HomeMy WebLinkAbout990076.tiff 2 RESOLUTION RE: APPROVE VACATION OF SPECIAL REVIEW PERMIT #1162 - IGLESIA MONTE CALVARIO SPANISH ASSEMBLIES OF GOD CHURCH WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated October 8, 1997, the Board did approve Special Review Permit#1162 for a public church with an associated grass playground area and ballfield in the A (Agricultural) Zone District for Iglesia Monte Calvario Spanish Assemblies of God Church on the following described real estate, to-wit: Lot A of Recorded Exemption #1850 being located in part of the SE% of Section 8, Township 2 North, Range 67 West of the 6th P.M., Weld, County, Colorado WHEREAS, the Department of Planning Services staff recommended the vacation of Special Review Permit#1162 due to the Conditions of Approval not being met, the Plat was not being recorded, the use did not commence, and the property has been sold to Craig Owen who intends to use the five acre parcel as a residential site, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the current property owner and the recommendations of the Department of Planning Services staff and all of the exhibits and evidence presented in this matter and, having been fully informed, deems it advisable to approve said vacation. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Special Review Permit #1162 be, and hereby is, vacated. Chester, Current Planner SUBJECT: Vacation of USR-1162 The Department of Planning Services' staff is recommending that USR-1162, for the Spanish Assembly of God, be vacated for the following reasons: 1. The conditions of approval were not met and the plat was never recorded. 2. The use did not commence. 3. The property has been sold to Craig Owen and he intends to use the five acre parcel as a residential site. This is a use allowed by right in the Agricultural Zone District. Weld Attn: Julie Chester JAN 0 41999 Dear Ms. Chester: Thank you for taking the time to educate me about the proc joie tr.Ll!sits. In the time that has danced since our last conversation, I have su y negotiated a contract for purchase of the 5 acre piece of property near the Enchanted Hills Subdivision. The legal description contained within the contract(enclosed for your reference)describes the property precisely,but the parcel is more widely known as the"Spanish Assembly of God"church property. Note the January 5, 1999 contract closing date. I have funding in place,the title work is scheduled for completion yet today,and there are no known obstacles that will prevent closing on January 5th. I have a valid contract on a new, existing,UBC factory-built home on the sales lot in Loveland, and have foundation subcontractors scheduled to begin work in late January. The building and septic application forms are completed as are the plot plan and dwelling construction drawings. The complete package will be delivered to your office, along with a copy of the deed on the day of closing: Tuesday, January 5. 1999. The process of establishing my primary residence on the 5 acre parcel is well underway. To avoid placing unnecessary schedule pressure on you and your office, I am forwarding this letter today, along with a copy of the purchase contract,to allow scheduling of events essential to the vacating process. I wish to have this letter serve as my official,written request to your Department,and ultimately to the Board of County Commissioners,to vacate the existing Special Use Permit associated with the Church's now defunct non-residential development plans for the parcel. I understand that I will be permitted to develop the 5 acre site(which is adjacent to my 75 acre farm)as my single family and primary residence. I further understand that due to negligible additional vehicle traffic compared to the Church's planned development, I will not be required to improve WCR 15 %:in any way.but instead will be allowed to leave it exactly as-is;an unmaintained and unmarked Weld County right-of-way. Thank you for taking the time to educate me on the requirements and specifics of the process,and thank you for volunteering to be the Planner to see the process through to its timely conclusion on my behalf.
