Dear Mrs. Hale,
I received your letter dated September 1, 1998. Since receiving your letter I have reviewed your
report of a heifer that was shot and killed. I have also spoken with Deputy Richardson regarding
this matter.
Our role in this case, as it is in other criminal investigations, is that of a collector of information.
The information is then forwarded to the District Attorney for a decision as to appropriateness of
charges. The District Attorney has the Statutory responsibility to make these decisions in every
criminal matter we investigate. Your case was sent to the District Attorney's Office for that
determination to be made. It is my understanding that someone from the District Attorney's
Office has been or will be in contact with you regarding their decision.
Based on the decision of the D.A.'s Office, Robert Drake was issued a summons for Cruelty To
Animals. Whether I personally agree or disagree with this decision has no effect on the filing of
Charges since it is beyond my Statutory responsibility. I am interested in the quality of the
investigation that the Deputies did regarding this incident. I am initiating a supervisor's inquiry
into this incident, and a supervisor from this Office will be getting in touch with you for
additional information you may have.
