HomeMy WebLinkAbout951830.tiffRESOLUTION RE: APPROVE MOBILE HOME PERMITS #1969, #1970, #1971, AND #1972 - BUSKER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 16th day of August, 1995, considered the request of Busker Dairy, do Scott and Susan Busker, 7678 Weld County Road 17, Fort Lupton, Colorado 80621, for four accessory structures to farm, and WHEREAS, said structures are to be occupied in an A (Agricultural) Zone District on a parcel of land being more particularly described as follows: Located in Section 28, Township 2 North, Range 67 West of the 6th P.M., Weld County, Colorado WHEREAS, at said hearing on August 16, 1995, the Board deemed it advisable to continue said matter to August 30, 1995, and WHEREAS, at said hearing on August 30, 1995, the Board of County Commissioners, having heard the testimony, finds that said request should be granted subject to the following conditions: 1. The applicant shall apply for a building permit for each mobile home prior to locating the mobile home on the property. 2. Prior to the occupancy of the mobile homes, the mobile homes shall be connected to an approved septic system and a legal water supply. 3. The mobile homes shall not be occupied until such time that the applicant has complied with Conditions 1 and 2 above. 4. Access to the mobile homes shall be by the existing access. 5. The mobile homes as accessories to farm are temporary. The mobile homes shall be removed upon cessation of use of mobile homes as accessories to farm. The Department of Planning Services staff has reviewed this request and recommends that the request be approved for the following reasons: WILL WILL NOT X Be compatible with the Weld County Comprehensive Plan. COMMENTS: The Department of Planning Services' staff recommendation for approval is conditional upon the following: 1. Div. of Water Resources 8/14/95) Upon speaking with John Schurer at the Division of Water Resources I was informed that at the time of the notification by Weld County Dept. of Planning Services he was informed that there would be 4 mobile homes added to the existing 2 and the total herd was 450 cows. Based in the information the dairy was in compliance with the annual 23.8 acre feet appropriation as determined by the State Div. of Water Resources. That usage is determined by number of cows times 35 gal. per day usage times 365 days a year and divided by 325851 ;E gal. peracre foot: There is an additional 1/3 to 1/2 acre foot required for household use. I will use the 1/3 figure in this analysis. The 6 mobile homes would use 2 acre feet on that basis. 450 cows x 35 Gal. = 15,750 gal per day x 365 days = 5,748,750 gal. annually. 5,748,750 325,851 (Gal per Acre Foot) comes to 17.64 acre feet plus 2 acre feet for 6 mobile homes makes 19.64 estimated usage thus he was in compliance at that time (June 23, 1995) Since that time Scott Busker has sent a letter to Planning Services acknowledging he has increased his cow number to 600 head. That computes to 600 x 35 gal. x 365 days = 7,665,000 gal. year Divided by 325,851 shows estimated usage of 23.52 acre feet plus the 2 acre feet required to supply the mobile homes makes 25.52 and over his alloted appropriation. Scott Busker also acknowledges rurchase of additional 76 acres of land which at 4 cows per acre would allow him 864 head. (140 acres plus 76 acres times 4 per acre -864) At that number using the above formula his estimated annual usage would be 33.87 acre feet for the herd plus 2 for the 6 mobile homes and unknown usage for the additional mobile homes he anticipates needing for that size herd. Based on this information the application should undergo more extensive evaluation including proper proceedures (I.E.notification of Tri-Area Planning Commission, Fire Dept., etc.) I request this application be denied due to the above info,niation and procedural errors made by Planning Services. We recently purchased an additional 76 acres of land, adjacent to the existing dairy site. Our cow units were 560, before the purchase, but our limit is now 864 cow units. When we applied for the accessory to farm mobile homes, we had 450 cows. Since that time we have added another 150 cows, which comes to 600 cows total. Currently, we have six employees, but our number of employees will double to 12 as we gradually increase our cow numbers to the maximum. As you can see from the above information, even four mobile homes will not be adequate for a business of this size. We trust that this will meet with your approval. This well is limited to an annual average withdrawal of 23.8 acre feet of ground water from the Laramie -Fox Hills aquifer. Information obtained from the Division of Water Resources which is based on a federal publication indicates that a cow producing 80 pounds of milk per day will require 23 gallons of water per day for drinking. Information obtained from Colorado State University Animal Science Department- Dairy Division indicates that a cow producing 80 pounds of milk per day will require 24 to 27 gallons per day for drinking. For this review we will use 26 gallons per day per cow. Clean-up is estimated at 325 gallons per day. An average single family dwelling will use 2/3 acre feet per day including lawn watering. An average single family manufactured home will use 1/2 this amount without lawn watering. For this review we will use 1/3 acre feet per manufactured home. One acre foot equals 325,829 gallons and one third acre foot equals 108,610 gallons. The well permit allows the withdrawal of 23.8 acre-feet or 7,754,730 gallons. Six manufactured unit will use 6 x 108,610 = 651,660 gallons per year. Clean-up will require 365 x 325 = 118,625 gallons per year. This leaves 6,984,445 gallons for maintaining the herd. One cow will use 23 x 365 = 8,395 gallons per year. 6,984,445 r 8,395 = 831 cows can be serviced by the well provided for in Permit No.043799. Several arguments follow in support of the recommendation. The water availability and septic/sanitation issues in the overall operation are not yet resolved, nor is adequacy of fire protection. These considerations should be completed early on rather than later. The clustering of tour mobile homes and the virtual guarantee o₹ additional units, is not a use consistent with the surrounding area. Small farms with single family brick and frame houses are predominant. Weld County ostensibly embraces the "right to farm" concept. Generally, this concept relates to the town moving to the annoyances of the farm. An example being Greeley's intended purchase of an offending feedlot. In this case, the farm moves in proximity to the town. Also, the recently started dairy operation, admittedly a "use by right", has expanded and there is no reason to believe that additional expansions won't occur. Although regulations may not differentiate, there is an obvious distinction between a dairy farm and an agri-business. When a conscious choice is made to locate an environmentally negative operation in proximity to a municipaiity,a compelling argument can be made that although the defined "use" is a right, the initial choice undermines the "right" to act in the use without substantial control. This approach is particularly important in considering ancillary uses as a right. The resulting economic benefits from employer provided housing should not overshadow infra -structure demands and area impacts. b Lnc: Jay M. With respect to those applications, we have the following comments: • As shown on Figure 11 of the Town's Comprehensive Plan (attached), the subject area is within the Town's potential growth/annexation area. • Given, this proximity to the Town's "area of influence", the Town of Firestone has interest in land use activity that occurs in this area. • Based on the general land use policies and associated, goals and objects of the Town's Comprehensive Plan, the proposed land use would not be consistent with the types of land uses identified for the area. • Although the Town supports agricultural uses for the area, the Town is concerned that more that one accessory mobile home to a farm, could significantly impact the agricultural nature of the farm and set undesired land use policies for the area. Although we sympathize with the Applicant's situation, we hope they would consider other alternatives to solve the technical problems they noted in their application. The four mobile units requested, with future applications implied, substantially alters the character of the uses allowed. Infra -structure requirements and local comprehensive plan impacts have not been either requested or received. These include the towns of Frederick and Firestone,( Frederick boundaries are within z mile of the location), Tri-Area Planning Commission, Fort Lupton Fire District, and the service area of the nearest sanitation district. This request would appear to encourage inter -governmental co-operation of the type currently being sought by proposed agreements. Comments from affected areas at this point appears to be deficient. Air pollution - the smell of cow feces an intolerable level, any increase in the herd condition. 2. Light pollution - since the opening of this dairy, the road leading into the dairy and surrounding area is lit up at night, flooding our bedroom with light. 3. Noise pollution - being awakened at all hours of the night by tractors, yelling cow hands and bawling cows is extremely nerve wracking. 4. Increased traffic - Weld County Roads 16 and 17 have seen a marked increase in traffic (both automobile and trucks) since the dairy moved into the neighborhood increasing road hazards and billowing dust. Once again, allowing the dairy to expand will only increase this problem. 5. Ground water - consideration should be given to the fact that with growth at the dairy the possibility of ground water contamination increases and if it does, who's going to pay for the cleanup? To date, the dairy owners, Scott and Susan Bunker, have not shown any consideration for the quality of life of the residents of our neighborhood, all of who were here before the dairy. We got this dairy and all the problems that have come with it much to our dismay and totally against our wishes. Having the dairy for a neighbor has done nothing but drive our property value down and ruin the peace and quiet that we moved to the country seeking. Please note in the file that the applicant was unable to fulfill the 70% requirement when he petitioned the surface estate property owners within the 500 foot radius. We neighbors are opposed to the proposed mobile homes because we do not feel is is consistant with the betterment of our area. Until the Busker's placed their 2 mobile homes at the dairy a year ago there were NO mobile homes on this section. Excluding the Busker Dairy there are ten other residences on our section. Of those only three are agricultural assessed with one of the two farms having 2 houses. the remaining seven residences are all assessed at the rural residential base. We also question the ability of this very sandy soil to accomodate the additional septic systems for the homes plus dairy plus the lagoon. As it is right now the stench from the lagoon and pens can be overwhelming. This sandy soil does not percolate adequately and there are still older homes with shallow wells which could be contaminated. The location of the proposed trailers is also within 1/2 mile of Frederick city limit and 1 mile of Firestone's city limit. Due to the fact the areas west of the towns are undermined the towns have encouraged growth to the east. This type of housing could decrease all the surrounding property values and future potential development. Thank you for considering these facts in your evaluation of the four applications.
