The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. 3. Prior to recording the plat, the applicant shall submit a copy of an approved well permit from the Division of Water Resources for Lot A. 4. Prior to recording the plat, the applicant shall show on the plat a common access easement across Lot B for the use and benefit of both Lot A and Lot B. The parcel of land under consideration is described as property located in the SE4 of Section 24, T1 N, R66W of the 6th P.M., Weld County, Colorado. The property is located south of and adjacent to Weld County Road 6 and east of and adjacent to Weld County Road 37. The request is to divide a 5.5 acre parcel into two lots of 3 acres and 2.5 acres. A water well is the current water source on Lot B and is proposed for Lot A. A septic system is the sewage disposal on Lot B and is proposed to Lot A. Access is existing from both lots onto Weld County Road 37 which is a paved road. The subject property lies in the Urban Growth Boundary area of the Town of Lochbuie and the City of Brighton. Both have reviewed this request and have no conflict of interest. The applicants stated in the recorded exemption application, that the reason for this request is to allow the property owner, who is retired, the opportunity to sell the existing nonproductive section of the property. This request would allow for an additional residence to be built on the new lot. The Department of Planning Services' staff has concerns that the proposed division is inconsistent with efficient and orderly development and the Transportation goals and policies as stated in the Weld County Comprehensive Plan. Further, it is the opinion of staff that sufficient reasons have not been given by the applicants to warrant creating an additional lot at this time. An additional residence at this location would add to sprawl row type development. Service, Teamwork, Integrity, Quality 952446 RE -1815, Conway Page 2 Staff also has concerns that the existing parcel is 75 acres smaller than the A (Agricultural) zone district allows by right. When allowing a split of such small parcels the Department of Planning Services' has concern of setting a precedent in the area of future land uses and further promoting recorded exemptions in the area. The intent of the recorded exemption is to enhance the Agricultural zone district. The property currently is only 5.5 acres. Staff has concerns that creating two lots of 2.5 acres and 3 acres will encourage future increase in urban uses in the area which will ultimately cause an increase in urban congestion and demands in the immediate area. Neither lot is served by a public water source or a public sewer source. The Department of Planning Services' staff requests that the Board of County Commissioners consider this proposal and determine if the standards of Sections 11.5.1 through 11.5.7 of the Weld County Subdivision Ordinance have been satisfied. To enable the property owner who is retired an opportunity to sell the existing nonproductive agricultural land for the a single family dwelling homesite. 4. Explain how the uses permitted will be compatible with existing uses surroundinn the recorded exemption. To either side North, West, and South there exist 4 single family dwelling homesites. To the East exist a large farm segment and 2 single dwelling homesites. So this division will meet in accordance with the other sites in the area. 5. Explain how the proposal is consistent with the intent of the zoning district it is located within. The district is on a residential trend. Although our lots are remaining at the 2 to 3 acre size the split would help turn non -used weed barring property into a residential with small agricultural property. Which will add consistent appearance and usage to the area keeping with the zoning trend in this location. 6. Explain how the proposal is consistent with efficient and orderly development. There is development with a more residential trend in the area. Brighton Colo. is showing growth in our direction from the North East, and Lochbuie Colo. is expanding toward us from the East. So while my 2043 Rd 37 segment is will remain 2 large lots, the residential trend would remain consistent. 7. Explain how adeouate provision for the protection of the health. safety, and welfare of the inhabitants of the neighborhood and the County will be accomplished. Due to the residential nature of the new lot, there would be no threat to health, safety, nor welfare to existing neighbors or neighborhoods.
