RESOLUTION RE: REFERRAL TO DISTRICT ATTORNEY FOR REVIEW OF POSSIBLE LEGAL ACTION FOR CRIMINAL VIOLATION AND AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST VARIOUS INDIVIDUALS FOR VIOLATION OF THE WELD COUNTY SUBDIVISION ORDINANCE AND C.R.S. § 30-28-110, IF NECESSARY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, John and Laura Underhill, Judy Rider, Maria Lara, Desri Stolz and Michael Murray, VI #9800050, are allegedly in violation of the Weld County Subdivision Ordinance and C.R.S. § 30-28-110, by subdividing properties in Weld County with the resulting lot(s) being less than 35 acres in size, without first obtaining approval of said subdividing by Weld County, and WHEREAS, on the 12th day of May, 1998, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, the Board deems it advisable to refer this matter to the District Attorney for the 19th Judicial District for a review of legal action for possible criminal violation(s) and authorize the Weld County Attorney to proceed with legal action against the above named individuals for violation(s) of the Weld County Subdivision Ordinance and C.R.S. § 30-28-110, if, in his opinion, it is necessary to do so in order to enforce the provisions of said Ordinance and said State statute . NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that VI #9800050 against John and Laura Underhill, Judy Rider, Maria Lara, Desri Stolz and Michael Murray, and any other persons acting in active concert with the identified parties be, and hereby are, referred to the District Attorney for the 19th Judicial District for review of possible legal action for criminal violation(s) against said subdividers of the properties. The complaint was assigned to the undersigned investigator and entered into our permanent record. As part of our investigative process, a copy of the complaint has been sent to the licensee with a request for a written response. The Real Estate Commission's jurisdiction is limited to the license law and the imposition of discipline against licensees where violations of license law are proven or admitted. The Commission has no jurisdiction with regard to Civil Action claims (e.g.: money damages), or authority to settle contractual disputes. If appropriate, you may wish to discuss the possibility of filing a civil action in this matter with an attorney. If your claim is under $5,000 you may consider filing in small claims court. Your efforts through the courts can run concurrent with any action this office may take. Complaints involving an immediate threat to the public (e.g.: theft, conversion of funds) are given the highest priority. Other types of complaints are generally handled in chronological order, based on the date that they were filed with the Commission. Apparently,Desri's seller and his realtor guided this transaction. With Seller's guidance, Dean(properly and prudery)sought and obtained a building permit prior to closing. Then Desri unwittingly closed Then she built her S120,000 house. Now,upon requesting a permit to add a garage,she discovers the problem. She complains to the Seller. Seller offers to sell her the remainder of Lob B.but she has no money and no use for the land. Meanwhile,the Seller apparently has conveyed another chunk of Lot B to another Buyer. I have requested(copy enclosed for your reference)the Seller take corrective action,but have no reply. It seems that all three owners of Lot B hold useless property. Litigation will be almost unavoidable unless one buys out the other two or Lot B is subdivided, I inquire: 1.
