Mr. Wm snadown. Ft. Lupton. Cole. Dear Sir, Kr. John Birkle brought to me today the papers and files in the Commissioners office relative to the road between See. 21 and Sao. 22 in 2'p. 2 N.B. 65 W. 6th P.k. and stated that you owned the 3E Y of Sec. 21, lip. d P.R. 65 W., and objected to the opening of the road. A letter you wrote Mr. Birkle stated that your title came through the Union Pacific Railroad Company. Cu this account there is no question that the land was not effected by the Act of Congress granting to the County right of way for roads around all government sections. The only right the county has to a road along your section line is the right obtained by the proceeding for establishment of the road. I find from en examination of the filee that this road was petitioned for, the fifteen dollars deposited as by statute provided, and viewers appointed to view the road. {he viewers did view the road and made report. Ni the report they recommended the road and reported that you were damaged to the extent of $8 per acre for each acre taken and that there was a strip 30 feet wide taken off your land. This would be a little less than two acres. Before the road o an be opened for travel the commiss- ioners must cease a notioe to be posted to effect that at the end of sixty days they will proceed to open the road. This notice mast be posted in three places along the road to be open- ed. IT'. Birkle stated that I should have the notices posted, and they would proceed to open the road at the end of sixty days. The commissioners always make effort to properly adjust all disputes about roads without resort to court proceedings , And Mr. Birkle stated to me that he believed this could be adjusted with you se that no trouble would come up. He stated that you thought the county should move the fence for you. I believe the county would stand the expense of moving the fence back, in-as-much as there is already a fence an the line, which Kr. Birkle said he thought belonged to you. GE'' . 1-GDGSON, Commissioner Road Dist. No 3 . Weld County Colorado . Pear Sir :- Complying with your request of August the 4 tai . I have surveyed- and examined the propsed A.B.C .Halwell Road between Sections 3 & 4 and 10 in Township 2 North, Range 60 West, and respectfully subr.iit the following report. The entire route of the proposed. Road is very sandy and would for the greater part df the way, have to be"Hard Dirted"to make it pass- able for an average two horse load. The fence new existing between Sections 15 & 16 would have to be re-set and one mile of new fence constructed. The fence between Sections 9 & 10 is in very poor condition I ' and would have to be removed and new fence constructed on both sides ,i of the Right-of-Say, which would require two miles of fence. At a point about 1/4 mile north of the corner to Sections 9 - 10 - 15 and 16 the Fulton Ditch runs directly on the line for about 100 feet. The road should bb constructed around the east side of this ditch or the ditch straightened and run through a dike on the west side of the Right of i,ay. This would require a dike 5 feet high and 100 feet long and the filling of the old ditch. The ditch is 8 feet wide on top and 3 feet deep. At approximately 2000 feet and again at 2700 feet north of the corner to Sections 9 - 10- 15 & 16 this ditch crosses the line of the proposed road requiring the construction of two 10 foot bridges, it also crosses the line at about 900 feet south of and again 800 feet north of the corner to Sections 3 - 4 - 9 & 10, but has evidently been aban- doned. Two small dirt fills would be required at these crossings. At the corner of Sections 3 -4 -9 & 10 the line of the pro- posed road is covered by the Davis Reservoir for about 600 fast and the following line was surveyed as the most practical route around the east side of the Reservoir. Comencing at a point on the line between sections 9 & 10 285 feet south of the corner to Sections 3-4-4 & 10 and running thence /j 1^ f -1 rv'f-• _.. RETOnT LN A.E.E .I'• . ROAD x--2_..� N. 68° 20'E. 263 feet, thence N. 14° 00 'E . 200Pfeet to the line between Sections 3 & iQ, thence N. 30° 00'W. 154 feet, thence N. 37° 25'WT. intersecting the line between Sections 3 & 4, 371 feet north of the cor- ner to Sections 3 -4- 9 & 10. The above described line is above the present high water line as established by the State Engineer on acount of a weakness in the dam, but should the dam be strengthened and the reservoir filled th the high water line as filed, the road as surveyed would be flooded in places, and to avoid this the road would have to be constructed sever- al hundred feet from line as surveyed and thus cut off several acres in sections three and ten. A natural water way running into the reservoir fron Section 10 would have to be tiled and filled, and the cattle pass in Section 3 as proposed by the Viewers would have to be entirely in cut. Accompanying this report is a plat showing approximately the location of the ditches, reservoir etc. Very respectfully submite L� o ELDER.
