Subject: Coors Energy, Amended USR-386
1. The amended Use by Special Review permit is for an open pit coal mine and ash and
mine waste rock disposal as submitted in the application materials, dated June 13, 1997,
on file in the Department of Planning Services and subject to the Development Standards
stated hereon. Disposal shall be limited to those areas delineated as A and B pits in the
application materials.
2. Each source of mine waste rock shall be approved by both the Weld County Health
Department (WCHD) and the Colorado Department of Public Health and Environment
(CDPHE) prior to disposal at the site. Only mine waste rock as defined in Doty &
Associates letter dated, October 1, 1997, shall be considered for disposal at this site. The
facility shall submit a detailed, written request for each source. Each request shall
include the following:
A) A comprehensive characterization of the mine waste rock. At a minimum the
characterization shall include: all 8 R.C.R.A. metals using the toxicity
characteristic leaching procedure(TCLP) and a determination of pH. The
characterization shall also include any appropriate additional analytes as requested
by either the WCHD or the CDPHE.
B) A review of the groundwater monitoring parameters. The groundwater
monitoring parameters shall be amended to reflect any appropriate potential
leachable materials from the mine waste rock.
3. The facility shall submit an annual reclamation report. In addition to reclamation
activities the report shall state the quantity and source(s) of mine waste rock accepted.
4. The facility shall comply with the Regulations Pertaining to Solid Waste Disposal Sites
and Facilities (6 CCR 1007-2), the Weld County Zoning Ordinance, and the Rules and
Regulations of the Colorado Division of Minerals and Geology.
5. The facility shall comply with Section 1.8 of the Regulations Pertaining to Solid Waste
Disposal Sites and Facilities (6 CCR 1007-2), pertaining to financial assurance, by April
9, 1998.
6. The facility shall review and update its existing groundwater monitoring plan by April 9,

1998. The plan shall comply with Section 2.2 of the Regulations Pertaining to Solid
Waste Disposal Sites and Facilities (6 CCR 1007-2). The plan shall be reviewed and
approved by the Weld County Health Department and the Colorado Department of Public
Health and Environment.
7. Fly ash and/or bottom ash and mine waste rock shall be transported in a manner that will
prevent significant fugitive dust from leaving the transport vehicle during loading,
transport, and off loading.
8. The disposal site shall be maintained in such a manner as to prevent significant fugitive
dust from blowing or drifting off the immediate disposal site at any time. Sufficient
water spray and/or cover material shall be available to be applied in order to abate dust
conditions at any time necessary.
9. The disposal cells shall have a minimum of four (4) feet of soil, regolith, mantlerock, or
bedrock material between the top of the groundwater table and the floor of the deposited
ash waste pit. The site shall have a minimum of four(4) feet of cover over the ash at
final grade.
10. The Special Use permit area shall be maintained in such a manner so as to prevent soil
erosion, fugitive dust, and growth of noxious weeds. The site shall be maintained in such
a manner as to present a neat and well kept appearance.
11. The facility shall be fenced with a three(3) strand barbed wire fence. The fence shall
remain until the area is fully reclaimed.
12. Lighting provided for security and night operation on the site shall be designed so that the
lighting will not adversely affect surrounding property owners.
13. All phases of the operation must conform to the noise limitations set forth in 25-12-103,
CRS, 1973.
14. The facility shall conduct an annual analysis of the fly ash and bottom ash. The analysis
shall include but not be limited to all 8 R.C.R.A. metals using the toxicity characteristic
leaching procedure(TCLP). The results of the analysis shall be submitted to the Weld
County Health Department (WCHD) and the Colorado Department of Public Health and
Environment (CDPHE). In addition, if at any time the source of coal is changed at the
Golden Plant, the TCLP (for all 8 metals) analysis shall be conducted on the fly ash and
the bottom ash and the results shall be submitted to the WCHD and CDPHE.
15. Covering of the ash and mine wastes shall occur on a regular and frequent basis. At a

minimum, the waste shall be covered with a minimum of six (6) inches of soil every 48
hour period.
16. Personnel from the Weld County Health Department, State Health Department, and Weld
County Department of Planning Services shall be granted access onto the property at any
reasonable time in order to insure the activities carried out on the property comply with
the Development Standards stated hereon and all applicable Weld County Regulations.
17. The Use by Special Review area shall be limited to the plans shown hereon and governed
by the foregoing Standards and all applicable Weld County Regulations. Any material
deviations from the plans or Standards shown or stated shall require the approval of an
amendment of the Permit by the Weld County Planning Commission and the Board of
County Commissioners before such changes from the plans or Standards are permitted.
Any other changes shall be filed in the office of the Department of Planning Services.

The Weld County Public Works Department has reviewed this proposal; the following comments
are recommended to be a part of any approval:
1. Traffic: The applicant has indicated that ash hauling is currently brought to the site using two
tractor/semi-trailer combinations over-the-road hauling trucks capable of hauling 25 tons each.
There will be three deliveries per day on a average.
The initial waste rock disposal project should be completed within 45 days of starting. It is
anticipated that the washed rock will also be brought to the site in 25-ton over-the-road hauling
trucks. The number of truck trips will be limited such that there are fewer than 25 trips per day
for the 45-day period only, regardless of the material being hauled. This traffic loading on
WCR 59 is consistent with the limited impact by Condition No. 2 of the 1987 resolution
approving the amendment of the Use By Special Review Permit 386.
2. Time Limit: The ash disposal operation is on-going; mine waste disposal will begin as soon
as the permit modification is approved. It is anticipated that the filing will be complete in
approximately 15 years under the currently approved plan. The need for disposal of the ash
from the power plant at the Coors beverage facility has been addressed in Case No. USR-386.
3. Amended Resolution: The Weld County Public Works Department feels that Coors Energy
has met it existing obligation to construct and build the road to the facility. Within the amended
resolution under Condition No. 2, the applicant has indicated that the proposed long use of
WCR 59 will not exceed the 25 truck loads per day. If this situation should change, the
requirements of the original permit for an additional 2 inches lift should be adhered to.
The initial leased rock disposal project is being identified as a 45-day hauling project. It is
limited to 25 trips per day. The short hauling project should not damage the road. If damaged
areas appear during or at the completion of the 45-day hauling period, the applicant should be
responsible for any repairs. Notification of the start and completion of the waste rock disposal
project should be submitted to the Weld County Public Works Department to reevaluate the
haul route.

This letter serves as the Solid Waste Unit's recommendation for approval of Coors Energy
Company's proposal to accept off-site mine waste rock at the Keenesburg Ash Disposal
facility. The original proposal is contained in the document titled "Use by Special Review
Permit Amendment Application, Coors Energy Disposal Site", prepared by Doty &
Associates and dated June 13, 1997. Amendments to the original application are contained
in subsequent written correspondence, copies of which have been provided to Weld County.
