RE: APPROVE AGREEMENT CONCERNING PURCHASE OF PROPERTY FOR
IMPROVEMENTS AT THE INTERSECTION OF WELD COUNTY ROAD 77, AT STATE
HIGHWAY 14 AND WELD COUNTY ROAD 392 AND AUTHORIZE CHAIR TO SIGN -
GILLILAND
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Agreement concerning the Purchase
of Property for improvements at the intersection of Weld County Road 77, at State Highway 14
and Weld County Road 392 between the County of Weld, State of Colorado, by and through the
Board of County Commissioners of Weld County, on behalf of the Public Works Department,
and Wayne and Joyce Gilliland, 38535 Highway 14, Briggsdale, Colorado 80611, with terms
and conditions being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said agreement, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Agreement concerning the Purchase of Property for
improvements at the intersection of Weld County Road 77 at State Highway 14 and Weld
County Road 392 between the County of Weld, State of Colorado, by and through the Board of
County Commissioners of Weld County, on behalf of the Public Works Department, and Wayne
and Joyce Gilliland, 38535 Highway 14, Briggsdale, Colorado 80611, be, and hereby is,
approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said agreement.

AGREEMENT
CONCERNING PURCHASE OF PROPERTY FOR CERTAIN IMPROVEMENTS AT THE
INTERSECTION OF WELD COUNTY ROAD (WCR) 77, AT STATE HIGHWAY 14 AND WCR 392
BETWEEN WAYNE H. GILLILAND AND JOYCE C. GILLILAND AND WELD COUNTY, COLORADO
THIS AGREEMENT is made this day of 3i-, ,1998 by and between Wayne H.
Gilliland and Joyce C. Gilliland,as tenants in common, whose address is 38535 Hwy. 14, Briggsdale, Colorado
80611, hereinafter referred to collectively as "Owners," and the County of Weld, a body corporate and politic of
the State of Colorado, by and through its Board of County Commissioners, hereinafter referred to as "County."
WITNESSETH:
WHEREAS, County finds it necessary to realign,rebuild, and improve the intersection of WCR 77 at State
Highway 14 and WCR 392, which is Weld County Project No. , and
WHEREAS, Owners own the property described in the attached as Parcel "1" and Parcel "2", and
WHEREAS, County needs the right-of-way in order to complete said rebuilding and improvement project,
and
WHEREAS, Owners wish to cooperate with County in said project.
NOW, THEREFORE, the parties herein agree as follows:
1. Owners agree to sell and County agrees to purchase the right-of-way shown and/or described as
Parcel "1" and Parcel "2", attached hereto and hereinafter referred to herein as the "Right-of-Way"
for the sum of twenty-five hundred dollars ( $2500.00).
2. Owners agree to grant the Right-of-Way to County by Deed of Dedication.
3. County agrees to pay the costs of title insurance and recording fees, if necessary as determined by
County.
4. The parties hereby agree that neither has made or authorized any agreement with respect to the
subject matter of this instrument other than expressly set forth herein, and no oral representation,
promise, or consideration different from the terms herein contained shall be binding on either party,
or its agents or employees, hereto. This Agreement to Purchase Right-of-Way on WCR 77 is
between Wayne H. and Joyce C. Gilliland, and is not intended for the benefit of any other third
party.

5. Agreement embodies all agreements between the parties hereto and there are no promises, terms,
conditions, or obligations referring to the subject matter whereof other than as contained herein.
6. Although the date of the transfer of the Property shall be the date of the delivery of the documents
of conveyance, it is expressly agreed by the parties hereto that upon execution of this Agreement by
County and Owners, County, its contractors, agents, employees, and all others deemed necessary by
County shall have the irrevocable right to possess and use all of the Right-of-Way for the purpose
of realignment, constructing, widening, and improvement of a portion of said intersection of WCR
77, at State Highway 14 and WCR 392.
7. General taxes for the year 1998 for the Property shall be apportioned to the date of delivery of the
Deed of Dedication based on the most recent levy and the most recent assessment. Owner represents
and warrants that all general taxes levied prior to such year have been paid in full by Owner.
8. County agrees to install a new barb wire fence on both sides of the new road alignment at no cost
to owners.
9. One access will be installed to the newly created parcel along the west side of the new road
alignment, to be furnished by County expense.
10. Other:
IT IS MUTUALLY AGREED that the terms and conditions of this Agreement shall extend to and be
binding upon the heirs, executors, administrators, successors, and assigns of the respective parties hereto.

A description of a severed tract of land lying West of the realigned right-of-way of Weld County
Road No. 77 to be conveyed to the U.S. Forest Service. For: Weld County Department of Public
Works. This description revises one dated June 15, 1998.
LEGAL DESCRIPTION
A tract of land located in the SW1/4 of Section 21, T8N, R62W of the 6th P.M., County of
Weld, State of Colorado, described as follows:
COMMENCING at the Southwest Corner of said Section 21, from which the S1/4 Corner of said
Section 21 bears N90°00'00"E, 2647.91 feet (Basis of Bearing), thence N90°00'00"E, 655.59
feet along the South Line of the SW1/4 of said Section 21; Thence NOO°27'03"E, 50.00 feet to
the North Right-of-way Line of State Highway No. 14 conveyed to Weld County, Colorado, as
described in Right-of-way Deed recorded May 3, 1939, in Book 1041 at Page 471 of the records
of Weld County, Colorado; Thence continuing NOO°27'03"E, 118.66 feet to a point of curve to
the left; Thence Northwesterly, 749.47 feet along the arc of said curve to a point tangent, said
arc having a radius of 1382.39 feet, a central angle of 31 °03'47", and being subtended by a
chord that bears N15°04'50"W, 740.32 feet; Thence N30°36'44"W, 439.26 feet to a point of
curve to the right; Thence Northwesterly, 124.36 feet along the arc of said curve to the TRUE
POINT OF BFCINNING, said arc having a radius of 1482.39 feet, a central angle of 04°48'24",
and being subtended by a chord that bears N28°12'32"W, 124.32 feet;
Thence continuing Northwesterly, 383.40 feet along the arc of said curve to the West Line of
the SW1/4 of said Section 21, said arc having a radius of 1482.39 feet, a central angle of
14°49'08", and being subtended by a chord that bears N18°23'47"W, 382.34 feet;
Thence S02°01'16"W, 428.72 feet along the West Line of the SW1/4 of said Section 21 to a
point on a line from which the True Point of Beginning bears N64°11'39"E;
Thence N64°11'39"E, 150.82 feet to the TRUE POINT OF RFGINNINft.
Area = 0.584 acres, more or less.
