED BY THE
REPORTING PARTY.
UPON ARRIVAL, I CONTACTED REPORTING PARTY MILLER AND HIS WIFE, JUDITH.
REPORTING PARTY MILLER SAID THAT HE HAD PUT UP A FENCE ON THE NORTH SIDE
OF BRUNO AVENUE IMMEDIATELY ADJACENT TO THE SOUTH OF HIS PROPERTY LINE.
MR. MILLER EXPLAINED THAT HE HAD AN AGREEMENT WITH WELD COUNTY, WHO IS
THE ACTUAL OWNER OF THE PROPERTY WHICH IS KNOWN AS BRUNO AVENUE, DATED
1986. MR. MILLER CONTINUED BY STATING THAT HE HAD ERECTED THE FENCE IN

ORDER TO KEEP PEOPLE OFF OF THAT SECTION OF PROPERTY FOR LIABILITY
REASONS. MR. MILLER SAID THAT HE HAD TAKEN THE FENCE, WHICH IS
CONTRUCTED OF HEAVY GAUGE CORRAL PANELS AND 1/8 INCH THICK HOLLOW STEEL
PIPE WHICH WAS SET INTO CONCRETE IN THE GROUND. MR. MILLER SAID THAT
THE PANELS THEMSELVES ARE 52 INCHES HIGH BY 16 FEET LONG, AND THE STEEL
POSTS ARE 8 FEET LONG WITH 2 FEET SET INTO THE GROUND IN THE CONCRETE
WITH THE REMAINING 6 FEET STICKING UP OUT OF THE GROUND. MR. MILLER
FURTHER EXPLAINED THAT A NEIGHBOR TO THE SOUTH, THOMAS MITCHELL, HAD
COME OVER WITH TWO OF HIS SONS AND HAD TAKEN THE FENCE PANELS DOWN AND
CUT THE STEEL POSTS AT GROUND LEVEL WITH A CUTTING TORCH. BOTH MR. AND
MRS. MILLER SAID THAT THEY HAD CAPTURED THIS EVENT ON VIDEO TAPE.
I THEN WENT INTO THE BASEMENT OF THE MILLER HOME WHERE THEY SHOWED ME
THE VIDEO TAPE THEY HAD TAKEN OF THOMAS MITCHELL TAKING THE FENCE DOWN.
IN THE VIDEO TAPE, YOU CAN CLEARLY SEE THREE SUBJECTS DOWN AT THE BRUNO
AVENUE LOCATION OF THE FENCE TAKING THE PANELS DOWN AND THE CUTTING THE
STEEL POSTS WITH WHAT APPEARS TO BE SOME TYPE OF A CUTTING TORCH THAT IS
IN THE BED OF A GRAY PICKUP TRUCK. MRS. MILLER STATED THAT SINCE SHE
COULD NOT CLEARLY FOCUS IN ON THE FACES OF THE SUBJECTS FROM WHERE SHE
WAS STANDING INSIDE THE RESIDENCE, SHE WENT OUT INTO THEIR YARD AND
THEIR PASTURE AREA WHERE SHE WAS ABLE TO GET CLOSE ENOUGH TO GET VERY
CLEAR SHOTS OF THOMAS MITCHELL AND HIS SONS. MRS. MILLER WAS EVEN ABLE
TO WALK AROUND THE PICKUP TRUCK TO THE FRONT, SHOWING THAT THERE WAS NO
FRONT GRILL NOR HEADLIGHTS NOR BUMPER, AND THEN TO THE REAR WHERE SHE
WAS ABLE TO PHOTOGRAPH THE LICENSE PLATE WHICH IS COLLECTOR SERIES
05G97. THERE IS EVEN CONVERSATION BETWEEN MRS. MILLER AND SUBJECT
MITCHELL, DURING WHICH TIME MITCHELL MAKES SOME REFERENCE TO MRS.
MILLER'S DAUGHTER IN CALIFORNIA. MRS. MILLER STATES THAT SHE HAS NO
CHILDREN AT ALL IN CALIFORNIA, AND DOES NOT KNOW ANYBODY IN CALIFORNIA.
I DID TAKE THE VIDEO TAPE AS EVIDENCE.
I ALSO WENT OUTSIDE WITH MR. AND MRS. MILLER AND VIEWED THE SECTIONS OF
FENCE THAT HAD BEEN REMOVED AND THE PIPES THAT HAD BEEN CUT. IT DOES
APPEAR THAT SOME TYPE OF A CUTTING TORCH WAS USED TO CUT THE PIPES AT
THE GROUND LEVEL JUST ABOVE THE CEMENT THAT THEY WERE SET INTO. THE
PIPES AND PANELS HAD BEEN THROWN OFF TO THE SIDE BY SUBJECT MITCHELL AND
HIS SONS.
THE MILLERS ALSO SHOWED ME AN AGREEMENT THAT THEY HAD WITH WELD COUNTY
SAYING THAT THEY HAD SOME TYPE OF A LEASE OR AUTHORITY TO USE THAT
SECTION OF BRUNO AVENUE FOR THEIR PRIVATE USE.
DEPUTY VICKI LAEGER, WHO WAS ALSO ON SCENE, AND I ATTEMPTED CONTACT WITH
THOMAS MITCHELL AT HIS RESIDENCE, WITH NEGATIVE CONTACT. THE FRONT
GATE TO THE MITCHELL PROPERTY WAS LOCKED AND THERE WAS NO ANSWER BY
TELEPHONE AT THE MITCHELL RESIDENCE. I DID LEAVE A MESSAGE ON THE
ANSWERING MACHINE AT THE MITCHELL RESIDENCE, AND ALSO LEFT A BUSINESS
CARD TAPED TO THE PADLOCK AT THE FRONT GATE REQUESTING THAT MR. MITCHELL
CONTACT ME OR ANOTHER DEPUTY WORKING THIS AREA REGARDING THIS CASE.
I THEN CLEARED SCENE WITH NO FURTHER ACTION TAKEN THIS DATE.

2 OF THE AFOREMENTIONED AGREEMENT, PARAGRAPH 2 UNDER TYPE OF USE, THAT
PARAGRAPH STATES "THAT PRIVATE USERS MAY USE THAT PORTION OF BRUNO
AVENUE DESCRIBED ABOVE FOR ANY PRIVATE USE, EXCEPT THAT PRIVATE USERS
MAY NOT TAKE ANY DIRT, GRAVEL, SAND, ET CETERA, FROM SAID PORTION OF
BRUNO AVENUE. ADDITIONALLY, PRIVATE USERS MAY NOT PLACE ANY STRUCTURES
OR BUILDINGS UPON SAID PORTION OF BRUNO AV". THE AGREEMENT DOES SPECIFY

ON THIS DATE, AT APPROXIMATELY 1250 HOURS, I DID SPEAK WITH THOMAS
MITCHELL BY TELEPHONE. MR. MITCHELL FULLY ADMITTED TO ME THAT HE HAD
CUT DOWN THE FENCE AND THE REASON BEING THAT, ON FRIDAY, 052695, ONE OF
HIS HORSES HAD GOTTEN OUT AND HAD RUN DOWN TOWARD BRUNO AVENUE. MR.
MITCHELL CONTINUED BY STATING THAT THE HORSE WAS ABLE TO GET THROUGH ON
THE SOUTH SIDE OF THE BARRICADE AND HAD APPARENTLY STEPPED INTO A HOLE
THAT WAS CREATED BY MR. MILLER. THOMAS MITCHELL FURTHER EXPLAINED THAT
WHEN HIS HORSE STEPPED IN THE HOLE, IT IMMEDIATELY TRIED TO FIND THE
QUICKEST WAY OUT AND HIT THE FENCE, WHICH CAUSED IT TO ROLL OVER ONTO
ITS SIDE, CAUSING INJURY. THOMAS MITCHELL ALSO SAID THAT HE WILL BE
FILING A LAWSUIT AGAINST RUSSELL MILLER FOR THE INJURY TO HIS HORSE
CAUSED BY THE FENCE BEING IN PLACE.
THOMAS MITCHELL ALSO SAID THAT RUSSELL MILLER HAS DUG SEVERAL HOLES IN
THAT SECTION OF BRUNO AVENUE WITH A TRACTOR. MR. MITCHELL DESCRIBED THE
HOLES AS BEING FOUR AND FIVE FEET DEEP IN PLACES, AND THAT THAT IN
ITSELF WOULD BE GOING AGAINST THE AGREEMENT BETWEEN THE MILLERS AND THE
COUNTY OF WELD. MR. MITCHELL ALSO FEELS THAT THE HOLES BEING THERE DO
PRESENT A DANGER, NOT ONLY TO ANIMALS BUT TO PEDESTRIAN TRAFFIC THAT
WOULD NOT SEE THE HOLES DUE TO THE OVERGROWTH OF WEEDS ON BRUNO AVENUE.
THOMAS MITCHELL ALSO TOLD ME THAT HE WAS GOING TO GO BACK OUT AND TEAR
DOWN THE FENCE THAT RUSSELL MILLER HAD PUT BACK UP. I ASKED MR.
MITCHELL NOT TO TEAR THE FENCE DOWN AT THIS TIME, FOR FEAR THAT IT WOULD
CAUSE FURTHER PROBLEMS WITH THE MILLERS. I ASKED THAT MR. MITCHELL WAIT
UNTIL WE GET SOME SORT OF A RULING FROM THE COUNTY ATTORNEY'S OFFICE AND
THE WELD COUNTY BOARD OF COMMISSIONERS IN THIS INCIDENT. MR. MITCHELL
SAID THAT HE WOULD BE WILLING TO WAIT ONE WEEK BEFORE GOING DOWN AND
TEARING THE FENCE DOWN AGAIN. MR. MITCHELL ALSO EXPLAINED THAT HE HAD
BEEN AT A MEETING WITH THE COUNTY COMMISSIONERS, THE COUNTY ATTORNEY,
THE DISTRICT ATTORNEY, AND THE WELD COUNTY SHERIFF, REGARDING THE
DISPOSITION OF BRUNO AVENUE. MR. MITCHELL STATES THAT AT THIS MEETING
HE WAS TOLD BY THE SHERIFF AND THE DISTRICT ATTORNEY'S OFFICE THAT HE
AND/OR OTHER NEIGHBORS COULD GO DOWN AND TAKE DOWN THE FENCE THAT HAD

ON 061595, I RESPONDED TO 2510 MATHEWS AVENUE IN THE COUNTRY ESTATES
SUBDIVISION ON A REPORT OF A CRIMINAL MISCHIEF.
I MEET WITH VICTIM MILLER UPON MY ARRIVAL AT THAT LOCATION. VICTIM
MILLER SAID THAT DURING THE NIGHT SOMEBODY HAD TAKEN SOME CORRAL PANELS
HE HAD ERECTED ON THE SOUTH SIDE OF HIS PROPERTY. BORDERING HIS PROPERTY
GOING OVER ONTO BRUNO AVENUE. VICTIM MILLER DOES HAVE A SIGNED
AGREEMENT WITH THE WELD COUNTY +=OR PRIVATE USE OF HALF OF BRUNO AVENUE
THAT BORDERS HIS PROPERTY. VICTIM MILLER SAID THAT THIS IS NOT THE
FIRST TIME THAT THE FENCE HAS BEEN TAKEN DOWN, AND THAT THE LAST TIME IT
WAS TAKEN DOWN IT WAS DONE SO BY A NEIGHBOR TO THE SOUTH WHO IS SUBJECT
THOMAS MITCHELL.
VICTIM MILLER SAID THAT HIS WIFE HAD LEFT FAR WORK Al ABOUT 8:00 LAST
NIGHT, AND WHEN SHE GOT HOME THIS MORNING SHE NOTICED THAT THE FENCE WAS
DOWN AND MISSING. VICTIM MILLER SAID THAT HE HAD TEMPORARILY PUT THE
FENCE BACK UP ON MAY 26TH, WHICH IS THE DATE THAT THE FENCE -WAS CUT DOWN
BY SUBJECT MITCHELL. VICTIM MILLER SAID THAI ALTHOUGH HE HAS NO
POSITIVE PROOF THAT IT WAS SUBJECT MITCHELL INVOLVED, HE DOES BELIEVE
THAT . HE HAS SOME INVOLVEMENT IN IT, DUE TO HIS i AST INVOLVEMENT ON MAY
26TH. WHICH WAS VIDEO TAPED.
I CHECKED THE AREA WHERE THE FENCE HAD BEEN TAKEN FROM, LOCATED DIRECTLY
SOUTH OF VICTIM MILLER'S FENCE LINE. THE FENCE IN QUESTION WAS ATTACHED
TO THE SOUTHERN END OF HIS FENCE. ON H I S SOUTHERN PROPERTY LINE AND
EXTENDING TO A BARRICADE MORE TOWARD THE SOUTH END OF BRUNO AVENUE. I
DID OBSERVE THAT SOME OF THE WEEDS NEAR WHERE THE FENCE HAD BEEN TAKEN
FROM HAD BEEN TRAMPLED DOWN, BUT SINCE THE GROUND WAS HARD PACKED AND
THERE WAS SOME OVERGROWTH OF WEEDS, THERE WERE NO USUABLE SHOE
IMPRESSIONS IN THE AREA. I ALSO CHECKED THE SOUTH DIRT OF THE ROADWAY
ON MATHEWS AVENUE FOR SUSPECT VEHICLE. TIRE IMPRESSIONS, HOWEVER.I WAS
NOT ABLE TO ISOLATE AND TIRE IMPRESSIONS WHICH WOULD BE ATTRIBUTED TO A
SUSPECT VEHICLE.
I EXPLAINED TO MR. MILLER THAT WITHOUT WITNESSES OR ANY DIRECT EVIDENCE
COLLABORATING THOMAS MITCHELL'S INVOLVEMENT, THAT WE WOULD NOT BE ABLE
TO FILE THE APPROPRIATE CHARGES AGAINST MR. MITCHELL.
I THEN RESPONDED TO 2390 MATHEWS AVENUE, AND CONTACTED THOMAS MITCHELL
REGARDING THIS COMPLAINT. MR. MITCHELL. ADVISED ME THAT HE WAS NOT AWARE

NO FURTHER ACTION TAFEN BY THIS OFFICER. I BELIEVE THAT THIS IS ONGOING
NEIGHBORHOOD DISPUTE BETWEEN THE VICTIM AND OTHER NEIGHBORS REGARDING
THE DISPOSITION OF BRUNO AVENUE IN THE COUNTRY ESTATES SUBDIVISION. IT
SHOULD BE NOTED FOR PURPOSES OF THIS REPORT THAT I DID LEARN FROM WELD
COUNTY ATTORNEY BRUCE BARr•ER THAT THE DISPOSITION OF BRUNO AVENUE DOES
GO BEFORE THE COUNTY COMMISSIONERS ON WEDNESDAY. JUNE 28TH 1995. THE

On Wednesday, June 28, 1995 the Board of County Commissioners of Weld County will consider choosing
between two alternatives for Bruno Avenue in the Country Estates Subdivision, Weld County, Colorado.
The first alternative will involve vacating those portions of Bruno Avenue between WCR 33 and Matthews
Avenue and between Tate Avenue and WCR 35. The center portion of Bruno Avenue, between Matthews
Avenue and Tate Avenue, will be closed to motorized vehicles and will be accessible for pedestrians, horses,
and bicycles. That portion of the roadway may be narrowed by vacating 10' to 15' on either side.
The second alternative is to vacate the entire stretch of Bruno Avenue.
Both of these alternatives will involve having the Board of County Commissioners authorize the Department
of Planning Services to proceed with a replat of the Country Estates Subdivision so as to reflect the changes
made to Bruno Avenue.
The Board of County Commissioners will consider this matter on its regular agenda on June 28, 1995 at
9 a.m. You are welcome to attend the Board's meeting to give testimony regarding these two alternatives.
The Board's meeting will take place at the Weld Centennial Center Complex, 915 Tenth Street, Greeley,
Colorado. If you cannot attend the meeting but would like to have the Board consider your thoughts and
concerns relative to this issue, you may send a letter stating those comments and concerns to the Board of
County Commissioners at P.O. Box 758, Greeley, Colorado 80632.

To Whom It May Concern:
Our family owns property on Tate Avenue in Country Estates and is in the process of
moving there. We have three small children, and are aware of the situation with Bruno Avenue.
We attended the meeting held in Fort Lupton on May 9th and we believe that Bruno Avenue
SHOULD be open between Mathews Avenue and Tate Avenue.
We are located on the north section of Tate Avenue. Our daughter has been using
Bruno Avenue as a path for her horse to get to friends' houses on Mathews Avenue. There is no
way that we would ever consider letting her ride her horse (or bicycles for our younger children)
on Road 8, and Road 6 is -too far out of our sight to be letting them use as a crossover road to
Mathews. This area is a country neighborhood. The difference between the city neighborhood
and the country neighborhood as far as our children are concerned is that we do not have
sidewalks to let them safely get to their friends houses. If Bruno Avenue were to be vacated, it
would be comparable to a non -busy city street being closed, and those children having to use
the busy street (with no sidewalk) to get where they are going. :It's just not safe! If Bruno
Avenue was opened for pedestrian, horse, and bicycles only, at:least our children would have a
safe path to get from one road to the other and could still be within our site almost the entire trip.
It is our understanding that Bruno Avenue was created by all land owners giving up a
small piece of their property. It is not logical to equally divide the extra land between all of the
Country Estates if the road is narrowed. That would take a lot of time and be very expensive.
However, it is not fair to the other Country Estates -land owners if the extra land were to be given
to the adjoining land owners along Bruno Avenue. We believe the best solution to this problem
is to leave Bruno Avenue open to pedestrians, horses, and bicycles ONLY, but to leave it the
same width it -is, for everyone to enjoy. Thank you for your time and for hearing our concerns.

OPENING BRUNO AVENUE TO HORSE, BIKE AND PEDESTRIAN TRAVEL WOULD
BE A SATISFACTORY OPTION TO ALL PARTIES. AS FOR NARROWING THE ROADWAY
WE ALSO FEEL THIS IS NOT NECESSARY. THE PARTIES THAT DO NOT WANT THIS
ROADWAY OPEN WILL GET THAT EXTRA 15 FEET ON EITHER SIDE. WE DO NOT
BELIEVE THIS IS A FAIR SPLIT OF THE LAND. IF ANYTHING, LEAVE IT AS AN

Due to the current ILLEGAL closure of Bruno Avenue, when
emergency equipment has been needed, in this area, the time of
arrival for the fire trucks and ambulances, to reach: the scene of
the emergency, was delayed approximately five (5) minutes.
Should the county choose to vacate Bruno Avenue, we the
property owners, feel that the risk of fire loss will be greatly
increased, and the value of our property and homes will decrease.
We could also be facing a substantial increase on our homeowners
fire insurance.
To avoid such a potential loss to all of the property owners,
in Country Estates Subdivision, the county shall, at it's expense,
compensate them with:
(1) Cash value, for 3.75' x 1150', (approximately 1/10 of an
acre, per property) located on either side of Bruno
Avenue.
(2) re -survey this subdivision.
(3) relocate all property Jiite fences to new survey stakes.
(4) re-imburse all property owners for increase or fire
insurance.
(5) re-imburse all property owners, for that portion of

In the past few months, Barry Kramer and I have received a number of telephone calls from residents
living in the Country Estates subdivision regarding the status of Bruno Avenue. Country Estates
subdivision is located between Weld County Roads 6 and 8, east of WCR 35. The subdivision
encompasses the entire area of Section 23, Township 1 North, Range 66 West of the 6th P.M., Weld
County, Colorado. Bruno Avenue is an east and west street which bisects the subdivision. A copy
of the map showing the location of the subdivision is attached. Also attached is a copy of the plat
map showing the subdivision, including Bruno Avenue.
Bruno Avenue has a long and controversial past. The roadway has never been accepted for
maintenance by Weld County. Prior to August, 1985, the avenue existed primarily as a dirt tract
and was used by horseback riders, kids on motorcycles and ATV's, bicyclists, and pedestrians. A
meeting of the Board of County Commissioners regarding the use of Bruno Avenue was held on
August 28, 1985. All of the owners of lots within the subdivision were noticed and had the
opportunity to attend. The hearing was designed to have the Board determine if there was a desire
to vacate Bruno Avenue. The Board decided at the hearing to close the roadway and encourage
agreements between Weld County and adjacent landowners for their private use of those portions
of Bruno Avenue adjacent to their properties. A copy of the Board's Resolution is attached.
Agreements with five of the seven adjacent landowners were approved by the Board in 1986. A
copy of the agreement with Russell and Judith Miller is attached.
The agreements with the adjacent landowners allow them to put the right-of-way to "any private
use." The landowners cannot, however, take dirt, gravel, or sand from the right-of-way or place
structures or buildings thereon. The agreements were non-transferrable and could be revoked by the
Board at any time. Barricades were placed at either end of Bruno after the Board made its decision
in August, 1985.
Since 1985 there have been two items of correspondence received by the Board regarding Bruno
Avenue. A letter dated May 27, 1992 was received from Stan Gembol, complaining about a
proposed driveway -type use of Bruno Avenue by Kevin Kozba. A copy of that letter is attached.
The second letter was dated September 23, 1993 from Tom and Cheryl Mitchell. Their letter
complained about the firearm activities of Russell Miller. A copy of the Mitchells' letter is also
attached. I can find no correspondence responding to either of these letters. I recall, however,
speaking by telephone with Mrs. Mitchell. It was my understanding that she was waiting for a
response from the Sheriffs Office and that she fully intended to pursue a criminal complaint against

Mr. Miller. I checked with the Records Department and found only one incident report involving
Mr. Miller, that being from November, 1994. A copy of the incident report is attached.
As of this date, only one of the five original adjacent landowners who signed the agreement is still
residing in the subdivision (the Millers). In January, 1989 the Nesters transferred ownership of their
lot to the Lahayes and a new agreement was executed between the Lahayes and the County.
Therefore, the Millers' and the Lahayes' agreements are the only ones which are still in effect.
By memo dated December 28, 1994 George Cicoff recommended that Bruno Avenue be vacated.
It may only be vacated through the resubdivision process set forth in the Weld County Subdivision
Ordinance. I believe that each Commissioner has already received a copy of George's memo.
I recommend that the Board schedule a special meeting at which time it can hear desires of the
neighbors regarding whether the Board should start the resubdivision process to vacate Bruno Ave.
