Approved with Conditions
1. The Department of Planning Services has determined through the review, that the standards of Section 11.4.2.1
through 11.4.2.6 of the Weld County Subdivision Ordinance have been met. This Recorded Exemption is
approved with the following conditions in accordance with information submitted in the application and the policies
of the County.
2. A Weld County septic permit is required for any proposed home. The septic system shall be installed according
to the Weld County Individual Sewage Disposal System (ISDS) regulations.
3. Prior to recording the plat, the applicant shall:
A. The following note shall be placed on the plat: Lot A of RE-1817 is not affected by this amendment.
B. The following note shall be placed on the plat: All proposed or existing structures will or do meet the
minimum setback and offset requirements for the zone district in which the property is located.
C. The following note shall be placed on the plat: Lot B of RE-1817 is affected by the ten (10)year time frame
and shall not be further subdivided through a recorded exemption for 10 years after the date in which the
amended plat AMRE-1817 has been recorded.
D. All access shall be clearly shown on the plat.
E. All easements shall be clearly shown on the plat.
F. The applicant shall show on the plat an access easement for the benefit of Lot B. The plat shall include
an easement certificate as stated in Section 11.7.12.5 of the Weld County Subdivision Ordinance.
G. The applicant shall submit a proposed deed to the Department of Planning Services which shows that the
east section of Lot B which is being excluded from the lot through this amendment, is deeded to be a part
of the adjacent lot, parcel number 080116000063. No additional lots are being created through this
amendment procedure.
6. The applicant shall submit a copy of the recorded deed which shows that the east section of Lot B which is being
excluded from the lot through this amendment, is deeded and recorded to be a part of the adjacent lot, parcel
number 080116000063 after the plat AMRE-1817 has been recorded.
7. No additional accesses to Lot A or Lot B shall be allowed.
8. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the
Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7
of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60) days from the date of
approval by the Department of Planning Services. The applicant shall be responsible for paying the recording
fees.

Re: Request to amend the east boundary of Lot "B", Recorded Exemption No. 0801-
16-2-RE1817, recorded December 21, 1995 in Book 1524 as reception No. 2468540,
being a part of the N1 of Section 16, Township 6 North, Range 64 West of the 6th
P.M., Weld County, Colorado.
Dear Ms. Eastin:
This request to amend the east boundary of Lot "B" of the above referenced
Recorded Exemption would align the east boundary line of existing Lot "B" with an
existing fence line that divides Lot "B" and other property we own, further aligning
it west of Owl Creek. The boundary now meanders in a southeasterly direction,
crossing Owl Creek at one point. The requested boundary change will alter the size
of the existing Lot "B" downward from 94.72+/- acres to approximately 91+/-acres.
The acreage would be added to the property we own east of Lot "B", increasing the
size of our other parcel to approximately 110.72+/-acres from it's existing 107.00+/-
acres.
Lot "B" is an unimproved lot, currently seeded to pasture mixture of improved
irrigated grasses, fenced and crossed fence, and used in the pasture rotation for
grazing of our cow herd. It is our plan to sell Lot "B" at some future date. At that
time it is highly probable that a new owner will want to use a small portion of the
lot for a residence.
The need to reconstruct our operating finances leaves us with few choices. We had
hoped to have put our financial state behind us with the sale of Lot "A" of the above
referenced Recorded Exemption, however, with livestock prices remaining low and
not being able to defer expenses we continue to see ourselves unable to salvage our
operation without adjusting our position. We do not want to sell our cow herd as we
have spent many years breeding for quality and the type of cattle desired by the
industry.
This request is consistent with the policies of the Weld County Comprehensive Plan
in that the uses and nature of the land will not be changed by this process. The
property is in an agricultural zone which will not be changed by this process, thus
insuring the request is consistent with the intent of the zone district in which the
property is located.
Uses that will be permitted are limited to those permitted by the County Agriculture
Zoning Ordinance which includes crops, pasture and livestock.This is compatible
with existing surrounding land uses as these are presently engaged in the same uses.
The uses permited will be compatible with future development of the surrounding
area as permitted by the existing zone and with future development as projected by
the comprehensive plan of the county . The subject property is not located within a
three (3) mile radius of any municipality . It is not considered in the future growth of
the City of Greeley or any other town in the area .
This proposal will not be inconsistent with efficient and orderly development of the
general area .
Sewage disposal will be a septic system . Domestic water for Lot "B"will be supplied
by North Weld County Water District.
Lot "B" is accessed from Weld County Road 70 .
The property is irrigated. Lot "B" when sold will be assigned 90 Shares of the
Capital Stock of The Bernhardt 320 Water Users Association , this being a prorated
share of the water rights we own .
The subject property does not lie in a geologic hazard or Weld County Airport
Overlay District. Nor does it lie in a flood plain .
The subject property complies with the overlay districts outlined in the Weld County
Comprehensive Plan dated November 21 , 1995 .
Fire protection is provided by the Galeton Volunter Fire District . The subject
property is in the Weld Reorganized School District RE-7 , Kersey , Colorado.

Dear Ms Dunn :
We the undersigned submit the following application to divide Lot
" B " amending Recorded Exemption No . 0801-16-2-RE 857 .
Cur request to amend the existing Recorded Exemption would split
the existing Lot " B " into two lots . The smaller of the two lots
would be Lot "A" , approximately 13+/-acres , the larger Lot " B " will
have approximately 98 . 18+/-acres . The existing Lot "B " is an un-impr-
oved lot . Our plans are to sell the new smaller Lot "A" , hoping
that this will provide some relief to the financial drain created
by loses in our livestock operation . It is anticipated that at
some future date a small part of Lot "A" will be used for a
residence , the remainder continuing to have an agriculture use .
We have no plans to change the use of the new larger Lot "B " it
will remain the basis of our livestock operation . Either as irri -
gated summer pasture or for hay production , the hay used in the
winter feed and care of our livestock .
All of the land is currently irrigated , having irrigation water
rights under the Larimer and Weld Irrigation system. A pro rata
distribution of our irrigation water will be assigned to each lot .
We currently utilize an underground and gated pipe irrigation
system for distribution and irrigation of the land . The split we
are proposing is a split whereby amended Lot "A" is already indep-
endent of amended Lot " B" within the current irrigation system .
The proposed lots "A" and "B " are separated by the fences curre-
ntly in place .
The subject property is located in an agriculture zone , the
proposed Recorded Exemption is consistent with the zoning . It is
our intent that both lots will remain agriculturally zoned . No
change in use is contemplated and the use is fully compatible
with the existing use and tenure of the area .
Domestic water for amended Lots "A" and " B " is available from
North Weld County Water District . A letter from the water district
stating that the district is able to supply water taps is part of
and attached to this request . Both lots will utilize septic tanks
or standard systems required by the Weld County Health Depart-
ment .
The proposed Amended Recorded Exemption is compatible with other
properties in the area and is not inconsistent with the effic-
ient and orderly development of the area . The property is not
located in a flood plain , geologic hazard or Weld County Airport
District . It complies with the Weld County Zoning Ordinance .
Fire Protection is provided by the Kersey Volunteer Fire Depart-
ment . Public Service Company provides electrical service to the
area . US West provides telephone service .
The herein described property , that we are proposing to split in
amending the existing Recorded Exemption is located approximately
11 miles northeast of Greeley , approximately three miles northwest
of Gill and approximately 33 miles southeast of Galeton .
Amended Lot "A" has access onto Weld County Road 55 , Lot " B "
having access onto Weld County Road 70 .
