HEARING CERTIFICATION DOCKET NO. 98-59 RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND THIRD AMENDED SPECIAL REVIEW PERMIT #877 FOR AN ASPHALT AND CONCRETE BATCH PLANT AND GRAVEL MINING OPERATION IN THE A (AGRICULTURAL) ZONE DISTRICT - CAMAS COLORADO, INC. A public hearing was conducted on October 28, 1998, at 10:00 a.m., with the following present: Commissioner Constance L. Harbert, Chair Commissioner W. H. Webster, Pro-Tem Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Julie Chester Health Department representative, Sheble McConnellogue Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated September 29, 1998, and duly published October 14, 1998, in the Platteville Herald, a public hearing was conducted to consider the request of CAMAS Colorado, Inc., for a Site Specific Development Plan and Third Amended Special Review Permit (USR) #877 for an Asphalt and Concrete Batch Plant and Gravel Mining Operation in the A (Agricultural) Zone District. Cyndy Giaugue, Assistant County Attorney, made this a matter of record. Julie Chester, Department of Planning Services representative, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Ms. Chester gave a brief description of the location of the site and stated Second Amended USR #877 was approved by the Board April 26, 1995; however, several Conditions of Approval were not met and the plat was not recorded. Ms. Chester stated the Conditions of Approval and Development Standards of Third Amended USR#877 address all prior requirements from the original permit and second amendment. She submitted a letter from the Planning Commission Hearing, marked Exhibit 35,which was inadvertently omitted from the file. Ms. Chester stated the items of concern have been addressed in the Conditions of Approval and Development Standards and Don Carroll, Department of Public Works representative, is working with the applicant regarding Conditions of Approval #3.A, B, and C. She stated the Road Maintenance and Improvements Agreement will come before the Board for approval at a later date. Mike Refer, CAMAS Colorado, Inc., explained they are working to modify the previous Improvements Agreement for the areas owned by Cooley Gravel Company, and C & M Ready Mix Concrete Company of Boulder, Inc., and the Bigelow Trust area owned by the City of Longmont. Under the prior Improvements Agreement, CAMAS did complete the improvements requested by the Public Works Department; however, the formal agreement was never completed. Mr. Refer stated the Public Works Department has requested the entrance to the site be modified to a ninety degree angle, and an acceleration lane be added going west. He stated CAMAS has agreed to the 982106 (±.' PL0468 HEARING CERTIFICATION - CAMAS COLORADO, INC. (3RDAMUSR#877) PAGE 2 requested improvements, and they are included in the Improvements Agreement now being drafted. He stated four amendments have been added to the 1994 agreement which clarify CAMAS in the legal owner and operator. He further stated paragraphs#8, 9, 10, and 11 of the current agreement are the sole responsibility of CAMAS Colorado, Inc. Commissioner Kirkmeyer clarified the Road Improvements Agreement will be considered for approval at a later day. In response to Commissioner Kirkmeyer, Mr. Refer indicated he agrees with the Conditions of Approval and Development Standards, most of which have already been met. Responding to Commissioner Kirkmeyer, Mr. Refer explained Condition of Approval #3.K.5 refers to a certain portion of the haul route, and added CAMAS Colorado met with the surrounding property owners, agreed to pave the haul route from Weld County Road 20.5 to the site, and the project was completed in 1995. Commissioner Kirkmeyer suggested deleting said condition to avoid confusion and staff agreed. Responding to Commissioner Hall, Mr. Refer stated the road improvements were completed; however, the plat for the Second Amended USR was not signed because the Road Improvements Agreement was never executed. Paula Fitzgerald, City of Longmont Parks and Recreation, stated the City is the current landowner of Sandstone Ranch and is working on a ten-year lease purchase with Frank and Andrea Bigelow for the remainder of Sandstone Ranch, and with CAMAS Colorado, Inc., on the reclamation plan. In response to Commissioner Baxter, Ms. Fitzgerald indicated the location of the Sandstone area consisting of 318 acres. Commissioner Kirkmeyer moved to approve the request of CAMAS Colorado, Inc., for a Site Specific Development Plan and Third Amended Special Review Permit#877 for an Asphalt and Concrete Batch Plant and Gravel Mining Operation in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record and deletion of Condition of Approval#3.K.5. The motion was seconded by Commissioner Baxter, and it carried unanimously. This Certification was approved on the 2nd day of November, 1998.
