A regular meeting of the Weld County Planning Commission was held February 4, 1997, in the County
Commissioners' Hearing Room (Room #101), Weld County Centennial Building, 915 10th Street, Greeley,

The summary of the last regular meeting of the Weld County Planning Commission held on January 21, 1997,
was approved as read.

REQUEST: Intergovernmental Agreement between Frederick, Firestone, and Dacono
Lee Morrison presented a summary of the Interim Coordinated Planning Agreement. Mr. Morrison explained
that under Colorado law, agreements such as this are authorized between various jurisdictions. The
agreement has been negotiated over an extended period of time with the participation of the three
municipalities and Weld County. The concept of the agreement is to pull together various jurisdictions' planning
processes, so that their approach is a matter of coordination rather than competition. One objective is to
accomplish the types of development which best protect the health, safety, prosperity, and general welfare of
the inhabitants by reducing the waste of financial and human resources which result from either excessive
congestion or excessive scattering of population. Another objective is to achieve maximum efficiency and
economy in the process of development. The agreement is interim in the sense that there will be a plan for the
area developed over the next year by the planning staffs involved in the agreement.
Mr. Morrison explained there is a three mile planning area around the municipalities as a whole, a smaller area
called an Urban Growth Area for each of the municipalities, and a small area of overlap. Within the Urban
Growth Area (the area closest to the municipalities), it is anticipated and encouraged that urban type
development occur in order to have the greatest efficiency of services. Non -urban uses are encouraged in the
areas far removed from the municipalities. Urban uses are those that require sewer services. This covers
most types of land use considerations that the Planning Commission hears. Smaller developments, such as
Recorded Exemptions, would not be effected by this agreement, while Subdivisions or Planned Unit
Developments in this area would be effected.
The land use plan that is anticipated to be created will hopefully have land use standards that are consistent
among the four jurisdictions in this area. Procedures for coordination have been established and will continue
to be addressed between the jurisdictions.
Mr. Morrison explained that referrals, which the County has always had to do, will now be reciprocal for
municipal developments within 500 feet of the edge of all of the towns.

When someone proposes to the County a development within one of the Urban Growth Areas, the County will
encourage an annexation to the municipality. By discussing and agreeing in advance where each
municipality's Urban Growth Area should be, the municipalities are agreeing to not get into annexation wars.
Except in certain unique circumstances, they are agreeing not to exercise all of their annexation powers.
There are other provisions regarding annexations to ensure one jurisdiction does not get saddled with the
burden of another jurisdiction's approval of a development. There is also a requirement that the weight a Board
gives to someone's testimony should be equal regardless of which jurisdiction they live in.
Mr. Morrison explained that, if adopted, this will be the second agreement the County has entered in to. The
first agreement was with Platteville.
Monica Daniels -Mika explained she felt an important issue to acknowledge is that a lot of staff time (not just
the Department of Planning Services' staff time) went into creating this agreement. It took approximately two
years to create with the help of the staffs of Frederick, Firestone, and Dacono, representatives from the
Colorado Division of Local Affairs and the Weld County Commissioners, and several citizens. The most recent
meeting held was on January 14, 1997, and was attended by all but one of the Weld County Commissioners,
representatives of the elected officials from Frederick, Firestone, and Dacono, and several citizens who voiced
a concern or interest in the past. Lee Morrison went through a similar presentation at that time and explained
the agreement.
In order to make sure this is something people are aware of, the Department of Planning Services' staff issued
a press release to the usual entities. In addition, records have been kept of interested citizens, and they were
also notified by letter of today's meeting. Both the press release and the notification letter contained the dates
and location of the readings before the Board of Weld County Commissioners. Ms. Daniels -Mika informed the
Planning Commission Members that the first reading will be on February 19, 1997, the second will be on March
10, 1997, and the final will be on March 24, 1997. All readings will be at 9:00 a.m. in the County
Commissioners' Hearing Room (Room #101), Weld County Centennial Building, 915 10th Street, Greeley,
Colorado.
Cristie Nicklas asked if the Dacono-Erie 1-25 Corridor Growth Area has been agreed to by the three
municipalities, or just Dacono and Erie. Lee Morrison stated that it is between Dacono and Erie.
Gristle Nicklas asked how that will effect the Intergovernmental Agreement and how it will effect Weld County.
Mr. Morrison stated that it will not effect the Intergovernmental Agreement because it is not part of the
agreement and will not effect Weld County as it is between Dacono and Erie.
Fred Walker asked about Mr. Morrison's definition of the Urban Growth Area, and whether he had stated "not
all of the land within the three mile perimeter of the communities is actually part of the Urban Growth Area".
Mr. Morrison stated that is what was said. The three mile area is larger than the urban growth area in some
directions.
Fred Walker asked Mr. Morrison about referral protocol and why the municipalities have until the Thursday
prior to a Board meeting to respond, rather than only the standard twenty-one day review period. Lee Morrison
stated that municipalities have timing problems that require more time due to part-time staffing and only having
two Board meetings per month.
Marie Koolstra asked if this agreement could have the effect of creating more restrictive enforcement of the
County policies, therefore chasing prospective developers to other counties. Mr. Morrison stated that the goal
is not to prevent development, but to encourage quality development.

Cristie Nickles asked if there is any development conflict with the overlap into the Mixed Use Development
(MUD) area and the Urban Growth Boundaries. Monica Daniels -Mika stated that the Department of Planning
Services' staff is proposing that when development occurs in the overlap areas, the standards from the MUD
Ordinance will be used. The next step in this process is to bring all the players to the table and choose a
baseline for standards in this area. It will be decided how compatible the MUD standards are with each of the
various municipal standards.
Arlan Marrs asked what factors are considered "to achieve maximum efficiency and economy" as stated in the
Purposes and Objectives section. Lee Morrison stated that the factors considered are the public sector
services that have to be expanded when growth occurs.
Mr. Marrs asked if the property rights of the property owner are addressed anywhere in the agreement. Monica
Daniels -Mika responded that the rights are addressed in Section 4.4.
Fred Walker asked if an estate -type subdivision (2.5 acre lots) is considered an urban or non -urban
development. Monica Daniels -Mika stated that it is currently defined as a non -intense urban use, but does fit
in the rural area if there are the attributes available to support it.
Mr. Walker stated that he is concerned that Weld County is saying to the individuals in the Urban Growth Area
that if they can't get annexed, they still won't get County approval. Lee Morrison responded that in the Urban
Growth Area, non -urban type uses are discouraged. The County is not precluded from hearing an urban
development proposal in an Urban Growth Area if the municipality is not interested in the annexation. Mr.
Morrison reiterated that existing land uses are not effected and Recorded Exemptions are not effected. Non -
urban uses in Urban Growth Areas are discouraged, but only if it is a new non -urban use. If someone wanted
to do an urban type development in an urban area and came to the County, the County would direct them to
the municipality. If the municipality wouldn't hear the request, then the County would process the application.
Mr. Morrison explained that people's property rights cannot be taken away, but the case law would not support
the view that people are entitled to be in a certain jurisdiction. The property right ties to the use of the land, and
if the only economic use of the land is an urban type development, either the County or the appropriate
municipality will have to consider that and make an appropriate decision.
Mr.Walker again questioned the estate -type development now allowed in Weld County, and whether Monica
Daniels -Mika stated it is considered non -urban development. Ms. Daniels -Mika stated that currently a
subdivision would be a non -urban development, but she feels that under this agreement, because more than
three parcels would be created, it would not fall under the exemption of non -urban. It would then be urban.
Mr. Walker stated that he feels this would take value from the property owner - value they have today that they
will not have once the agreement is signed. Therefore, the agreement is holding this area to a higher standard
than the rest of the County. Jack Epple commented that the scenario Mr. Walker was using stressed facilities
and services which in the past have pushed the growth to the Urban Growth Area. Finding a developer would
be difficult because they have to meet Weld County's regulations. Mr. Epple feels that instead, the land owner
would want to go to the nearest municipality first. Mr. Walker stated he didn't feel this was an unlikely scenario
because many people are drawn to an urban setting in order to live in a less populated area. He stated that
there is a demand for this type of development in an Urban Growth Area. Lee Morrison stated that the
agreement does not specifically address this scenario, only characteristics. In the non -urban development
definition, a cluster -type development is specifically not to be considered urban. It doesn't say all estate zoning
would or would not be allowed in the non -urban area under this agreement. Mr. Morrison stated you have to
look at the attributes to see if it is really an urban or a rural development. Monica Daniels -Mika stated that
instead of the zoning of the property, the actual intensity should be looked at.
Man Marrs stated that the Urban Growth Area line on the map is somewhat arbitrarily drawn in that property
owners on one side of the line are entitled to do one thing, while those on the other side are not.

Monica Daniels -Mika responded that the officials from Frederick, Firestone and Dacono spent a lot of time
analyzing whether or not they had the ability to provide services in various areas where the topography would
preclude development. The towns feel that they can provide services inside those areas, or will be able to in
the future. Mr. Marrs stated that he felt that Ms. Daniels-Mika's response was from the County's or a
municipality's point of view. He questioned what rights are being taken or given to the land owner. Specifically,
he questioned what would be said to a property owner who had two pieces of property - one that could be
developed and one that could not. Ms. Daniels -Mika stated that if the property carried the attributes for
development, then development is more of a probability.
Lee Morrison stated that this a plan, not zoning. The plan can be modified by agreement of the parties. The
lines in question could be modified over the course of discussion during the next year. However, property
owners do not have a vested right in the possibility of a future development. Property owners have a property
interest in being allowed an economic use of their property.
Fred Walker stated that he feels the property owners are being precluded from the opportunity to upgrade or
upzone their property. Mr. Morrison stated that there will still be the opportunity to upzone to other types of
uses that are still non -urban. Mr. Walker stated he was referring to urban development. Mr. Morrison stated
that Mr. Walker was jumping back and forth over the line between development outside and inside Urban
Growth Areas.
Marie Koolstra stated that there has to be some sort of master plan, even though some people will feel cheated.
She is concerned however, that the County will be held to a higher standard in the proposed area. Lee
Morrison stated that the plan that is anticipated by the agreement is not done, but the planning staffs have
looked at those issues. He doesn't know whether the standards are higher or lower, only that they are different.
Monica Daniels -Mika stated that the Weld County Comprehensive Plan talks about the need for
intergovernmental agreements, urban growth boundaries, and efficient land development. It lists why one
would want to enter into an agreement and the best tools for doing it. Ms. Daniels -Mika stated there has been
a lot of philosophical discussion in this meeting as to whether this is a good thing, but this is the direction the
Comprehensive Plan gave to us three years ago in order to make municipalities and the County regionally
responsible for what is done in an area. The big picture is that this region in question is developing at an
incredibly fast pace and there has to be some type of relationship between the various government entities.
This is the first step to agree that we're going to agree to go some place. Many of the issues brought up that
some Planning Commission Members are uncomfortable with are currently being done in land use.
There was discussion about whether the one-half mile urban growth boundary had been changed to a three
mile boundary area. Monica Daniels -Mika stated the three mile boundary discussed in the agreement refers
to the outside area of the municipal boundaries; there is still a one-half mile urban growth boundary inside the
area.
Shirley Camenisch asked if all of the towns have signed the agreement. Don Sandoval stated all three of the
towns have signed the agreement and are waiting for it to go through the County process. Mr. Sandoval
explained the municipality annexation process. He also wanted to acknowledge that there has been a lot of
work done and time spent on this project.
Jack Epple moved that the Interim Coordinated Planning Agreement be forwarded to the Board of County
Commissioners with Planning Commission's recommendation for approval. Shirley Camenisch seconded the
motion.
Arlan Marrs stated that in the past the Planning Commission Members have passed things along to the Board
of County Commissioners with the idea that the Commissioners would take care of it during the three readings.
Mr. Marrs stated that he would like to see the Planning Commission take the initiative to send an agreement
that they truly believe in and agree on to the Board of County Commissioners.

RESOLUTION OF RECOMMENDATION TO THE BOARD OF COUNTY COMMISSIONERS
Moved by Jack Epple that the following resolution be introduced for passage by the Weld County Planning
Commission. Be it resolved by the Weld County Planning Commission that the proposed Intergovernmental
Agreement between Frederick, Firestone and Dacono be recommended favorably to the Board of County
Commissioners.

NOTES on UGA Agreement
PURPOSE
to establish procedures and standards pursuant to which the parties will move toward
greater coordination in the exercise of their land use and related regulatory powers
within the unincorporated areas surrounding each MUNICIPALITY. The objectives of
such efforts are to accomplish the types of development in such areas which best
protect the health, safety, prosperity, and general welfare of the inhabitants thereof by
reducing the waste of physical, financial, and human resources which result from either
excessive congestion or excessive scattering of population, and to achieve maximum
efficiency and economy in the process of development.

Development. Any land use requiring requlatory approval by the elected governing

plat or a down -zoning, neither of which creates any itional lots and except for a

DEVELOPMENT OF SOUTHERN WELD AREA LAND USE PLAN. (i) specific land use
standards for each MUNICIPALITY's Urban Growth Area (ii) procedures for COUNTY
coordination with each MUNICIPALITY in the review and approval process for proposed
Development, and (iii) procedures and guidelines relating to the annexation of lands
Mutuality of Impact Consideration
Referrals to County. within 500 feet of any property in unincorporated Weld County, to
the COUNTY for its review and recommendation. Reciprocal w/the municipalities
COUNTY Development approvals in the Southern Weld Planning Area will be
processed and determined in accordance with the following during development of plan:
Protocol for referral
4.1 Referral. The COUNTY will refer all proposals for Development within the
Southern Weld Planning area to all three MUNICIPALITIES for their review and
recommendations.
MUNICIPALITY'S objection COUNTY will not approve unless, in the COUNTY's
judgment, (i) such conflict or incompatibility is unlikely to occur, (ii) that suitable
mitigation measures to be imposed by the COUNTY as conditions of approval will
eliminate or adequately mitigate adverse consequences of incompatibility or conflict, or
(iii) the MUNICIPALITY'S anticipated zoning classification of the property is
unreasonable because of existing uses of adjacent property.
Development Outside Urban Growth Area. To the extent
legally possible pursuant to the Plan and the COUNTY's land use regulations as
described in Section 3.2, the COUNTY will disapprove all proposals for Urban
Development3 in areas of the Southern Weld Planning Area outside the Urban
Growth Area.
This places emphasis on non -urban uses in the area outside of urban growth
area4
Development in Urban Growth Area. COUNTY will, in writing,
notify the proponent of the opportunity for annexation and notify each such
MUNICIPALITY of the proposal.

Das a condition of approval of any rezoning, planned unit development, subdivision, or
use by special review for any commercial or industrial use pursuant to §31.4A 8 of the
Weld County Zoning Ordinance #89, as amended or renumbered (Exhibit A), the
COUNTY shall require that there be executed annexation agreement between the
applicant and the MUNICIPALITY which requires the owners to annex the property
to the MUNICIPALITY upon the terms and conditions and within the time stated in the
agreement. No such agreement shall be required in the case of a recorded exemption,
subdivision exemption, or use by special review for oil and gas wells.
Municipalities represent availablity and willingness to provide utilities within
UGA.

SUBJECT: Intergovernmental Agreement for Frederick, Firestone, and
Dacono
We have recently received a revised agreement from Tami Tanoue, Attorney for Firestone and
Dacono. While this agreement is continually evolving, several issues remain unanswered.
1. What role, if any, will the Tri-Area Planning Commission play in the future? .
2. What design standards in any particular area will be employed to determine street design
and infrastructure standards?
3. What type of funding is needed to complete the plan and who will pay? Will funding be
available from the State in a timely fashion?
4. What is the goal of the plan and what will be included in this plan?
5. Have the Towns reviewed their Comprehensive Plans to ensure compatibility with each
other and the County's Comprehensive and MUD plans?
We both concur that this agreement has been developed on the premise that the towns will
respond to referrals in a consistent fashion, thereby speaking in harmony. We continue to be
concerned about this assumption and would like some assurance from the towns that this is
what they intend. Because the UGB areas are considerably smaller than originally presented to
the Board there have been compromises, however the proposed UGB area continues to be
quite extensive, with overlapping jurisdictions between Frederick and Firestone. Because the
form of the agreement was originally developed in conjunction with only one jurisdiction, the
terms deal with issues between each municipality and the County and to a lesser extent
between municipalities.
There is still some confusion concerning which of the three, if any, of the municipalities has the
ultimate authority in the referral process. For example, if Firestone recommends approval for a
land use and Frederick recommends denial, what is the County to do? The County is agreeing
to encourage annexation of urban uses into a municipality but, in the event of an overlap, the
appropriate municipality is not designated nor is there a process to resolve the conflict.
Additionally, the version proposed by the new agreement gives the municipalities the option to
not make a recommendation prior to the County Planning Commission meeting and submit a
recommendation directly to the Board of County Commissioners. This may be looked upon as
a way to decrease the authority of the Planning Commission.
Several terms and definitions need to be refined to make this a precise and cohesive document
The proposed IGA stipulates an increase of additional tasks for the Department of Planning
Services' staff, and a basic awareness of this is needed. The IGA requests written notification
concerning land use cases which do not incorporate town responses and reasons for making a
contrary decision, as well as requests notification, in witting, to all three municipalities when the
Department is approached by a developer in a situation which involves a potential annexation.
Some of the specific concerns are as follows:
§ 2.1 "Development" should exclude those items that are residential but do not create additional
lots.
§ 2.3 The County has never reviewed and signed off on the municipalities' non -urban growth
area which are inside the three mile radius around all the municipalities but outside the UGA.
The Tanoue version adds standards for the County to follow in this area (§ 3.2.)
The concept of "adjacent or near or contiguous" is a problem in relation to what is an acceptable
annexation or triggers the need for referral to the County. These terms need to be cleared up.
The discussion of compatibility could possibly be simplified by stating that the jurisdiction which
is the source of neighborly 33concern should be irrelevant to considerations of compatibility (§4.5.)
Note that the Tanoue version provides for annexing outside of the UGA "for commercial or
industrial development that would have a significant economic benefit to the municipality." J
Should the Board wish for more detailed explanations of our concern, we recommend a work
session to obtain the particulars of each Section of the IGA.

Dear Ms. Symington:
The Environmental Protection Services Division of the Weld County Health
Department has reviewed the proposal for the View Point Estates Subdivision,
dated December 14, 1995. The Division recommends disapproval for such a
development for the following reasons:
1) Developments of this density (1 home per 3/4 acre) are likely to impact
shallow aquifers. It is likely that this development is located in the
South Platte alluvium, which means that the soils are extremely porous.
The effluent which will be discharged for the septic systems serving these
units will be concentrated due to the density of the homes. This will not
allow for adequate dilution and attenuation of the effluent causing an
impairment to shallow groundwater on the downgradient side of this
subdivision.
2) The average life of a septic system is approximately 20 years. The lots
would be fully developed when and if the septic system were in need of
replacement. A lot size of 3/4 acre would inhibit the ability to install
a replacement system. In addition, the application materials indicate
that the proposed homes will be approximately 1800 square feet each,
further constricting area which may be necessary for a replacement system.
3) The subdivision may be near a community sewer line. In accordance with
Section 3.12 of the Weld County Individual Sewage Disposal System
Regulations our Department cannot issue a permit to "repair or replace an
individual sewage disposal system...if a community sewer is within 400
feet of the applicant's dwelling, place of business, or institution; and
if the municipality or district agrees to provide sewer service."
The Division would reconsider this recommendation in regard to item #1, if
provided engineering data demonstrating the soil stratigraphy to the static
groundwater level, or 15 feet, which ever is less. It should be noted that the

Division would have no comments if this subdivision were to connect to the
community sewer system.

residents of this area, It will bring out. that the Ii:Gr-1 only addresses a future
effort: to agree on standards_. of developrren and a notification process between
interested parties of future developement, but not an agreement. on specific
areas of political control.
Notice was published this week of a public- hearing before the Hoard of County
Commissioners relating to a request for change of coning for a. parcel of land
located on the south side of WCR 22 between the 12.5 frontage road and WCR11.
What makes this. parcel of particular interest in that it lies within the Urban
Frederick AND Growth Area (Comprehensive Plan) of both Firestone and �-,._cer�ci<: �`i D within the
County's !Mixed Use Developement (MUD) area, In other words, there are three
different government entities looking to developement this parcel as a. part of
their growth area.
The purpose of the ICPA is "to establish procedures and standards pursuant to
.
which the parties (Firestone, Freder≥ck, I)e.+:;cnno and Weld County) will move
toward greater coordination in the exercise of their land use and related
regulatory powers s within unincorporated atec areas surrounding each MUNICIPALITY"
Iwith:n parentheses, mine, The ICPA does not provide for regulating into rr;at
areas the parties can expand so that a sensible and efficient pattern of r-ontoi
and administration will result. As property owners seek annexation or zoning
for ad.tuat developement such as the one here ;.ender- consideration they have a
choice of three government entities to which they may apply in order to best
suit their purposes. This may well lead to the unfortunate result of a
checkerboard pattern of control by the municipalities and the county that is
both inefficent and detrimental to the inhabitants of the area.. As a worst case
scenario one might drive along a mile of WCR22 proceeding from County through
Firestone and then Frederick and back into County control within that mile if
land owners sought rnrrnic.i.pa1 annexation or county zoning for developement in
that manner.
Of course, those parcels developed within county control could eventually opt
to be annexed into Firestone or Frederick thus reducing the checkerboard to two
players, but this is unrealistically sanguine. Tire main consideration of the
property owners will continue to be their own interests (not sa.l.d derogatorily)
not the general welfare of the area. Additionally, it is my understanding that
Firestone and . r ercler nc:4:: are presently negotiating to remove the overlapping of
their planning areas, but based on past experience, the actural agreement should
be effected before making this a consideration.
Again,,.;...,�.e ICGA itself is not an accomplished tart, It still most be approved
by the four planning commissions, the three boards of trust::ees or city council
and the board of c:cuunty commissioners before it ..s in effect; changes of any
one of which will requ.i.re renegotiation and repetition of the approval process.
In addition, the ICGA is an interim agreement., which :i.≤:s in effect an agreement
of purposes and objectives only, with the important nuts and bolts of the many
details of coordinated planting, Some contentious, to be abreed on, to oe
optimistic, at a later date..
Further, no provision is made for narticipati,ori of Mead, Erie and, most
importantly, Longmont, lurking on the borders of this tempting area with the
real possibility of their- annexing and imposing their own standards and
procedures.
In summation, if and when passed, the i:CGA may well set the tone for the
subsequent uniform and hopefully sensible, both socially and economically,
standards of developement ror our local area.. It is to be braced that the
purpose of this interim agreement (ICGA) is not: only to give the impressi.rn o
progress:; being made towards agreement on the detaile=d standards of
developement. And even if all this is accomplished, and we have an area with
uniform developement standards and design, the perhaps more important issues
and consequences of ill planned, chaotic, checkerboard government
jurisdictions may well remain.

I have expressed my concerns to you before at the MUD hearings,
and at the IGA hearings.
The boundaries of these two entities overlap and comprise roughly
an area 20 miles long and 20 miles wide. I have watched both the county
and the municipalities work in this area over the last several years.

I see the municipalities in a virtual land grab over who can annex
the most land. (For example, Frederick has annexed the property to
the north of our place for 200 homes, yet we are approximately 8 miles
from the city center of Frederick).
I've watched the county approve nearly everything that comes before
them in the form of a PUD. (As long as a PUD is completed correctly --
it will pass, and developers know this. PUD's however, take very little
if any consideration for an agricultural process that is already in place)
Neither the MUD or IGA opts for any open space or division of
municipalities. (Open space might also be in the form of developmental
rights, or purchasing farms outright).
When I brought this issue before you on the first reading of the IGA,
little if any response was given % . 'his article in the Longmont
Times Call (dated February 27, 1• yid respond indicating that the
county is not in a position to buy open space, nor does it have the financ,
That bothers me in that I do know Weld County has received over
11 million dollars in lottery money since the lottery begin in 1983.
These monies come into the county under the Conservation Trust Fund
and are separate from any monies that come from grants from GOCO.

In talking last week with David Metsch at the Divison of Local
Government which dispurses these funds; he informed me that Weld County's
breakdown of this $11 million comes to $2,879,344.07; and the City of
Greeley has received $4,8 `, 0.12 since the lottery begin. (See enclosed
breakdown sheet of funds`. hese funds can go to either municipalities or
countys.
In looking further into these amounts, I've found that a good 80% or
more of the County's funds has gone to Island Grove Park, and roughly 10%
to Missle Site Park; whereas the majority of the$4.9 million that Greeley
obtained has gone to the Senior/Rec Center. It appears to me at this
point that perhaps some of the County's allocation of these funds could
be directed our way in the form of developmental rights or open space
in this MUD/IGA area. (Isn't Island Grove under the City of Greeley's
operation?)
The City of Longmont is studying the possibility of buying the
Sandstone Ranch at some 3 million. This ranch is in Weld County along
Highway 119 in the MUD area, ..,but they want a buffer between them.
The Municipal Annexation Act of 1965 refers to municipalaties growth
keeping directly adjacent to their city centers - but these MUD & IGA
agreements do not.comply.
True, there is more dollars from developed areas rather than
agriculture. You've claimed Weld is the top agriculture county in the
State - of which I agree, but I just don't understand these concepts you'\
allowed in this area. If something is not done soon, it will be a develoj
delight; and our land will be gone forever. We need•to preserve and
protect our heritage and feel that the MUD & IGA proposals do not allow
us to do so.

In general, the interim agree-
ment calls for the parties to "plan for
and regulate the development and use
of land within their respectivejurisdic-
tions." The agreement defines vari-

In Baton Rouge Rouge, Louisi-
ana, HUD auditors found only one
homeless person among the 43 ten-
ants it reviewed. Expensive cars were
parked in front of houses that con-

of the group's director. One tenant
earned $58,000 a year and paid no
ous types of development and speci-

between Weld County Roads 22 and
20, and 13 and 7.
It was also noted in two meet-
ings last week —the IGA meeting on
Wednesday and the MUD meeting
on Thursday — that the proposed
Urban Growth Boundaries of both
Firestone and Frederick overlap with
Weld County's proposed Mixed Use
Development (MUD) area that cen-
ters on and spreads out from Del
Camino at the intersection of I-25 and
Highway 119 (WCR 24).
The proposed interim agreement
also calls for referrals among the par-
ties when one or the other is consider-
ing development within the concerned
area. The agreement also specifies
the types of development that may
take place within the various lines of
jurisdiction.
The agreement also notes the
existence of people and property no
within but adjacent to areas that may
be developed by some of the partie
to agreement. Section 4.4 of the in
terim agreement, headed "Mutuality
of Impact Consideration," states the
following:
"The parties recognize that deci-
sions by one party regarding develop-
ment may impact property outside of
each particular jurisdiction. The par
tics agree that those jurisdictiona,
boundaries will not be the basis fm
giving any greater or lesser weight It
those impacts during the course of
deliberations."

welcomed the byways in 1991. But
funding is always short when
gravel roads need repairs, rest
areas need to be built or signs
needs to be placed, Williams said.
The Pawnee Pioneer Trails also
receives grants from lottery rev-
enue. Improvements such as an
education center and campground
have been added, Williams said.
"Maybe within five years, we'll
have a full-fledged rest area
there."
Taking steps toward open space
preservation, county officials
have applied for state grants to
fund upgrades to park land. The
county received a $45,000 Great
Outdoors Colorado grant to fund
work at Missile Park. "Hopefully
that will be created as part of a
trail head for Poudre River
Trail," Hall said.
Additionally, county officials
have applied for a $40,000 open
space grant to fund an expansion
of Barbour Ponds. The request
was not high on the state's priority
list, however, Hall said.
For the first time ever, the
county will budget for open space
and parks. In 1998, the county will
have $125,000 budgeted for those
activities, Hall said.
"As a county, we're probably in
the fledgling stage of an open
space plan," Hall said. Before
(the adoption of the Del Camino/I-
25 Mixed Use Development Plan),
open space was something some-
one else did."
But one of the problems is tar-
geting future desirable open space
areas. "We're still an agricultural
county. People have the fear,
when you say 'open space,' it
means returning it to prairie,"
Hall said.
Private property owners don't
want to see their rights to develop
their land stripped away by a
comprehensive plan marking
their land as open space.
"We have to be very sensitive to
private property owners," he said.
"We're still a long ways away
from getting any resolve."
WASI :
Daily, Kaiser -Hill Co. called
for bidders who can ship, treat
and dispose of low-level rad-
wastes and mixed wastes from
Rocky Flats.
Kaiser -Hill is the company
hired by the U,S. Department
of Energy to manage the weap-
ons site's cleanup.
No such disposal site exists
in the state today. But an of-
ficial with the Colorado De-
partment of Public Health and
Environment, which would
issue a license, said represen-
tatives of both Kaiser -Hill and
Highway 36 Land Development
explained the proposal last
month to residents near the
site, which lies west of Last
Chance, a crossroads hamlet
on U.S. 36 at Colorado 71.
