BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
SEPTEMBER 16, 1996

The Board of County Commissioners of Weld County, Colorado, met in regular
session in full conformity with the laws of the State of Colorado at the regular
place of meeting in the Weld County Centennial Center, Greeley, Colorado,
September 16, 1996, at the hour of 9:00 a.m.
ROLL CALL: The meeting was called to order by the Chair and on roll call the following
members were present, constituting a quorum of the members thereof:
Commissioner Barbara J. Kirkmeyer, Chair
Commissioner George E. Baxter, Pro-Tem - TARDY
Commissioner Dale K. Hall
Commissioner Constance L. Harbert
Commissioner W. H. Webster

MINUTES: Commissioner Harbert moved to approve the minutes of the Board of County
Commissioners meeting of September 11, 1996, as printed. Commissioner Hall
seconded the motion, and it carried unanimously.
CERTIFICATION
OF HEARINGS: Commissioner Harbert moved to approve the hearings conducted on
September 11, 1996, as follows: 1)Special Review Permit for an agricultural
service establishment (equestrian center and ranch) in the A (Agricultural) Zone
District, Don and Linda Owens (Planner Goranson); 2) Second Amended
Special Review Permit for a wet sand and gravel mining operation in the
A (Agricultural) Zone District, Western Mobile Northern (Planner Eastin); and 3)
Special Review Permit for a railcar maintenance and repair facility to include
railcar inspection, maintenance, cleaning, dismantling, storage, and surface
coating in the A (Agricultural) Zone District, Rescar Industries, Inc.
(Planner Hodges). Commissioner Webster seconded the motion, which carried
unanimously.

ADDITIONS: There were no additions to the agenda.
CONSENT AGENDA: Commissioner Harbert moved to approve the consent agenda as printed.
Commissioner Hall seconded the motion, and it carried unanimously.
READING OF
ORDINANCES
BY TAPE: FIRST READING OF ORDINANCE NO. 147-J: Commissioner Hall moved to
allow the first reading of said ordinance by tape. Commissioner Harbert
seconded the motion, which carried unanimously.
EMERGENCY ORDINANCE NO. 186-A: Commissioner Webster moved to
allow the first reading of said ordinance by tape. Commissioner Harbert
seconded the motion, which carried unanimously.

REPORTS: No reports were given.
PUBLIC INPUT: No public input was offered.
WARRANTS: Don Warden, Director of Finance and Administration, presented the following
warrants for approval by the Board:
All Funds $ 464,388.40
Commissioner Baxter moved to approve the warrants as presented by Mr.
Warden. Commissioner Webster seconded the motion, which carried
unanimously.
BUSINESS:
NEW: CONSIDER INSTALLATION OF TRAFFIC CONTROL DEVICES AT WELD
COUNTY ROAD 27.5 (AKA 77TH AVENUE) AND WELD COUNTY ROAD 52
(AKA 49TH STREET): Commissioner Hall explained staff recommends the
existing stop signs on Weld County Road 27.5, which is being paved, be moved
to stop traffic on Weld County Road 52, which will remain gravel. Commissioner
Hall then moved to approve said installation, and Commissioner Baxter
seconded the motion, which carried unanimously.
CONSIDER TEMPORARY CLOSURE OF WELD COUNTY ROAD 40
BETWEEN WELD COUNTY ROADS 41 AND 43: Commissioner Hall moved to
approve said closure. The motion was seconded by Commissioner Harbert, and
it carried unanimously.

CONSIDER INTERGOVERNMENTAL AGREEMENT FOR ACTIVATION OF
OUTDOOR WARNING SYSTEM WITH CITY OF EVANS AND CITY OF
GREELEY AND AUTHORIZE CHAIR TO SIGN: Bruce Barker, County Attorney,
stated the warning system is for tornados and/or other natural disasters. He
noted the Weld County Regional Communications Center has agreed to activate
the siren on the City of Evan's behalf and referenced Paragraph 3 indemnifying
the City of Greeley and Weld County. Mr. Barker noted a typographical error
in the last paragraph on Page 1 of said agreement and recommended approval.
Commissioner Baxter moved to approve said agreement and authorize the
Chair to sign. Commissioner Harbert seconded the motion, which carried
unanimously.
CONSIDER RESOLUTION RE: ENDORSING THE ANALYSIS OF NORTH
FRONT RANGE TRANSPORTATION OPTIONS: Chair Kirkmeyer noted this
resolution was passed around to the Board and concerns a rail feasibility study
for northern Colorado's Front Range. Commissioner Harbert moved to approve
said resolution, and Commissioner Webster seconded the motion, which carried
unanimously.
CONSIDER EMERGENCY ORDINANCE NO. 186-A, IN MATTER OF A
SUPPLEMENTAL APPROPRIATION FOR THE YEAR 1996: Mr. Warden
explained this ordinance will reappropriate certain monies and transfer funding
for the jail construction. Commissioner Harbert moved to approve Ordinance
No. 186-A on an emergency basis, and Commissioner Webster seconded the
motion. No public testimony was offered, and Mr. Warden confirmed there are
usually two supplemental appropriations necessary each year. The motion then
carried unanimously.
PLANNING: FIRST READING OF ORDINANCE NO. 147-J, IN MATTER OF REPEAL AND
RE-ENACTMENT OF CERTAIN PORTIONS OF ORDINANCE NO. 147,
COMPREHENSIVE PLAN ORDINANCE: Monica Mika and Kerri Keithley,
Planning Department representatives, were present. Ms. Mika explained this
amendment changes the Comprehensive Plan from conceptual to structural and
includes other suggested corrections. No public testimony was offered. Ms.
Mika confirmed the maps reflect the change requested by Leo Schuster,
President of Progressive Living Structures, Inc., and noted the Planning
Commission's recommendation for approval. Responding to further questions
from the Board, Ms. Mika stated the first four chapters of the plan were mailed
to various entities and she spoke with other individuals; however, there was not
a lot of public participation. She clarified this amendment is just schematic
changes and regulatory changes will come before the Board in November,
which is when more public input will be necessary. After further comments from
the Board, Commissioner Hall moved to approve Ordinance No. 147-J on first
reading, and Commissioner Harbert seconded the motion, which carried
unanimously.

RESOLUTIONS AND
ORDINANCES: The resolutions were presented and signed as listed on the consent agenda.
Ordinance No. 186-A was approved on an emergency basis, and Ordinance
No. 147-J was approved on first reading.
Let the minutes reflect that the above and foregoing actions were attested to
and respectfully submitted by the Acting Clerk to the Board.
There being no further business, this meeting was adjourned at 9:15 a.m.
