HomeMy WebLinkAbout992693.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST RONALD AND BONNIE VEIK FOR VIOLATION OF THE WELD COUNTY ZONING ORDINANCE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Ronald and Bonnie Veik, VI #9900233, are allegedly in violation of the Weld County Zoning Ordinance, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 9th day of November, 1999, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Ronald and Bonnie Veik, property owners, were present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until May 31, 2000, to allow adequate time for the property owners to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that said violation be, and hereby is, referred to the Weld County Attorney's Office for legal action against Ronald and Bonnie Veik to remedy the violation of the Weld County Zoning Ordinance, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties, with an instruction for delay of action upon such referral until May 31, 2000, to allow adequate time for the property owners to bring the subject property into compliance. 992693 PL0824 pal PL, CA, )/. The owners (Carol and Don Schmidt) have known about a problem (septic "system" tools waste to well for years) and have covered it up. The owners tried to pump out the "system" abcut 3 years ago. Maybe with Owens Sanitation(?). The pumper was able to pump some waste out then the walls of hte well caved in. At that time the pumper left a tank and said he didn't want any part of this, but that the Schmidt's had better take care of it. Apparantly at that time additional chemicals were thrown in the well and then it was covered up. The same night Mr. Spencer took a bath and then had hives on his body from the water line down that lasted a month. No he didn't see a doctor at the time. A new system was built (around this same time approx. 3 years ago) and the leachfield is in the neighbors property (and Loyd says there is waste above the leachfield - so to him it appears to be failing already). Currently the property has sold (Loyd thinks there are several current disputes one with him others with neighbors over property lines that may prevent this transfer of property. Mr. Spencer mentioned several things our department doesn't have any jurisdiction over: the Schmidts had threatened him and his mother (who was also living there at the time) and Mr. Spencer may have some other civil issues over privacy and agreements he has had with the Schmidts. Other complaints that I referred to planning: owner has two bus shells on the neighbors property, and has built clothes line posts on the neighbors property as well. The leachfield is reported to be on the neighbors property as well... The well in question is one of 4 that Mr. Spencer thinks are on the property (told this by carol's father the previous owner). The well in question is in the flood plain and is under water 2-3 times a year. It's a open hole well, with a cement block and lid. He has been told that the well is 35' and also 65' deep (by different people over the years). The cap (cement with metal handle) is probably 2-3 feet under dirt (see map). Mr. Spencer brought a water sample in from this property today for a bacteria test. He assumes the water is contaminated and has only used his residence for sleeping, getting his meals etc. elsewhere. Mr. Spencer also says that the realtor, Dee Marich (The Group 352-1332) sold the house and that he told her about the well and she refused to disclose anything to the buyer. Also Mr. Spencer says that the previous owner (Baum, Carol Schmidt's father) filled in the drainage draw with trash and changed the flood pattern to it's current route.
