RE: ACTION OF BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY,
COLORADO, CONCERNING SITE APPLICATION OF CARDINAL COMMUNITY
ACADEMY AND AUTHORIZE CHAIR TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has received a site application from Cardinal Community
Academy, P.O. Box 444, Keenesburg, Colorado 80643, concerning a Wastewater Treatment
Plant located on the following described parcel of land, to-wit:
SE1/4, SE1/4, SE1/4 of Section 17, Township 1
North, Range 63 West of the 6th P.M., Weld
County, Colorado
WHEREAS, the regulations for site applications for the Wastewater Treatment Plant
require review of the site application by the Board of County Commissioners, and further, that
various local and state agencies be given the opportunity to review and comment on said
revised site application, and
WHEREAS, the site application from Cardinal Community Academy was submitted to
the Board of County Commissioners of Weld County for review and comment, a copy of said
application being attached hereto and incorporated herein by reference, and
WHEREAS, after study and review, the Board finds that said site application is
compatible with the Weld County Comprehensive Plan, and that it is in the best interest of Weld
County to recommend approval of said application.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the site application submitted by Cardinal Community Academy
be, and hereby is, recommended favorably to the Colorado Department of Public Health and
Environment as being compatible with the Weld County Comprehensive Plan.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said site application.

COLORADO SUBJECT: Cardinal Community Academy, Application for Site
Approval
In accordance with the Regulations for the Site Application Process (5 CCR 1002-22) the Cardinal
Community Academy is requesting the Boards approval for a wastewater treatment plant (actually
just a large subsurface septic system). The system will be located on a 9 acre lot near the intersection
of WCR's 8 and 65, in the SE4, SE4, SE4 of Section 17, Township 1 North, Range 63 West, of the
6th Principal Meridian, approximately 4 1/2 miles southeast of Keenesburg.
Our Department recommends that the Board approve this site application.
The system will serve the Cardinal Community Academy charter school. The system will he
designed for 192 people which would result in a maximum daily flow of approximately 3,840
gallons/day. A site application is required for flows greater than 2,000 gallons/day. The nearest
community sewerage is located in the Town of Keenesburg.
The Department of Planning Services(memorandum attached)has reviewed this application and has
found "...no conflicts with their interests." I have also discussed this application with Dave Dubois
of the North Front Water Quality Planning Association and they also have no concerns.

SUBJECT: Site Approval for the Car nal ommunity Academy,
Wastewater Treatment Plant
The Department of Planning Services' staff has reviewed this application and find no conflicts with
our interests. Section 31.2.11 of the Weld County Zoning Ordinance, as amended, lists Public
Schools as a Use Allowed by Right in the Agricultural Zone District. The area where the school is
to be located is a rural area south of Keenesburg, zoned Agricultural. A letter was sent to Mr. Danny
Kipp on September 24, 1999 addressing the use of the school. At that time, staff determined that
the public school would not require any special zoning permits or building permits through Weld
County. The bulk requirements for the Agricultural Zone District must be adhered to, in regard to
minimum setbacks and offsets. The proposed school does not lie within any overlay districts,
including the flood plain, as indicated on FIRM map#080266-1050C.
The Weld County Comprehensive Plan addresses Public Facilities and Services. "The type,
intensity, and location of a land-use proposal are factors that determine the type and level of
services and facilities required. Effective and efficient delivery of services and facilities can be
promoted by assessing the needs and impacts of a land-use proposal, along with the existing and
planned capabilities of the service and facility providers at that location." The Department of
Planning Services relies on the Weld County Department of Public Health and Environment to
review this application and determine the adequacy for the use. P.Goal 2 states"Require adequate
facilities and services to assure the health, safety, and general welfare of the present and future
residents of Weld County." The application, as submitted, appears to be adequate, in assuring
the health, safety and welfare of the residents of Weld County.
Furthermore, A.Goal 6 of the Weld County Comprehensive Plan states, "Public facilities and
services such as sewer, water, roads, schools, and fire and police protection must be provided and
developed in a timely, orderly, and efficient manner to support the transition of agricultural land to
urban development. The expansion of public facilities and services into predominantly rural
agricultural areas, when the expansion conflicts with other existing goals and policies, will be
discouraged. In evaluating a land-use application, Weld County representatives and the applicant
will consider the public facilities and services goals and policies."

13. Please identify any additional factors that might help the Water Quality Control Division make an informed
decision on your application for site approval. The proposed treatment plant is located in a rural area of
Southeast Weld County. The present land-use is Agricultural and the site has historically_been used as
farmland. On September 2, 1999, the Weld RE-3i Board of Education and the Cardinal Community Academy
entered into a contracture! agreement (attached as Exhibit H) to grant the CCA a charter to operate a K-8
school at this location. The site of the proposed school is raw farmland which was donated to the CCA by
Mike Coan, the former landowner, for the sole purpose of constructing a facility at this location to house the
school. As identified in the contract, the CCA will initially purchase modular school units to begin operations
at this location. As the location of the site is not in close proximity to any existing treatment facilities,
consolidation was not a viable option. The closest town is Prospect Valley, which is an unincorporated
collection of domestic residences and small businesses with no common sewage treatment facility.
However, there is adequate space on this site to construct and operate a viable ISDS without impact to
adiacent landowners and/or water users. In addition, the construction of this facility will be consistent with
comprehensive water quality plans for this area. Finally, the closest domestic dwelling is approximately
Y.
mile east and up gradient of the site. It is possible that additional domestic dwellings will be constructed
within one mile of the school in the future, however, the location of the leach field near the center of the site
should provide an adequate buffer which will prevent off-site contamination from ever occ:urrinq.

ATTACHMENT TO SITE APPLICATION
In accordance with C.R.S. 1981, 25-8-702 (2)(a), (b), and (c), and the "Regulations for Site
Applications for Domestic Wastewater Treatment Works", the Water Quality Control Division must
determine that each site location is consistent with the long range , comprehensive planning for the
area in which it is to be located, that the plant on the proposed site will be managed to minimize the
potential adverse impacts on water quality, and must encourage the consolidation of wastewater
treatment works whenever feasible.
In making this determination, the Division requires each applicant for a site approval for a domestic
wastewater treatment works to supply an engineering report describing the project and showing the
applicant's capabilities to manage and operate the facility over the life of the project to determine the
potential adverse impacts on water quality. The report shall be considered the culmination of the
planning process and as a minimum shall address the following:
Service area definition including existing and projected population, site location, staging or
phasing, flow/loading projections, and relationship to other water and wastewater treatment
plants in the area.

Proposed site location, evaluation of alternative sites, and evaluation of treatment alternatives.
The proposed site location is really not negotiable since the land is being donated and has, by
all reasonable investigations, proven to be a viable location.
Proposed effluent limitations as developed in coordination with the Division.
Since there is no proposed discharge, this limitation will not be necessary, however, the
stream classification and proposed standards were included with the application under item #
3.
Analysis of existing facilities within the service area(s).

Analysis of opportunities for consolidation of treatment works in accordance with the
provisions of 22.3(1)(c), including those recommended in the water quality management plan,
unless the approved water quality management plan recommends no consolidation.

Evidence that the proposed site and facility operations will not be adversely effected by
floodplain or other natural hazards. Where such hazards are identified at the selected site, the
report shall describe means of mitigating the hazard.
The location of the proposed school is not within a designated flood plain as noted in Exhibits
C, E and F.
Evidence shall be presented in the form of a report, containing soils testing results and design
recommendations and prepared by a Professional Geologist and a Geotechnical Engineer, or by
a professional meeting the qualifications of both Professional Geologist and Geotechnical
Engineer, with an appropriate level of experience investigating geologic hazards, stating that
the site will support the proposed facility.

Detailed description of selected alternatives including legal description of the site, treatment
system description, design capacities, and operational staffing needs.

Legal arrangements showing control of site for the project life or showing the ability of the
entity to acquire the site and use it for the project life. Approval by the Division of an
application for site approval shall not be deemed to be a determination that the proposed
treatment works is or is not necessary, that the proposed site is or is not the best or only site
upon which to locate such a treatment works, or that location of a treatment works on the
site is or is not a reasonable public use justifying condemnation of the site. Approval by the
Division shall only be deemed to be a determination that the site application meets the
requirement of this regulation 22 (5 CCR 1002-22).

Management capabilities for controlling the wastewater loadings within the capacity
limitations of the proposed treatment works, i.e., user contracts, operating agreements,
pretreatment requirements and or the management capabilities to expand the facilities as
needed (subject to the appropriate, future review and approval procedures).
The Cardinal Community Academy School Board will be responsible for retaining qualified
employees for maintenance of the school including, domestic water supplies, wastewater
treatment and general building maintenance. Any future expansion plans will be channeled
through appropriate review and permitting prior to implementation.
Financial systems which has been developed to provide for necessary capital and continued
operation, maintenance, and replacement through the life of the project. This would include,
for example, anticipated fee structure.
The maintenance of the entire school is accounted for within the framework of the proposed
budget. Revenue for operation of the school is obtained through per pupil operating revenue
of approximately $ 4,830.00 per enrolled student.
Implementation plan and schedule including estimated construction time and estimated start-
up date.
The school is scheduled to open in the fall of 2000 for the 2000-2001 school year. It is
anticipated that construction will be completed for the entire school by July 15, 2000.
Construction of the ISDS will conducted in May or June of 2000. It is anticipated that it will
take approximately 2 weeks to construct the system.
Depending on the proposed project, some of the above items may not be applicable to address. In
such cases, simply indicate the non-applicability of those.
