RESOLUTION RE: ACTION OF BOARD CONCERNING RECONSIDERATION OF, IN LIGHT OF ADOPTION OF WELD COUNTY ORDINANCE NO. 89-FF, DEVELOPMENT STANDARD #17 FOR SPECIAL REVIEW PERMIT #1105 FOR A SHOOTING RANGE (SHOTGUN SPORTS GUN CLUB AND PRO SHOP) IN THE A (AGRICULTURAL) ZONE DISTRICT - GREAT GUNS (GREG REEVES AND PATTY DEPLAZES) WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated February 21, 1996, the Board of County Commissioners approved the application of Great Guns (Greg Reeves and Patty Deplazes), 16058 Weld County Road 96, P.O. Box 142, Pierce, Colorado 80650, for a Site Specific Development Plan and Special Review Permit#1105 for a shooting range (shotgun sports gun club and pro shop) in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the NW'/ of Section 11, Township 8 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, Development Standard #17 of said Permit, as approved, reads as follows: The Special Review Permit is issued for a period of five years. After the completion of five years, the Permit shall be reviewed every five years thereafter and may be revoked if a substantial change has occurred regarding compatibility with surrounding land uses. Revocation proceedings shall follow the procedures set forth in the Weld County Zoning Ordinance. The applicants can request reconsideration of this Standard within 30 days of final approval by the Board of amendment of Section 45.3.1 of the Weld County Zoning Ordinance without the requirement of additional fees. WHEREAS, Section 45.3.1 of the Weld County Zoning Ordinance was amended by the adoption of Weld County Ordinance No. 89-FF on May 29, 1996, which became effective on June 11, 1996, and WHEREAS, on July 10, 1996, at 10:00 a.m., the Board reconsidered, in light of adoption of Weld County Ordinance No. 89-FF, Development Standard #17 for Special Review Permit#1105 for a shooting range (shotgun sports gun club and pro shop) in the A (Agricultural) Zone District at the request of said applicant, Patty Deplazes, who was present at said hearing, and 961190 CC : /L ; NL , z 7Qa(-runs PL.1021 DEVELOPMENT STANDARD#17 FOR USR#1105-GREAT GUNS (REEVES AND DEPLAZES) PAGE 2 WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request to amend Development Standard #17 shall be approved and said Development Standard shall read as follows: This Permit shall be conditioned on a requirement that every ten (10) years the safety of the design of the range shall be reviewed and safety design changed taking into account the history of the operation and changes in surrounding land uses and the relevant provisions of§ § 45.3.2.2, 45.3.3.2-45.3.3.6, and 45.3.4. Review of the safety plan shall be accomplished using the Site Plan Review Process and such changes shall not constitute a major change from the Special Review Permit. The operator, if he chooses not to accept the staff determination under the Site Plan Review process, may request that the matter be determined by the Board of County Commissioners who shall hear the matter in accordance with the procedures for considering a Special Review Permit provided, however, that no fee shall be charged. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request of Great Guns (Greg Reeves and Patty Deplazes) to reconsider, in light of the adoption of Weld County Ordinance No. 89-FF, Development Standard #17 for Special Review Permit#1105 for a shooting range (shotgun sports gun club and pro shop) in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, approved subject to the above stated language.
