RE: CLOSURE OF WELD COUNTY ROAD 97, BETWEEN WELD COUNTY ROADS 52
AND 62, FOR AN INDEFINITE PERIOD; CESSATION OF MAINTENANCE DUTIES
THEREON; AND AUTHORIZATION FOR BRET SIRIOS TO PERFORM EMERGENCY
MEASURES ON THE RIGHT-OF-WAY OF SAID STRETCH OF WELD COUNTY
ROAD 97 WITH THE INTENTION OF REDUCING DIRT BLOWING ONTO PROPERTIES
LOCATED EAST THEREOF
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, pursuant to Section 42-4-106(6)(a), C.R.S., "...local authorities, within their
respective jurisdiction may, for the purpose of road construction and maintenance, temporarily
close to through traffic or to all vehicular traffic any highway or portion thereof for a period not to
exceed a specified number of work days for project completion...", and
WHEREAS, by Resolution dated March 20, 1996, the Board temporarily closed the Weld
County half ofWeld County Road 97, between Weld County Roads 52 and 74, because the
roadway had been inundated with blown dirt from properties located in Sections 12, 13, 21 - 28,
Township 5 North, Range 61 West of the 6th P.M., Weld County, Colorado, until such time as the
roadway could be reopened, and
WHEREAS, the dirt blowing has continued making the roadway between Weld County
Road 52 and Weld County Road 62 impassable and therefore unable to be reopened, and
WHEREAS, Mr. Bret Sirios, the operator of the properties mentioned above, has agreed
to perform certain remedial emergency measures on the right-of-way of said stretch of Weld
County Road 97 in an attempt to reduce the dirt blowing from said properties to other properties
located to the east thereof, and
WHEREAS, the Board now deems it advisable to extend the closure of the Weld County
half of said stretch of Weld County Road 97 for an indefinite period, to cease maintenance activities
thereon, and to authorize the entry of Mr. Sirios onto said stretch of Weld County Road 97 for the
purpose of performing said remedial emergency measures, and
WHEREAS, the Board has verbally agreed with the Board of County Commissioners of
Morgan County to said closure, non-maintenance, and authorization, with the understanding that
both Boards will pass resolutions approving the same during the week of June 10, 1996.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the closure of Weld County's half of Weld County Road 97, between Weld
County Roads 52 and 62, to vehicular traffic, be, and hereby is, extended for an indefinite period
of time in order to protect the safety of the general public, and that Weld County Public Works
Department maintenance crews are directed to refrain from performing regular maintenance
thereon until the roadway is reopened.
BE IT FURTHER RESOLVED that traffic control devices warning the public that the
roadway is closed shall be erected in such a manner as to conform to the Federal Manual on
Uniform Traffic Control Devices and coordinated with identical devices erected by Morgan County
for its half of said roadway.
BE IT FURTHER RESOLVED that Mr. Bret Sirios be, and hereby is, authorized to perform
those remedial emergency measures on the right-of-way of said stretch of Weld County Road 97
which he and the-landowner to the east thereof deem necessary for the purpose of reducing dirt
blowing from properties located in Sections 12, 13, 21 -28, Township 5 North, Range 61 West onto
properties located to the east thereof. Such authorization is made with the understanding that Mr.
Sirios' performance of such work is not covered by Weld County's workers' compensation
insurance for personal•injuries to himself which he may incur as the result of said work.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 10th day of June, A.D., 1996.

Dear Barbara,
Our board unanimously approved Resolution 96 BCC 33 today. This is the resolution that is for
a road closure on the Morgan/Weld county line. Since this is a jointly owned road we thought it
would be appropriate to forward this resolution.
We are of the understanding that your board took action on this item yesterday and will sign a
resolution tomorrow. Would you please forward us a copy of the resolution when executed.
We appreciate your cooperation in addressing this problem and hopefully the farmer will be able
to stop his land from blowing.
