RE: ACTION OF BOARD CONCERNING REQUEST OF VARIOUS LANDOWNERS TO
RECONSIDER RESOLUTION DIRECTING STAFF TO PROCEED WITH REPLAT AND
VACATION OF BRUNO AVENUE, COUNTRY ESTATES SUBDIVISION, WELD COUNTY,
COLORADO
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on June 28, 1995, at 9:00 a.m., the Board considered two alternatives for
Bruno Avenue in the Country Estates Subdivision, Weld County, Colorado, and, by Resolution of
the Board, determined that Bruno Avenue shall be vacated subject to replat of both the Second and
Third Filings of Country Estates Subdivision, Weld County, Colorado, to reflect the changes made
to Bruno Avenue; and directed the Department of Planning Services staff to prepare and process
an application for replat and to prepare the Quit Claim Deeds and/or other documents as needed
to return the right-of-way to the appropriate adjoining landowners in accordance with the replats,
and
WHEREAS, on August 21, 1995, at 9:00 a.m., the Board considered the request of various
landowners to reconsider said Resolution of June 28, 1995, directing staff to proceed with the replat
and vacation, and
WHEREAS, the Board of County Commissioners heard all of the testimony and statements
of those present, studied the recommendations of the Weld County Attorney's Office and the Weld
County Public Works Department and all of the exhibits and evidence presented in this matter and,
having been fully informed, finds that Bruno Avenue shall be vacated; the Department of Planning
Services shall proceed with the replat of both the Second and Third Filings of Country Estates
Subdivision, Weld County, Colorado, to reflect the changes made to Bruno Avenue; and staff shall
be directed to process the appropriate Quit Claim Deeds, etc. to return the right-of-way to the
appropriate adjoining landowners in accordance with the replats.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Bruno Avenue shall be vacated subject to replat of both the Second and
Third Filings of Country Estates Subdivision, Weld County, Colorado, to reflect the changes made
to Bruno Avenue; and the Department of Planning Services staff be, and hereby is, directed to
prepare and process an application for replat and that the Quit Claim Deeds and/or other
documents be prepared as needed to return the right-of-way to the appropriate adjoining
landowners in accordance with the replats.

RE: Bruno Avenue
On June 28, 1995, the Board of County Commissioners of Weld County, Colorado directed the
Department of Planning Services and County Attorney's staff to prepare and process an
application for the replat of both the second and third filings of Country Estates Subdivision,
Weld County, Colorado. The replat would vacate the entire stretch of Bruno Avenue. A copy of
the Resolution is enclosed.
On July 10, 1995, the Board of County Commissioners received a petition type letter from
various landowners in the Country Estates Subdivision, stating that the various landowners desire
to see Bruno Avenue, between Matthews Avenue and Tate Avenue, remain as a pedestrian, bike
and horse trail. The landowners further advise the Board of County Commissioners that they are
willing to volunteer their time to keep the road smooth, trash free and the weeds mowed. They
desire to see no motorized vehicles on the roadway, except for maintenance vehicles. A copy of
their letter is enclosed.
On Tuesday, July 18, 1995, the Board of County Commissioners directed staff to place the
landowners' request on the Board of County Commissioners agenda for a possible change in the
direction given by Resolution to staff on June 28. 1995_ The Board further directed that the
meeting be scheduled far enough in advance so that all persons will have ample time to make
arrangements to attend.
Please be advised that on August 21. 1995, at 9:00 a.m., the Board of County Commissioners of
Weld County. Colorado, will consider the request as submitted by the various landowners who
have signed the enclosed letter, and possibly reconsider the Board's Resolution of June 28. 1995,
directing staff to proceed with a replat and vacation of Bruno Avenue. You may attend the
meeting to give any testimony or other evidence to the Board of County Commissioners
regarding this issue. The Board's meeting will take place at 9:00 a.m. on August 21, 1995, in the

Attached is a copy of a petition -type letter which was presented to the Board of County
Commissioners on Monday, July 10, 1995 by Steven Steerman. As you can see, the individuals who
have signed the letter desire for Bruno Avenue, between Mathews Avenue and Tate Avenue, to
remain as "a pedestrian, bike and horse trail." They are agreeing to maintain the trail.
On June 28, 1995 the Board of County Commissioners, by resolution, directed staff to work toward
the vacation of the entirety of Bruno Avenue. Mr. Steerman is aware of the Board's June 28, 1995
action. He desires to have the Board of County Commissioners reconsider.
Although I applaud those individuals who have signed the letter and are thereby volunteering to
maintain the right-of-way if it is kept as a trail, I am concerned about the long-term viability of such
a volunteer arrangement. The landowners who have signed the letter may be very enthusiastic about
maintaining the trail initially, but in later years after many of these residents have moved I question
who will be responsible for coordinating the volunteer effort. It is my opinion that an agreement
with these residents will not be enforceable against the successors in ownership of their properties.
Any agreement will be without consideration on the part of the Board of County Commissioners.
Agreements without the exchange of consideration are normally considered to be void.
Please consider the letter and let us know whether the Board desires to change its direction set forth
in the Resolution and now direct staff to replat the roadway such that the trail is created between
Mathews and Tate Avenues.

On June 28, 1995, the board passed a resolution -directing staff to vacate Bruno
avenue. On July 10, 1995, Steven-Steerman presented to the board a petition -type
letter. Individuals who signed the letter agreed to maintain Bruno Avenue as a
trail.

The board agreed to
reconsider the matte '-'4 Hearing notices will
be mailed along with an explanation of why it is being reconsidered. Meanwhile,

Re: Country Estates Subdivision
-Bruno Avenue Closure
Dear Weld County Commissioners:
I -am sure that you are aware of the numerous complaints
-and problems surrounding Bruno Avenue which is located in the
Country Estates Subdivision. As a landowner of one of the
eight lots adjoining Bruno Avenue,I would like to address the
long and disputed history of this street. We are the only
property owner remaining of the original six property owners
whom petitioned the Board of County Commissioners in 1984
requesting the closure of Bruno Avenue for private use. The
1984 petition cited teen parking, trash dumping, and unauthorized
trespassing to facilitate release of livestock as the primary
reasons for requesting the private use agreements to allow
fencing of the Bruno Avenue area. -Three of the new landowners
-currently have Bruno Avenue space fenced into thier properties
with no agreement with the county or other authority to do so.
During this entire dispute over access to Bruno Avenue not one
of these fences has ever been disturbed. The portion of
Bruno Avenue between Mathews Avenue and Weld Co Rd 33 which is
not used as a common driveway was simply fenced closed by the
original property owners prior to my residence in this area
in 1983. To the best of my knowledge, the landowners simply
placed a fence across the right of way beyond their building
areas and assumed this land into their properties. This
closure was never challenged by anyone, either resident or
county agency. Although I currently have an agreement with
the county for private use of this area granted in 1985, my
fence has been repeatedly cut and removed, the front windows
of my home have been _broken, and we have been continually
harassed by trespassers. Myself, my husband, and my son have
also been subjected to verbal abuse from persons using the
Bruno Avenue right of way. Those persons, who may not be
inclined to shout obscenities from a public roadway, certainly
felt free to do so when in a more restricted "non-public"
area.
I feel it would be of great interest for the county
agencies involved in this issue to review some of the code
violation citations issued by Weld County Planning Services
for this area earlier this year. Many of the persons agreeing
to maintain the -Bruno Avenue area were among those cited for
various code violations on their properties. My concern, as
an adjacent landowner who has been this route before, is how

effective can these same people be when agreeing to maintain
an area which is not located on or near thier property. Who
will assume the responsibility to maintain this area once the
newness wears off and the area becomes just vacant space again?
Which agency will be responsible to enforce the maintenance
for this area when the volunteers decide they no longer wish
to perform these duties? Moreover, where will the responsibility
lie in the enforcement o₹ nonmotorized vehicle use? I am
continually required to gather household trash from around my
house and barn area which is constantly blown onto my property
from 2570 Mathews Avenue, owned by Steven and Lori Steerman.
Many persons moving to this area believe they are moving
to the "country" and are therefore permitted to allow their
dogs to run free if they choose. Bruno Avenue , when unfenced,
serves as a primary travel route for the numerous large dogs
allowed to run the neighborhood each night after dark. These
animals create much commotion when they are around or on my
property. They have also created a large number of unwanted
offspring.
Due to my unwillingness to give in to the bully tactics
by one party in this development, this issue has continued
to escalate to unprecedented proportions causing much
frustration for several county departments and creating much
animosity among the neighboring residents. Prior to the arrival
_of this bully, the residents had a live and let live attitude
through out the subdivision. I no longer feel safe or
protected in my own home as I once did. I now leave my
outdoor lights on for fear of vandalism. I hesitate and
am fearful when going to check my livestock after dark. This
situation has begun to take a toll on my personal mental and
physical health.
Until this bully decided he desired access to Bruno Avenue
for an ATV freeway and took it upon himself to remove my
fence repeatedly, this area went completely unnoticed by any
of the other residents for nearly ten years. The sudden
desire to open a bike path between Mathews Avenue and Tate
Avenue came only after the Board of County Commissioners
resolved to vacate Bruno Avenue. Many of the residents
signing this letter of intent to maintain the area are
fearful that they may not get their "fair share" of the
vacated area. Review of the filing maps will show that many
of these first filing properties are some of the largest in
the subdivision. I would also like to know how the county
agency responsible for the building of the proposed bike
path proposes to restrict the entry areas to allow mowing
machines but restrict other motorized vehicles, ie: ATVs
small cars or trucks. The expressed desire to retain the
entire 80 feet seems somewhat ridiculous when Mathews Avenue
was plated for 60 feet. I have personally never witnessed
any bike path or horse trail which required more than eight
to ten feet.

I feel the only way to bring final closure to this issue
for both the residents of Country Estates Subdivision and
the governing bodies of Weld County is to adhere to the decision
made by the Board of County Commissioners on June 28, 1995
to vacate the entire length of Bruno Avenue. I feel that the
Landowners in this subdivision are too divided on too many
issues to ever have any hope of having a property _owners
association which could effectively enforce any code violations
which may occur. This should be apparent by the great number
of hours spent by the Sheriff's department, the Planning
department, and the Board of County Commissioners. Many of
tthe residents in this subdivision do not Irish to become
involved in these issues but wish to remain an island unto
themselves and certainly have no desire to become part of
or support a homeowners association.

My name isDeanie Stengel. I -am currently a resident of Country Estates
and live at 2330 Mathews Avenue. I am proud to speak on behalf of -the
landowners and children of Country Estates who desire seeing Brano
Avenue between Mathews Avenue and Tate Avenue open as a
pedestrian, bike and horse trail.
Again, as stated in our letter type petition of July 10, 1995, we remain
voluntarily willing anti able to -maintain the width and length of this area,
smooth, trash free and keep -the weeds mowed. Our intent is to
maintain this area toauthorized personsand vehicles (which would only
consist of -motorized maintenance vehicles) and to -eport any
unauthorized activity to the proper countyauthorities ina civilized adult -
like manner. In order to help prevent unauthorized -motor vehicles from
entering this area, we would like to request, from the county, proper
postage of the necessary signage be put in place on both ends of this
designated area. In addition, posting of proper times in which people
would be permitted lobe in this area without violation, perhaps hours
between and clown Virould be permitted,but this couldbe left at the
counties discretion.

On July 1'8, 1995 approximately 12 adults and roughly 1-0-12 children
walked the entire stretch of this area. It was -evident that in order to
make -the road safe and _usable -2 ditches (1 at Mathews -Avenue and 1
approximately 1,1-00 feet directly -east) need tote filled in with dirt (each
are approximately FO feet wide), a fence on the south side of this area
needs to be moved inward to its' proper lot line (from Mathews -Avenue
to approximately 1,100 feel directly east),the weeds need to be mowed,
but the road virtually was -free of trash except for a large piece of
corrugated fiberglass which clearly was identified as belonging 10 the
landowner directly North of this area. Unless this landowner has a
specific use forthis pieceoi fiberglass, we intend ontiaulingthisdebris
away.
Several neighborhood children have been riding their horses through
this area and have teen instructed by their parents to pick-up any and
all trash they might see and are able to carry and bring it home for
proper disposal.
'fir seems to be some confusion as to the reverse of the Special
Permits that were issued to the landowners several years ago. It was
said -to one of the landownersty the county attorney, that if either of the
landowners sold theirproperties, the Special Permit would no longer be

valid and this area would revert back to the county for their purposes.
This should have occurred on September 23, 1993 which was when the
property at 2450 Mathews Avenue sold. The landowners should have
been notified -they no longer had a special permit in effect. There are
individuals present, who can attest -to the original platting of Country
Estates. They were made aware, the area in question was mandated by
the county as an access between Mathews Avenue and Tate Avenue
known as Bruno Avenue. We question and aredeeply concerned by the
consideration of the Weld County Officials lo reverse the mandate at
this time.
Dueto theblind hill, heavy semi-trucks,tankertrucks and general traffic
traveling atatiigh rate of speed down Road 8, and the distance of one
and a half extra miles to be traveled -down to Road B in order to gain
access onto Tate Avenue or Mathews -Avenue, places our children and
ourselves in unnecessary danger. Not only for -this -reason, but totave
this area serve as a -community pedestrian, bike path and horse tail
would be an excellent fire break in case of grass tires. This in turn
would protect our homes and investment and would be within zoning

I just have a few points to bring up concerning the
proposed "bike path". First of all, the whole idea of having
a bike path in Country Estates is pretty much of a joke
because I can tell you from first hand experience -that it's
not safe for kids to ride bikes on the street on account of
all the unrestrained dogs that run out and try to bite
them. This -has been an ongoing problem in the
neighborhood and it doesn't appear to be a problem that's
going -to go away anytime soon.
Secondly, the reason Bruno Ave. was closed down in the
first place is because of the problems causer' by people
being inconsiderate and disrespectful of others. Perhaps
if Bruno Ave. were made into on official bike path, the
unsavory behaviours of -the past would change overnight,
but considering the behaviour exhibited in just the past
two months, I reallythinkthat keeping Bruno open will
only cause more problems -For the adjoining property
owners and the county law -enforcement officers.

The last point I'd like to bring up is -that the real
underlying motivebehindthe petition to -keep Bruno open
is not a sincere desire to have a bike path, but only a
way of keeping alive the neighborhood feud -that's been
going on for some time now. If the people who signed the
petition to keep Bruno open were really that concerned
about a bike path, why did not one of them show up for
the meeting on June28th? Three families cared enough
about fiavmg Bruno closed to show up at -that meeting.
can guarantee you that not one of the landowners in
Country Estates would willingly give up 7 tentis ion
acre of their land so n handful of people could use it as a
bike path.
If the county has plenty of money to -throw around, I have
a couple of suggestions for a better use of it than an
ill -planned, unneeded bike path. For one, -the gymnasium
floor at Hudson Elementary is in dire need of repairs and
if the county still has extra money, the recent property
tax -hikes could be repealed.

We have purchased the property at: Block 1, Lot 6 of Country Estates Subdivision, and
are preparing to build our home on that parcel of land very soon.
It is with great concern that we write to you of our opposition of a proposed bike trail on
what is known as Bruno Ave. We are opposed to any area bordered by Matthews Ave.,
Road 6 and Road 8 being usedas a bike or ATV recreational trail, at this or any other
time.
We were attracted to this property for the -Equine fellowship, and the peace and quiet of
a rural setting. The proposed bike trail could perhaps attractan element of motorized
vehicles not in accordance with the reason we and others who already live in the area,
chose to do so. There are no guarantees these vehicles won't find there way onto Tate
Ave., disturbing the ruralatomosphere we desire. Other concerns include, this activity
could leave the area to ruin, and degrade the natural beauty. The safety and
enjoyment of riding horses in the area could also be endangered, motorized
recreational vehicles, bicycles, and horses do not mix.
It is also understood that the present tax format would not support-suchan an
endeavor, and really, how well could volunteers uphold and maintain such activities
when in reality it -pits neighbor against neighbor? How long are a handful of people
willing to police the area, for thebenefitaf just a few, who after they get tired of having
gotten their way at the expense of others, wouldn'tabandon the areaanyway.
Please, we respectfully ask that -the Board reconsider, and vacate this proposal.
